PLANNING AND ZONING COMMISSION 7 February, 1967 The meeting was called to order at 8:00 p.m. by Chairman Miller. PRESENT WERE: Arthur Miller, Chairman David Dale Odmar Skjelbostad Henry Hauser Ralph Nesbitt James Brown, Clerk Cecil Cruse Quentin Wood, APW James Hawks, Planner ITEM 2-1-67Z MINUTES JANUARY 3, 1967 On 'Item 1-A-67Z, add to the minutes; Motion was made by David Dale, seconded by Cecil Cruse to recommend to the Council that the Planning Consultant have a report on this area. The motion carried. With this addition, the minutes were approved as published. ITEM 2-8-67 PUBLIC HEARINGS M-2 TO R-I CONTINUED FROM JANUARY 3, 1967 As the Council had decided at the present time not to act on the request for a planner's report but to wait until the Council decided on further planning action by the community, the Zoning Board felt that without a planner's report on the area they would not make a recommendation at this time. Motion was made by David Dale, seconded by Henry Hauser to continue the Hearing until such time that we can receive a report from the planning consultant and all the persons would again be re-notified. The motion carried. ITEM 1-4-67Z DALE F. DAHLKE CONTINUED FROM 1-3-67 Mr. Dahlke has now decided to drop this until further notice. He will have to re-apply to be put on the agenda. ITEM 1-6-67Z JOE RUZIC PRELIMINARY PLAT CONTINUED FROM 1-3-67 Mr. Wood did not have the report completed and asked this to be continued until the February 21st meeting for further action. ITEM 2-2-67Z DICK STOCKSTEAD Mr. Stockstead appeared along with the Building Inspector, Mr. Richard Bren, to request a special use permit for the D-X Service Station on the southwest corner of Eden Prairie Road and West 78th Street. There was some discussion as to whether this was the best use for the corner, how it would affect the total use of the land in that immediate vicinity and the location of the station relative to the road. PLANNING AND ZONING COMMISSION 2 7 February, 1967 Mr. Stockstead said they had had-a preliminary talks with the Highway Depart- ment and were told that there would be no problem getting permits to enter and exit from State Highway 5 and the County Road #4. It was felt that they should have these permits so that we would know definitely what the Highway Departments were or were not approving before we made the final approval and recommended action by the Council. This item was continued until the meeting of February 21, 1967, pending Mr. Stockstead securing the necessary highway permits and bringing them to a the meeting. ITEM 2-3-67Z DON ANDERSON t0 Mr. Anderson appeared with Mr. Quentin Wood, the Village Engineer. They ex- plained that he had secured the mining rights from the Claredon Park people to remove the hill that forms part of the property of Claredon Park and also formed a joint boundary with Mr. Anderson's property and property owned by Mason-Hagen- ' Astleford-Carter. In securing these mining rights, it would now enable them to revise the grading plan of the entire area, including a new grading plan for the E� Claredon Park area. It would wind up with a logical grading plan for this area. C4 .< After much discussion, a motion was made by Ralph Nesbitt, seconded by David Dale A to recommend approval of the grading plan- for Claredon Park, Mason-Hagen-Astleford- ,_i Carter, and Don Anderson's property as per the revised map drawn by the Carter- 'O Krueger Associates, dated 12-66 and made part of the contracts. The motion carried. Motion was then made by Ralph Nesbitt, seconded by Cecil Cruse to recommend a mining license for the Claredon Park property. The motion carried. Motion was then made by Odmar Skjelbostad, seconded by David Dale to recommend to the Council that they take the necessary steps to procure the road right-of-way for the alignment between 169 and County Road #39. The motion carried. ITEM 2-4-67Z JOE SEMRAD Mr. Joe Semrad represented by Mr. Don Coulter presented to the Planning and Zoning Commission a preliminary plat of the Mr. Joseph Shidla property which Mr. Joe Semrad hopes to develope. Motion was made by Henry Hauser, seconded by Cecil Cruse to accept the preliminary plat for study and report by the Village Engineer. 1 The motion carried. ITEM 2-5-67Z FEEDERS INCORPORATED i; Petition from Mr. gene Reilly representing Feeders Incorporated was presented to the Board. Z Motion was made-. by Ralph Nesbitt, seconded by David Dale to set the Hearing for March 7, 1967 on this property. The motion carried. !J PLANNING AND ZONING COMMISSION 3 7 February, 1967 ITEM 2-A-67Z APARTMENT COMPLEX IN NORTHEAST CORNER OF VILLAGE Mr. Oscar Jones representing himself and Mr. Allan Garrison appeared with a proposal for the area between the old 169 and the new 169 in the northeast corner of the Village. This is a very hilly area surrounding a small pond and they are proposing an apartment complex in this area that would run in the neighborhood of approximately $3,000,000.00 in construction costs containing a variety of apartment buildings. The basic idea appeared to the members of the Board to be good and a good use for the land involved in this particular area. The Board was reminded by Mr. Hawks that under the existing zoning, a complex of this type could not be constructed and also would require the public sewer facilities to be feasible. Because of the basic idea that they generally felt that this type of develop- ment would be good in certain areas of the Village, a motion was made by Ralph Nesbitt, seconded by David Dale to recommend to the Council to instruct the planner to come up with an ordinance on multiple dwelling and planned unit development areas. The motion carried. ITEM 2-B-67Z NORTHERN CONTRACTING A letter was received from Northern Contracting requesting the special use permit for their Minnetonka Blacktop Plant be renewed for the year 1967. Motion was made by Ralph Nesbitt, seconded by Henry Hauser to recommend to the Council to renew the Blacktop permit. Mr. Cecil Cruse requested that it be recorded in the minutes that he abstained from all action on this matter and is so recorded. The motion carried. ITEM 2-6-67Z MINNESOTA HIGHWAY DEPARTMENT APPROVAL OF LAYOUT 7H Mr. Quentin Wood explained that it was a new layout from the Highway Depart- ment covering an area previously approved whereas the Highway Department was enlargir� some of the road net along Highway 5 to include frontage roads and felt that this was the point where we should request a diamond or half-diamond on 'the Interchange at Highway 5 and Mitchell Road. It was felt that this could best be accomplished by meeting with the Highway Department, the Zoning Board and the Council. Motion was made by David Dale, seconded by Cecil Cruse to have the Council set the meeting date for this special meeting with the Highway Department. Ralph Nesbitt voted no, Henry Hauser voted yes, David Dale voted yes, Cecil Cruse voted yes, Odmar Skjelbostad voted yes, and Arthur Miller voted yes. The motion carried. PLANNING AND ZONING COMMISSION 4 7 February, 1967 ITEM 2-C-67Z JAMES-LOWINK-GLEASON-SHULTZ PROPERTIES FORMERLY THE LUCAS PROPERTY In a recent series of hearings and rezoning matters, it was felt that this property was properly rezoned. Now it appears that in a dropping in part of the legal description, the publication did not cover this particular piece of property. In order to get this property correctly zoned, it would be nec- essary to go through the procedures of setting a hearing date and holding the necessary rezoning hearing and making a recommendation. Motion was made by Ralph Nesbitt, seconded by Odmar Skjelbostad to set the hearing date on the James-Lowinski-Gleason-Shultz property for March 7, 1967. The motion carried. ITEM 2-7-67Z 701 PLANNING Because of the lateness of the hour, a special meeting is to be held on the night of February $, 1967 at 8:15 p.m. Motion was then made by Henry Hauser, seconded by Ralph Nesbitt that the meeting be adjourned at 12:05 a.m. The motion carried.
