MOTION: Popovich-Lynch moved to approve the minutes of April 19, 1993 meeting. Motion seconded by Brown. Motion passed 8-0. IV, PETITIONS- REOUESTS AND COMMUNICATIONS A. ]guest for Eden Prairie Figure Skating Club It has been recommended that the Eden Prairie Figure Skating Club "EPFSC"be allowed to install a jumping harness in the Olympic Ice Area to be used during EPFSC ice rentals under the supervision of EPFSC only. The jumping harness would be utilized to assist older skaters in the club by providing a means to better practice the art of skating jumps without falling. Parks,Recreation and Natural Resources Commission Monday,May 3, 1993 The harness will not be used during any public ice time including developmental ice time without the proper supervision of the EPFSC. All costs for the jumping harness will be paid for by the EPFSC. MOTION: Richard moved to approve the installation of the jump harness at the Olympic Ice Arena. Motion seconded by Hilgeman. Motion passed 8-0. DISCUSSION: Brown questioned the developmental ice time and the harnesses limitation of use as being the same time as the figure skating club time. Lambert clarified it as meaning that unless there is an instructor there that knows and can supervise the use of the harness,they would not allow any body to use it. B. Letter from Tom Larson.Minnesota Wildlife Refuge FYI item only. Lambert wanted the Commission to be aware of and understand the letter s .; outlining the proposed boundary additions of the Minnesota Valley National Wildlife Refuge is in a preliminary stage only. V. DEVELOPMENT PROPOSALS A. Fairfield West Phase 2 This is the Phase 2 project that was continued from July, 1992. The project will include an additional 11 lots on 6.3 acres. Popovich Lynch asked Lambert to clarify the status of the Natural Resources Committee's finalization of their priorities, if the Council approves a referendum what happens after that. Lambert explained that they are down to seven sites. The proposed schedule is to make a recommendation to the City Council at the July 6 meeting, assuming the Parks Commission and the Cultural Commission will be able to hold a joint meeting on June 28 to hear a special presentation from the Natural Resources Committee. If the final recommendation of the Committee includes the Fairfield West Phase 2 site as one of the sites it would like to acquire, it will then be the City Council's decision when and if it goes to a referendum. 2 •1 Parks,Recreation and Natural Resources Commission Monday,May 3, 1993 Popovich Lynch stated that the question is whether or not we want to lose the entire site to high-density zoning when the facts show the trees in that location are 150-250 years old. There will probably be substantial damage to those trees that will result from construction near the trees. She does not feel comfortable losing those trees to an experiment in which there will be no way to determine whether or not the experiment succeeded until 3-5 years after construction has been completed. Hilgeman feels that the "ultimate"tree lose will be much greater than the j originally stated 28%tree loss. Experts,including developers,believe there d is no way that a developer can develop the area as R1-13.5 and only loose i 28%of the trees. She does not believes that by zoning the area as R1-44 that it would mean bigger houses and amenities that would result in more '? tree loss. She believes that a homeowner in the R1-44 district would purchase a home because of the wooded lot and not take out trees or at the least limit any further tree loss. She does not support the zoning of the area as R1-13.5 and further states that it was meant to be zoned R1-44 only and it should remain that way. Brown asked Lambert why the Commission is put on the spot continually because builders want to build more than what is recommended to be there under R1-44 zoning always asking for twice as much as what is planned for the property. Lambert states that the property in question is not zoned R144 that it is zoned rural. Most land that is not developed in Eden Prairie is zoned rural. It is guided as low-density residential,which generally means R1-13.5 lots. He does not believe that Centex has come in"asking for twice as much as , what is planned for the property." Centex has followed the guide plans and requests set before them. The Big Woods is typically the kind of woods that would be considered to be zoned R1-44 because of the natural resources in the area. The reason Lambert recommended allowing this experiment, is because Centex has gone much further than any one else in the City has ever gone in trying to preserve trees. Centex shows that it is possible, although difficult, to develop this subdivision with only 28%tree loss. Lambert was very impressed with Centex and the extra effort and study they have put . v C 3 u a: I Parks,Recreation and Natural Resources Commission CMonday, May 3, 1993 forth in the development of this particular site,that it is really difficult to argue that we should not give them the chance to try to save those trees with their proposed controls. Lambert believes if the experiment were to actually work,that it would serve as a great standard as far as preserving trees for other developers developing in woods. If it doesn't work,Lambert would then recommend going back to 1 acre lots or scenic easements, or other restrictions that are appropriate and legal. F The city tree preservation ordinance states that we want to preserve 70%of the significant trees not all the trees. This site is a mature maple forest, 60% of the trees on this site are significant. In a typical subdivision in a typical w woods that has been developed 30% of the trees are significant and in a typical development there are only 70%of that 30%that are saved. In the Fairfield West development,we want to save 70%of 60%of the trees. This subdivision would remain more heavily wooded after development than most subdivision. Richard asks, at what point does the commission decide that the experiment has worked on these lots, do we allow the developer to develop additional �. lots? Lambert's recommendation is there would not be a final analysis of this experiment until 3 years after the last lot was developed. Putnam stated that Centex has been assessed for sewer and water, storm sewers that do not even serve the site,Candlewood Parkway as a collector street to serve the area that is currently there and for the future Scenic Heights Road. Centex feels fivstrated because its has been assessed for urban development and cannot get approval to develop the site. Centex feels they are being singled out by the City to a standard different from other developments. ' Richard believes that Centex and the Commission have the same intentions in mind in regards to the lot sizes being 1/2 to 1 acre in size. Richard feels that the Commission believes the bigger the lot the better likelihood the trees would be saved. Richard is comfortable with the 1/2 to 1 acre lot size. Bowman also believes that Centex has done an exceptional job to ensure there would be minimal tree loss. However, he does not feel comfortable with the project being an experiment and the jeopardizing of the trees. Hilgeman doesn't believe that Centex is being singled out. She states that it is unfortunate that Centex feels that way. She believes that Centex should 4 i r Parks,Recreation and Natural Resources Commission Monday, May 3, 1993 have known when it purchased the property that the property was of a great significant historical value to the City. She also states that if the Commission votes to approve zoning the property R1.13.5 that it would be going against its own City Code,Chapter 11,Land Use Regulation, Section 11.10, Subdivision 2. MOTION: Popovich Lynch moved to request that the Parks,Recreation and Natural Resources Commission deny the rezoning request from Tandem Corporation from rural to R1-13.5 on the 6.34 acres as well as the preliminary plat and other items as indicated in the staff report dated April 23, 1993, for the following reasons based on the City Attorney's memo: 1. The purpose ofRl-44 is to reserve appropriated located areas for single- family living on large lots with vegetations, slopes,water bodies or other significant natural features are best preserved through large lot development. 2. Rezoning to R1-13.5 district within the lot sizes are too small for the heavily wooded portion of the proposed development. �_. 3. If zoned R1-13.5 it is likely to cause substantial environmental damage by undue destruction of the woods. 4. Under R1-44 it should be possible to preserve at least 75%of the significant trees and tree mass in the R1-44 district(per the City Attorney's memo). 5. Based on what we know,we will not know the damage of the experiment until 3 to 5 years out and that it is inappropriate to design other areas based upon the extension of this experiment. Motion passed 6-1. DISCUSSION: Kracum states that the Big Woods is a mature forest. He states it is evident of human encroachment and ultimately the site will eventually be developed and he feels strongly that RI-44 is the appropriate zoning because key preservation is the utmost goal of the Commission. Richard is uneasy with the recommendation motion in that it seems that the Commission got an agreement from Centex to delay further development by 5 «. .......... Parks,Recreation and Natural Resources Commission Monday,May 3, 1993 allowing this experiment to happen and now it seems as though the Commission has possibly changed the experiment by adding a new restriction. Richard has been in favor of developing the old woods R1-44 and feels that 1/2 to 1 acre lots are fair. B. Sowles Property Penning Cross explained this development is located between Bearpath West and the Fairfield South addition on the East and is 162 single family lots with 32 multi-family lots. Lee Johnson, a representative of Orrin Thompson Homes, explained the 13.5 transition zone. The developer is proposing three zoning classification- R6.5, most of the balance of the property would be R9.5, and R13,5. t Brown was concerned about the north lots having been flooded a couple of years ago. The developer is not aware of any flooding. Brown possibly mistook the lots for another location. Richard spoke to a couple of homeowners up in the Fairfield area and expressed concerned about area traffic from the high-density area once developed. Johnson will be addressing the concerns with the City. He does i believe that people will use Dell Road to get to and from the area once the development is complete and does not believe there will be a traffic problem for residents in the Fairfield development. Bowman was concerned about the wildlife in the wetland area. Johnson explained that by not making the area a common area and by making the wetland area private ownership under a scenic easement,that it would be the best way to protect the wildlife and wetland area by limiting its use. MOTION: Popovich Lynch moved to approve the development project by Orrin Thompson Homes on the Sowles property according to the Planning Commission's Staff Report dated April 23, 1993 and the supplemental staff report dated April 30, 1993. Motion passed 6-0. IV. PETITIONS, REQUESTS AND COMMUNICATIONS None. V. DEVELOPMENT PROPOSALS A. Centex Deerfield Penning-Cross stated this project was reviewed at the Planning Commission on May 10, 1993, and was continued for two weeks due to some issues that needed to be resolved. Through the staff process,the issues have mostly been resolved with the exception of the assessments on Dell Road which will need to be addressed with the Engineering Department. The Parks Commission usually reviews a project after the Planning Commission makes its recommendation; however,to keep the developer on schedule, notices for a public hearing are being published for the June 1, 1993,City Council meeting. Dan Blake,Centex Homes, made a presentation of the proposed site. The proposed plan has four uses--neighborhood commercial,multi-family residential, single family residential, and a park and trailway system. The project will be built over a 34 year span. Trails and sidewalks will be built as per the City's requirements. 2 Approved Minutes Parks,Recreation and Natural Resources Commission Monday,May 17, 1993 Penning-Cross stated although this is one plan that is being proposed, it is two separate projects. The commercial project is separate from the housing project and regarding the removal of the NURP pond and cash park fees,the commercial will pay the cash park fees and the housing will not pay the fees. i Brown asked with the tree groupings on lot 5 (21.3 square feet),lot 6(18.8 square feet)and lot 16(25,000 square feet)would it be advantageous to make the lots smaller to save the wooded area? Blake explained the lot size f is not a factor as much as being able to grade Dell Road to serve the development south of it is. Hilgeman asked Penning Cross to explain why it was recommended in the Comprehensive Guide Plan to change the housing density to a higher density than what was originally shown on the Guide Plan. Penning Cross explained s the Guide Plan generally designates unzoned land as low density residential. With 212 and Dell Road going through the area,there are compelling reasons to upgrade the density so that there is multi-family and a small commercial area next to a major highway. Lambert questioned the time frame of the construction of trails as well as the grading of the park. Blake explained construction of the trails will be tied in ' with road construction as per the statFs requirements and the grading of the park would be done during the adjacent development. Richard requested Centex inform the buyers of the homes be notified of the trails behind their property. Penning Cross stated that if the trails go in with j road construction,the house should be under construction after the trail was constructed. Potential property owners will be aware of the trail prior to home construction. Richard wanted to know what is the City's protection on the park in the trade off of the land with MN-DOT. Lambert explained prior to the second reading on the development,the park, the plans,grading, and boundaries will have to approved by MIN-DOT and to the conditions approved by the Parks Commision and City Council. Bob Smith, representative for the commercial site, addressed the screening issues of the commercial site. The commercial site uses will be general retail, a restaurant and a gas convenience store serving the residential area. Screening of the light from the residential areas will be accomplished by 90' wide by 10'high berming with pine trees along both sides of the residential areas. 3 I i r Approved Minutes Parks,Recreation and Natural Resources Commission Monday,May 17, 1993 Lambert brought up the issue of pedistrian traffic to the site and a need to run a trail along the southern boundary to encourage its use rather than people trespassing through the surrounding properties to get to the site. Richard feels it would be a good idea to put a trail in. The developer will grade for a trail but will not put a trail in until facts show that people are actually walking through the properties to get to the site. The trail construction would then be a City responsibility. MOTION: Brown moved to approve the Centex Deerfield project as per the recommended acceptable changes of the May 7, 1993, staff report and the w completion of a trail easement along the southern boundary. Hilgeman seconded the motion. Motion passed 6-0. B. St. Ed-ward's Field This project is in the northwest section of Eden Prairie. Dan Herbst, Pemtom Land Company, reviewed the St. Edward's Field proposal. The development consists of 9 single family lots,the platting of the balance of the Dorf property,the Lunzer property and outlot A for the purpose of preserving the wetland. The variances that are being requested are a 25'front yard set back from variance on the right of Purgatory Creek. Also because this in a shoreline area, it is being requested there be a 120'front yard set back on two lots. These variances are being requested for the purpose of keeping the houses off the wetland. Penning Cross stated there are no significant trees on this site. Because this land is less than 10 acres of land the current policy does not require NURP ponds. The storm water will be handled by a 72" sump manhole which collects the sediment prior to it being discharged into the wetland. Popovich Lynch asked if this has already gone to the Watershed District and if they agreed to the filling of lots 4 and 5. Herbst stated it did not go to the ' district,normally the district does not review this on the basis of City Council back up. Penning Cross stated the wetlands that are being filled are going to be mitigated behind lot one and according to Watershed District standards. 4 I Approved Minutes Parks,Recreation and Natural Resources Commission Monday,May 17, 1993 MOTION: Hilgeman moved to approve the St. Edward's Field development project based on the conditions of the May 7, 1993, staff report and staff memorandum dated May 13, 1993. Kracum seconded the motion. Motion passed 6-0. VI OLD BUSINESS f A. Trapping„Ordinance .� Stuart Fox,Manager of Parks and Natural Resources reviewed the proposed , trapping ordinance. The ordinance was passed by the Parks Commission by a 7-0 vote in December 1992. At the first reading by the City Council,the Council made a revision to recommend the removal of leg hold traps from the ordinance. At the subsequent second reading, the City Council after hearing comments from several property owners as well as individuals fro the DNR,U.S. Fish and Wildlife Service felt it would be best to turn the ordinance back to the subcommittee for further refinement. At which time, the Trapping Committee met twice--once on April 12 and then on April 20, 1993,to iron out the changes. Fox highlighted a few of the changes that were made,all of which are spelled out in the proposed trapping ordinance. The decision was made that only original members would vote on the changes. Each change was reviewed piece by piece and then a vote was taken. It was not a concensus by reaching 100 percent of the unanimity, but there were majority votes on the proposed changes. i Hilgeman asked when somebody requests permission to trap outside the permitted area, does that individual have to prove or provide a record of methods used for elimination of the animal prior to the issuance of the permit. Fox stated it would come through the Wildlife Management Plan. Basically,the animal control officer meets with the homeowners,tries a variety of methods,providing such traps, sets the traps, and checks them. The officer documents the methods used to trap the animal so that if it were to ever come before the Commission, it would be known exactly what steps were taken. There were spectators at the meeting to speak against the ordinance. Richard Layborn,a non-voting member of the subcommittee strongly recommends the Commission reconsider the ordinance and prior to voting,to be aware and understand the leg hold traps. Elaine Sorenson, an Eden Prairie resident,wanted to bring to the attention of the Committee, subdivision 9B --the use of live traps are to be used only after using other S i • Approved Minutes Parks,Recreation and Natural Resources Commission Monday,May 17, 1993 reasonable efforts to use other non-lethal methods including but not limited to repellents, harassment and exclusionary devices. Linda Hatfield, a member of Friends of Animals,would like to see the use of leg holds for nuisance trapping only. Brown questioned because of the DNR's stand,the Commission cannot legally outlaw the use of the leg traps. Fox stated the Commission can ! prohibit trapping within the City and eventually the leg traps could become illegal but the DNR's position is either the City prohibits trapping all together or it allows trapping based on their laws. The City can determine where trapping can occur in the City, or if it can occur in the City,but the DNR believes that it is their responsiblity to regulate how trapping occurs. Popovich Lynch stated she feels that by taking into consideration the issues and concerns of the diverse groups represented at the meeting, the changes made were the best that the Commission could provide. She feels that it was a mutual compromise among all parties involved and that no one group came i out of the meeting as a winner. �.. MOTION: Kube Harderwijk motioned to approved the revised trapping ordinance. Hilgeman seconded the motion. Motion passed with S in favor with 1 abstention. Brown abstained, stating that he could not vote for trapping of any kind. VII. NEW BUSINESS A. Change Orders for Ampitheatre Stodge Buildinst Construction Penning Cross explained there were 2 change orders required for the Amphitheater Storage Building. The first one being,to do additional framing to correct a gap to properly align the joints and to seal the moisture out. The ! second change order,was to put an ADA(Americans with Disabilities Act) acceptable railing on the ADA approved ramp. MOTION: Hilgeman motioned to approve the change orders per the Staff Memorandum dated May 12, 1993. Popovich Lynch seconded the motion. Motion passed 6-0. 6 (!~ Approved Minutes Parks,Recreation and Natural Resources Commission Monday,May 17, 1993 B. Set Special Meeting Date for June 28 1993 at Outdoor Center Lambert explained that a special meeting between the Parks Commission, Cultural Commission,and the Heritage Preservation Commissions has been requested for June 28, 1993, at 7:30 p.m. At this meeting the Natural Resources Committee will present the recommendation of preservation of natural resource sites. A packet of information will be handed out prior the meeting. During the meeting the three Commissions will meet separately for discussion. The three Commissions will be requested to take action at this meeting based on the recommendation from the Committee and to forward the recommendations and coordinations from the Committee to the City Council for its July 6th meeting. C. Natural Resources Sutdy Committee Tour of Sites The Natural Resources subcommittee will be doing its final walk through of the sites on June 12, 1993,with the Naturalists Commission members. D. Potential Site Tom Richard requested Penning Cross to bring to the next meeting a list of potential site tours for the Commission. Miller and Pioneer Parks were recommended as well as the Aitkins and Swanson properties. These tours would be conducted the same way as the tours in past.
