The meeting was called to order at 8:00 p.m. by Chairman Nesbitt. PRESENT WERE: Ralph Nesbitt, Chairman Odmor Skjelbostad Vernon Emerson James Brown, Clerk Henry Hauser Quentin Wood, Engineer Warren Shultz ITEM 3-1-68 MINUTES Motion was made by Henry Hauser, seconded by Warren Shultz to approve the minutes of 2-6-68. The motion carried. ITEM 3-2-68 DALE DALKE Mr. Dalke appeared before the Commission with a request to divide his lot into two lots and have the provisions of Ordinance ##93 excepted on platting require- ments as such. The lot which he has would be divided into two equal lots which would still meet all of the requirements for the zoning. Both lots would front on a public village road which is now in existence. There are no other require- ments that need to be met for the Village to approve this. Mr. Quentin Wood recommended that the Board grant Mr. DRlke his request as he has studied the property and felt that there were no drainage problems. The necessary easements could be put into the deeds that the Village might need for utilities. The road would be the present road and therefore no road dedication problems would need to be considered. Motion was made by Warren Shultz, seconded by Henry Hauser to recommend to the Council to grant an exception to Ordinance ##93 on the platting of property to Mr. Dale Dalke and recommend approval of his- splitting his present lot into two equal lots. The motion carried. ITEM 3-3-68 JOE SEMRAD - CEDAR FOREST ESTATES Mr. and Mrs. Semrad appeared with Mr. Don Coulter and all the nexessary maps for the approval of the preliminary plat on Cedar Forest Estates. Mr. Wood stated that Mr. Coulter had gone over the project and Mr. Coulter had done all of the necessary work to meet Mr. Wood's approval for the preliminary plat. All of the drainage, road grades, and so on were shown as required. Mr. Wood recommended that the Board now approve the preliminary plat as presented. Motion was made by Odmor Skjelbostad, seconded by Warren Shultz to recommend to the Council approval of the preliminary plat of Cedar Forest Estates. The motion carried. ITEM 3-4-68 HIGHWAY 169-212 Mr. Wood reported on a meeting held at the Village of Jonathan where some of the other communities were proposing certain re-routings of 169 and 212 and in these re-routings had split the road in Eden Prairie and made some very major changes within the limits of the Village of Eden Prairie. Mr. Wood had reported that as Eden Prairie had not been advised of these changes and would have to approve any change in alignment other than the present PLANNING AND ZONING COMMISSION MEETING 2 5 March, 1968 alignment which the Highway Department is working on that there could be no approval given by a committee from Eden Prairie at the meeting. He also felt that the routings as proposed were not of the best interest to the Village of Eden Prairie, would cause undue hardship in the community as it was going through areas that were already built up residentially or areas that were prime recreational sources: The present alignment which has been approved in the Village has been under consideration for some time and Village planning has been worked on this assumption and has approved or disapproved proposals along the alignment because the alignment was there and had been approved and the Village's position generally was that this was a good alignment for the Village. He stated that after the road leaves Eden Prairie's limits, we have no say over where it goes in other communities but we do have to grant approval to the Highway Department in Eden P-airie. He stated that this was just a report to the Board. It has already been made to the Council but this was to appraise the Board of this action. Clerk Brown reported on a letter which had been received from the Highway Depart- ment regarding the request by the Council to move Highway 169 approximately 1000 feet south of the railroad right of way between Eden Prairie Road and Pioneer Trail. The Highway Department had studied this and had felt that it was not feasible at this time with the time element involved in building the road to making a major change. Clerk Brown also reported that the Council had acted on this and had withdrawn • their request to the Highway Department for a re-alignment in this particular area. ITEM 3-5-68 PLANNING The Clerk reported that Mr. Brauer has prepared the initial stage of his plan for Eden Prairie and would be presenting this at a public meeting on March 19th. The Village had obtained the Eden Prairie School Cafetorium and all members were urged to attend. 2. Mankato School. The Clerk asked if there was anybody that would be interested. Mr. Emerson and Mr. Shultz expressed an interest in attending the meeting of March 30th. 3. General There was a request of Mr. Ralph Nesbitt's on the request from Chanhassen regarding the Tel-E-Lett proposal to build in Chanhassen Village in the area that had been annexed from Eden Prairie and would be basically surrounded by Eden Prairie. There was again some question as to what effect an operation of this type might have on the Village as Tel-E-Lett has proposed to construct an open type operation where sound would not be controlled and this certainly could have an effect on the surrounding area. It was also discussed that while this property had been annexed from the Village of Eden Prairie before it became a village and when Chanhassen Village consisted only of a small area around the Highway 5 and 101 interchange, since that time Chanhassen Village has been combined with Chanhassen Township to form . a large municipal area. This portion of land was in Hennepin County whereas the PLANNING AND ZONING COMMISSION MEETING 3 5 March, 1968 rest of Chanhassen was in Carver County. It did cause certain problems in administering the property from the County levels, elections and where people would vote and so on. This property was in the Eden Prairie School District while the rest of the property in Chanhassen is mainly in Chaska and some in the Minnetonka School District. It was felt that probably at this time it might be wise to take some action to have the County Boards reconsider this area and re-adjust the boundary to the original Eden Prairie- Chanhassen Village boundary and have this land annexed back to the Village of Eden Prairie. A motion was made by Henry Hauser, seconded by Vernon Emerson to recommend to the Council to take the steps necessary to re-adjust the border to re-assimilate by Eden Prairie the land that was annexed to the Village of Chanhassen in 1962. Motion was made by Warren Shultz, seconded by Odmor Skejlbostad that the meeting be adjourned at 9:00 p.m. The motion carried. 1 mes C. Brown, Clerk
