Planning Commission - 08/22/2011 APPROVED MINUTES EDEN PRAIRIE PLANNING COMMISSION MONDAY,AUGUST 22, 2011 7:00 P.M., CITY CENTER Council Chambers 8080 Mitchell Road COMMISSION MEMBERS: Matt Fyten, John Kirk, Katie Lechelt, Jacob Lee, Jerry Pitzrick, Kevin Schultz, Jon Stoltz, Travis Wuttke STAFF MEMBERS: Michael Franzen, City Planner; Rod Rue, City Engineer; Stu Fox, Manager of Parks and Natural Resources; Julie Krull, Recording Secretary I. PLEDGE OF ALLEGIANCE—ROLL CALL Chair Stoltz called the meeting to order at 7:00 p.m. Kirk, Lechelt and Schultz were absent. II. APPROVAL OF AGENDA MOTION by Lee, seconded by Wuttke, to approve the agenda. Motion carried 5-0. III. MINUTES A. PLANNING COMMISSION MEETING HELD ON AUGUST 8, 2011 MOTION by Fyten, seconded by Wuttke, to approve the minutes. Motion carried 3-0. Pitzrick and Stoltz abstained. IV. INFORMATIONAL MEETINGS V. PUBLIC MEETINGS VI. PUBLIC HEARINGS A. VARIANCE#2010-01 by Kevitt Excavating Location: West of Shady Oak Road, South of Hwy 62 Request to: Permit a 10 foot high fence. The City Code maximum height is 6 feet. Jeff Habisch presented the proposal. He stated they would like to construct a 10 foot high fence to screen views of Highway 62. The current fence, which is a chain link fence, is a 5 1/2 foot fence. They would like the proposed fence to block the traffic that is coming down off the off ramp onto Highway 62. With the construction of the fence, they would like to create a nice atmosphere for this EDEN PRAIRIE PLANNING COMMISSION MINUTES August 22, 2011 Page 2 area. Mr. Habisch utilized the overhead projector to show pictures of the area, and pointed out the visible site line to Highway 62. Stoltz asked Franzen to review the staff report. Franzen stated this request meets the practical difficulty test and staff recommendation is for approval. Stoltz opened the meeting up for public input. There was no input. Pitzrick commented to Mr. Habisch there must be a lot of noise from Highway 62. Mr. Habisch stated there is a lot of noise coming off of Highway 62 but they are more concerned with the traffic and views. Pitzrick stated if the project proponent were to use a heavier wood it would cut down on some of the noise. Lee asked Mr. Habisch where the area will be for the fence. Mr. Habisch stated it would be just in the proposed area; which would be west of Shady Oak Road and south of Highway 62. MOTION by Pitzrick, seconded by Fyten, to close the public hearing. Motion carried 5-0. MOTION by Pitzrick, seconded by Wuttke, to recommend approval of Final Order 2010-01 based on plans stamped dated February 12, 2010 and the staff report dated August 19, 2011. Motion carried 5-0. VII. PLANNERS' REPORT A. DNR RULE CHANGE PRESENTATION This was a staff presentation from Lori Creamer, Administrative Assistant, Eden Prairie Planning Department. This presentation was about a DNR rule change that applies to lots that were created prior to the City adopting a shoreland ordinance in 1982. This rule change would allow a non conforming lot to be built on, without a variance, if the lot meets certain criteria. This new rule will make it easier for builders to construct on the lots. The next step in this process is to have Staff draft a code amendment and to come back before the Commission this Fall. VIII. MEMBERS' REPORT IX. CONTINUING BUSINESS X. NEW BUSINESS XI.
