PLANNING AND ZONING COMMISSION 16 August 1966
The meeting was called to order at 8:00 P.M. by Chairman Arthur Miller.

ITEM 8-6-66Z MINUTES OF AUGUST 2, 1966
Motion was made by Dr. John Wright, seconded by Anthony Hirt to approve the minutes
of August 2, 1966 as publiched.
The motion carried.
ITEM 8-7-66 PUBLIC HEARINGS
1. Bren, Kusisto, Dvorak, Greguson, Wright property which was continued from
August 2, 1966. Mr. Greguson who represented the petitioners appeared before
the Zoning Board and requested that the Hearing be continued until next meeting
as the petitioners were preparing additional information which they wish to
present and also they were preparing information where they wished to withdraw
certain areas from the petition and this was not ready at the present time. Mr.
Hagstrom, an attorney representing certain of the residential people in the area
who are opposed to the rezoning presented amemorandum. All of these notes and
the memorandum are in File No. 16.
Motion was made by Cecil Cruse, seconded by Albert Picha to continue the Hearing
until September 6, 1966.
The motion carried.
2. Greg Redpath request for rezoning.
No information had been received from the Park Board as yet on the Zoning Board's
request to have them look at the property and make a recommendation to the Planning
and Zoning Board.
A motion was then made by Anthony Hirt, seconded by Ralph Nesbitt to continue
the Redpath Hearing until 9/6/66 and to request a report from the Park and Recreation
Board on this area for the Village.
The motion carried.
ITEM 8-4-66 ALLAN GARRISON-OSCAR JONES
The parties did not appear before the Zoning Board with any further information.
No action was taken on this matter.
ITEM 8-5-66 ROGER STOLTZ request for a mobile home
This apparently has been dropped as the Building Inspector has advised Mr. Stoltz
that the home was not presently a complete residence as it only has one exit door.
No other action was taken on this matter.
PLANNING AND ZONING COMMISSION - 2 16 August 1966
ITEM 8-8-66Z MICHAEL SILL AND PRESTON HAGLIN
Mr. Sill and Mr. Haglin appeared before the Planning Commission with their re-
quest to put in all weather 9 ton road to service an Industrial site which they
had previously purchased in the Industrial area in Eden Prairie which they now
hope to begin development proceedures in.
The proposed road that they pvpose to put in would go on the Easterly 16th line
of Section 19, from County Road #1 to the North boundary of their property. In
looking at this the Planning and Zoning Commission felt that their proposal had
real merit and that there should be an alignment road between present State High-
way 5 and County Road #1. That action should be taken to approve this alignment
and get it as part of the permanent records.
A motion was made by Dr. Wright, seconded by Cecil Cruse to recommend to the
Council that alignment for a road going between State Highway 5 and County Road #1
which would follow the Easterly 16th line of Sections 18 and 19 as they fit into
this particular area.
This alignment may vary slightly with the necessary field engineering that would
be required with putting in the road but this is the basis for the alignment.
The motion carried.
Motion was then made by Ralph Nesbitt,:-�seconded by Cecil Cruse to recommend
approval of the layout for a road on the property of Sill's and Haglin as the road
would be on the recommended alignment as shown on the proceeding motion and to
recommend to the Council that the Village personnel work with the Eden Prairie
Land Venture people, Mr. Sill and Mr. Haglin on the requirements on this road so
that an approved road can be properly constructed in the area.
The motion carried.
ITEM 7-7-66Z M.F. GRILL report on the Dump Ordinance
Mr. Grill had requested in a telephone conversation with the Clerk, that unless
there was something urgent about it that the matter be continued until the Sept-
ember 6 meeting.

Motion was then made by Cecil Cruse, secondedb%_lbert Picha to table it until
September 6, 1966.

ITEM 7-5-66Z JOE RUZIC
Mr. Ruzic again appeared before the Planning and Zoning Commission with a proposed
plat along Shady Oak Road. He still proposes to remove most of the top of the hill.
The problem of road access from one road to another was discussed. It was generally
felt that the best access to the area and the best use of the land for the Village,
was to come in from Rowland Road and develope this as part of an over-all develop-
ment including other properties in the final plan.

There was much discussion on this matter as to how this could or not be done and
where the road should or should not go. There was no final action taken. Mr.
Ruzic apparently does not want to go through a rezoning proceedure and will again
attempt to come in with a plan that will meet with Planning and Zoning Commission's
approval.
No other action was taken on the matter.
ITEM 8-D-66 WARREN PETERSON, BRUCE HEPP
The gentlemen appeared before the Planning and Zoning Commission requesting
permission to move a building presently used as a Chapel by the Betheny Fellow-
ship in Bloomington to a site which they have recently purchased from Mr. M.F.
Grill on State Highway 169 and for which they have a pending request for rezoning
from POC to Commercial.
There was much discussion on this matter but it was generally felt that to grant
approval to move the building before the zoning had been approved would not be
appropriate.
It was felt that the Building Inspector and the members of the Zoning Board who
normally would make an inspection of a building to be moved could have made the
inspection prior to the September 6 meeting, at which time the Public Hearing
on the zoning will be held and at that time the rezoning approval is being re-
commended to the Council. The approval for the removal of the building from
outside the Village into the Village could also be recommended if it was felt that
this was a good recommendation to make..
Mr. Anthony Hirt felt the other members of the Zoning Board who would not be
making the official inspection should for their own personal satisfaction make
an inspection of the building prior to the September 6th meeting so that they
have knowledge of it when it came before the Planning and Zoning Commission. The
parties were advised that no action would be taken on the recommendations on this
until after the Public Hearing had been held.
Motion was then made by Cecil Cruse, seconded by Ralph Nesbitt to request a report
from Midwest Planning on this rezoning and to request a report in writting be
mailed to the members of the Planning and Zoning Commission, prior to the September
6th meeting.
The motion carried.
ITEM 8-C-66Z CALVIN ANDERSON
Mr. Calvin Anderson appeared before the Planning and Zoning Commission to request
a variance in the construction in a home in Topview Acres. Mr. Anderson is the
owner of the adjoining lot and had been advised by the soil boring people that the
home should be moved closer to the road for better soil stability.
The motion was made by Dr. John Wright, seconded by Albert Picha to recommend a
variance from the 50 foot set-back not to exceed ten feet on the lot.
The motion carried.

ITEM 8-F-66Z MAPPING OF THE VILLAGE
Mr. Bruce Hamlin, Mr. Quentin Wood, and Mr. Virgil Muller appeared before the
Planning and ZoningCommission and asked them to make a recommendation to the
Council that the Council consider obtaining the complete contour map of the
Village of Eden Prairie. Mr. Hamlin explained that the map would cost over
$60,000.00 but that the Mark Hurd people would be willing to finance the Village
on a two year program.
It would take approximately one year to complete the entire ma There were
proposals that possibly the Federal Government would grant a low interest loan
to the Village for the map. Mayor Osterholt who was in the audience at the time
asked that the Zoning Commission if they do make a recommendation, give some of
the reasons why they are recommending the procurement of this particular item.
Motion was then made by Anthony Hirt, seconded by Dr. John Wright to recommend to
the Council that the Planning and Zoning Commission is interested in the map which
would give a complete topograpical picture of the Village and to suggest to the
Council the procurement of this map at the pes94491 earliest possible time in
line with good budgetary planning.
The reasons for requesting this fnap:
It is needed to properly align roads.
. It would be needed for water and sewer layouts.
It is needed in making preliminary studies on plats.
It is needed to know where proper drainage areas should be located.
It is needed when a plat comes in to know the location and layout of the plat fits
to the best advantage of the Village, the adjoining property that the plat normally
would not consider.
It was felt that a map of this type would be used almost constantly by the Planning
and Zoning Commission and if the Village went into a 701 plan this map would be in-
valuable aid in finalizing the 701 type program.
The motion carried.
Along with the Planning proceedures, Mayor Osterholt asked the Planning and Zoning
Commission to consider making a recommendation to the Council of some type of
Planning g either 701, a Village finance plan, but to express something to the Council
or to no planning whatsoever so that the Council could properly act on it. He asked
for the people to give a recommendation as soon as possible after they had given the
matter some thought.
ITEM 8-G-66Z BLUE SKY ADDITION
The final plat of Blue Sky Addition was presented to the Planning and Zoning Com-
mission. It was recommended for approval by Engineer Wood. The Commission -pe=
members having gone over the preliminary plats and were advised that no changes
had been made in the final plat.
A motion was made by Ralph Nesbitt, seconded by Anthony Hirt to recommend approval
of the final plat and authorize the Chairman and Clerk to sign the plat.
The motion carried.

PLANNING AND ZONING COMMISSION - 5 16 August 1966
ITEM 8-H-66Z REZONING OF THE BALANCE OF THE WARDEN PROPERTY BETWEEN SCENIC
HEIGHTS ROAD AND OLD HIGHWAY 5 AND NEW HIGHWAY 169.
Mr. McDonald and Mr. Morehouse presented a petition to rezone the balance of
this piece of land. Previously the Easterly part of the land had been rezoned
to SI at the request of Research, INc. It was felt at that time by the Plann-
ing and Zoning Commission that the balance of the land should have been rezoned
and a recommendation had been made to the Council but because it had not been
properly published, the Council could not act on this particular parcel. .
Motion was then made by Dr. John Wright, seconded by Cecil Cruse to set the
Hearing Date for September 6, 1966 to rezone the balance of the Warden property
from RA to SI.
There was some discussion along this line along with Item 8-9-66Z which the
rezoning of the Warden property should be enlarged to include an additional area.
At the request of the Zoning Board the Clerk had written to the Research, Tran-
sistor, and-Char-Lynn people requesting their feelings on having their properties
W rez oned:'- 'All had answered in the affirmative and the Zoning and Planning Board
have already acted on the Research and Transistor property. This would give them
a chance to act on the Char-Lynn property, also to consider the balance of the

M-2 property along Highway 5.

A motion was made by Cecil Cruse, seconded by Dr. John Wright to enlarge the area
M'_�V for the Hearing on September 6 to include the Shultz property, the char-Lynn
property, the Zero-Max property, the Louver property, in fact all of the M-2
property between County Road 04 and Scenic Heights Road on both sides of Highway
E" #5.
The motion was carried.
