Presbyterian Lot variance - Topview manse lot. Church PLANNING AND ZONING COMMISSION 6 August, 1968 The meeting was called to order at 8:00 p.m. by Chairman Nesbitt. PRESENT WERE: Ralph Nesbitt, Chairman Odmor Skjelbostad Vernon Emerson James C. Brown, Clerk Henry Hauser Quentin K. Wood, Engineer Homer Raguet Don Brauer, Planner ITEM 8-1-68 MINUTES OF 7-2-68 The chairman asked that the following corrections be placed in the minutes: Item 7-A-68 The motion should read, It was moved by Warren Shultz, seconded by Henry Hauser to recommend to the Council that they accept the Guide Plan as presented by Brauer and Associates. The motion carried. Item 7-2-68 The motion by Warren Shultz should read, motion was made by Warren Shultz, seconded by Henry Hauser to recommend to the Council rezoning the property, etc. The motion carried. Item 7-8-68 The motion should read, motion by Warren Shultz, seconded by Henry Hauser to recommend to the Council that the variance be denied. The motion carried. With these additions, the minutes were ordered approved as published. ITEM 8-2-68 PUBLIC HEARINGS 1. Jones-Garrison asked that their action be tabled until such time as a multiple zone be approved for the Village of Eden Prairie. Motion was made by Homer Raguet, seconded by Vernon Emerson to table any action on this until we have a multiple zone in our applicable zones for land use. The motion carried. 2. The preliminary plat of Crosstown Industrial Park. Information had not been completed for publication. Motion was made by Vernon Emerson, seconded by Warren Shultz to reset the hearing for the meeting of September 3, 1968. The motion carried. ITEM 8-3-68 HENNEPIN COUNTY HIGHWAY DEPARTMENT Revision on Shady Oak Road from Crosstown 62, South to 169. They are generally moving the entire road east until the road straightens to cross the proposed bridge over Highway 169. Motion was made by Henry Hauser, seconded by Warren Shultz to recommend to the Council approval for Layout County State Aid Road #61 alignment proposal as proposed by Hennepin County. The motion carried. ITEM 8-4-68 NICK SERIOS Mr. Serios was represented by Mr. Wood requesting that the Board approve the divison of two lots and authorize the easement for a driveway across one lot PLANNING AND ZONING COMMISSION 2 6 August 1968 to the second lot. There was some discussion on this matter. It was felt that the division should be so set that the second lot would include the area for the driveway and the area between the driveway and Willow Creek Road that was being left in the original lot. Motion was made by Homer Rauget, seconded by Henry Hauser to recommend approving the split providing the area of the driveway and the triangle of land between the driveway and the Willow Creek Road be part of the new lot and not carried as an easement. The motion carried. ITEM 8-5-68 CALVIN ANDERSON REPRESENTING THE EDEN PRAIRIE PRESBYTERIAN CHURCH Mr. Anderson appeared representing the Board of Trustees of the Eden Prairie Presbyterian Church asking for a variance on Lot 4, Block 1, Topview Acres to build a home closer to the lot line than the zoning ordinance required. They had approval from the adjacent property owner to come within 12 feet of the property line as their building is over 30 feet from the property line in this particular area. This lot is located on a curve and the lot, being pie shaped, in order for the house to be within a reasonable distance of the road, requires a variance. Motion was made by Warren Shultz, seconded by Henry Hauser to recommend to the Council granting the variance of the east side of Lot 4, Block 1, Topview Acres. The motion carried. ITEM 8-A-68 HERB MASON-EDEN PRAIRIE DEVELOPMENT CO PANY Mr. Mason appeared with Mr. John Rapp and Mr. Bill k Ellerbe and Mr. John Highland of Northwest Tel-E-Lect to present a detailed layout of the property of the Eden Prairie Development Company owns west of County Road #4 (Eden Prairie Road). They had several different proposals which they presented showing the layout of the industrial and residential area in this property along with the alternates depending on where the highway proposed by the State runs through the property. Mr. Brauer made certain comments regarding the area. He recommended that the Board approve the proposals, that he had recommended certain restrictions which would be placed on Tel-E-Lect and also that the balance-of the property for industrial be of the SI type, that there also be certain restrictions on the removal of natural screening material, such as trees and hills, etc. Mr. Mason was agreeable to this as were the representatives of Tel-E-Lect who felt that this was no problem. The Tel-E-Lect people could not abide by the SI ordinance as they do require outside storage of the completed units. Motion was made by Warren Shultz, seconded by Odmor Skjelbostad to recommend to the Council that the Eden Prairie Development Company's preliminary plans be approved subject to Mr. Brauer's conditions. The motion carried. ITEM 8-B-68 BUDGET FOR PLANNING AND ZONING FOR 1969 There was much discussion on this area. Mr. Brauer presented a proposal for his work in 1969 and also some other areas which the Board felt should be considered. PLANNING AND ZONING COMMISSION 3 6 August 1968 Motion was made by Henry Hauser, seconded by Vernon Emerson to request a budget of $10,000.00. Upon a roll call vote, Vernon Emerson voted yea, Odmor Skjelbostad voted yea, Homer Raguet voted no, Henry Hauser voted yea, Warren Shultz voted yea, and Ralph Nesbitt voted no. The motion carried. ITEM 8-C-68 CARRYING OUT THE REVISED COMPREHENSIVE PLAN Mr. Brauer asked that the Board consider certain phases which should be recommended to the Council. 1. The rezoning of certain lands. 2. The planned unit development. Motion was made by Odmor Skjelbostad, seconded by Vernon Emerson to recommend to the Council thatthey be authorized to consider rezoning all of the undeveloped land which does not fall under the zoning classifications in the new Guide Plan to a RA or R-1 category, to hold it open until such time as a developer has a plan for the area that meets the zoning classification of the new Guide Plan. The motion carried. Motion was then made by Vernon Emerson, seconded by Henry Hauser to recommend to • the Council that they adopt the planned unit development modification to Ord #8 conditions presenity on the site in the preliminary sketch plat.
