Grill Sanitary land fill on his property ZONING AND PLANNING COMMISSION MEETING 19 July, 1966 The meeting was called to order at 8:00 P.M. by Vice-Chairman, Cecil Cruse. PRESENT WERE: Anthony Hirt David Dale Ralph Nesbitt James Brown, Clerk Dr. J. Wright Quentin Wood, APW Cecil Cruse, Vice-Chairman James Hawkes, Planner The minutes of July 5, 1966 were read and approved as read. ITEM 7-2-66Z PUBLIC HEARINGS 1. Keith James-Warren Schultz-J.V. Gleason, L.P. Lowinski Mr. James appeared before the Planning and Zoning Board and requested that the hearing be continued until August 8, 1966, as certain of the key people he had to present information to the Planning and Zoning Board were not available due to summer vacation periods. Mr. Spencer Kluegel, the attorney for the home wowners in the area, appeared and stated that his people were ready to proceed with the Hearing. Mr. Anthony Hirt stated that they had postponed the Hearing or continued the Hearing from the last meeting due to the home owners, he felt that it was only fair to allow the same courtesy to the petitioners. A motion was then made by Ralph Nesbitt, seconded by Anthony Hirt to continue the Hearing until August 8, 1966. The motion carried. 2. Northeast area of the Village as published is the area covered by Highway 169, County Road 18, and the North quarter section line of Section 12. There was some discussion as to why this large area was published. It was explained that the publication was set up large enough to include any area that the Board might want to consider but not necessarily rezoned or all the area being shown in the publication. The basis for this is the redoing of the areas in the rezoning of Research Incorporated to properly zone the area and also to change the zoning from the M-2 Industrial to the Sl Industrial, also to do this for Trantstor Incorporated. No one appeared to oppose-the Hearing. The Hearing had been ordered by the Planning and Zoning Board so no one appeared to represent the parties to be rezoned. Motion by Anthony Hirt, seconded by David Dale, to recommend the Council to change to S1 the M-2 area occupied by Research, Transistor and the Kopesky property and the R-A area on the corner of County Road 18 and State Highway 169. The motion carried. They also felt the Council should take under advisement for future consideration, not necessary rezoning, the entire area North of the proposed road between Shady Oak Road and County Road 39. In this area to eventually all to be Special Industrial Zone. ZONING AND PLANNING COMMISSION MEETING - 2 19 July, 1966 3. Greg-Redpath Mr. Redpath did not appear at this particular meeting. We had no communications from the Park Board on the property. Motion was then made by Ralph Nesbitt, seconded by Dr. J. Wright to continue the Hearing until August 16, 1966. The motion carried. ITEM 7-3-66Z MRS. HOPE LINDMAN Mrs. Lindman and her associates had a large mobile home parked in the parking lot west of the Village Hall which they invited the members of the Planning and Zoning Commission to view and to the various other individuals who appeared that evening. They also showed a film on mobile home parks versus trailer parks and showed a preliminary plan for a mobile home park on land owned by Mrs. Lindman on Highway 169 between Purgatory Creek, Starring Lake and the Northrup King property. It was explained to Mrs. Lindman that under the existing Ordinances, a mobile home trailer park or whatever you wanted to call it was not allowed in the Village of Eden Prairie. In order to allow a Mobile Home Park, it would require a new or change in Ordinances to put this into consideration. There was a certain amount of discussion on how this could be handled and it was felt that if an Ordinance was drafted, presented to the Zoning Board and they held one or more Public Hearings on it, getting the feeling and • temper of the people is the Village as to whether or not they wanted this type of residential Ordinance, that this would be the fairest way for these people who have petitioned for a mobile home trailer park, automotive court or what have you, type construction in the Village and for the citizens in the Village to be heard and present their views. A motion was mhde by Ralph Nesbitt, seconded by Dr. J. Wright to recommend to the Village Council and that they have an Ordinance drawn up covering Mobile Home Parks. After the Ordinance is drafted, the Ordinance is to be returned to the Planning and Zoning Board for Hearings and recommendations. They have set a target date of September 20, 1966 for the Ordinance to be returned to the Planning and Zoning Board. The motion carried. Mr. Goetze requested permission to speak and stated that he felt that the Village should look into land use and formulate a long range plan. ITEM 7-4-66 SKY BLUE ACRES Preliminary plat Mr. Evert appeared with his preliminary plat. Mr. Wood recommended approval of the Plat as the only basic difficulty would be the determination of the first floor level of the homes that might be built on any of the lots and this would be actually a problem which the Building Inspector could solve by properly setting the stakes for the elevations. Other then that, the drainage, the location of the property along the existing County Road, the size of the lots, all meet the Village requirements. u ZONING AND PLANNING COMMISSION MEETING - 3 19 July, 1966 A motion was then made by Anthony Hirt, seconded by David Dale to recommend approval of the preliminary plat of Sky Blue Acres. The motion carried. ITEM 7-5-66 JOE RUZIC Mr. Ruzic has a preliminary plat on Shady Oak Road, Mr. Wood stated that Mr. Ruzic's original preliminary plat did not present any good platting to the Village and re- commended that no action be taken on it. Mr. Ruzic also felt that this preliminary plat that was presented at the last meeting was not good and presented a new preliminary plat on the same area. In this particular plat he had proposed a very graphic grade setting in order to make or manufacture lots on this land. It was generally felt that the development of this area tied too closely to the existing property to plat this particular piece without being cognizant of the existing property and :._make this plat tie to the property adjoining it so that it would properly be laid out for lot sizes, lot locations, road accesses, it was also felt that the area should not be regraded to level land because it makes for more lots but the lots thht dht-Ni to natural characteristics which makes them desirable for home sites should be left in this manner. A motion was made by David Dale, seconded by Anthony Hirt to request Mr. Ruzic to do further work on this plat and do some work with the Engineer, Quentin Wood in tying this plat into what might or might not be done in the areaadjacent to it so that it • does not become an isolated area. The motion carried. Q ITEM 7-6-66 JOE RUZIC SANITARY LAND FILL ON THE WILLARD ANDERSON PROPERTY All of the information had not been completely disseminated to the Planning and Zoning Cir Board on Sanitary land fills. Mr. Ruzic said that he would like to present a demon- stration. It was felt that an actual demonstration of the land would not be appropri- ate until it was agreed on that this would be a suitable area for this type of operation. He then stated that he had pictures of the operation both in slide and motion pictures which would be presented to the Zoning Board at their meeting of September 6: ?No other action was taken at this time. ITEM 7-7-66 M.F. GRILL CIO Mr. Grill appeared before the Planning and Zoning Commission to request reconsider- u- ation of his request for Sanitary Land Fill on his property located east of the ,p Flying Cloud Drive In Theater. He stated that this would be a fill operation in a large hole to bring the hole up to grade level where it could be built on. The entire operation would be completely hidden from the view of Highway 169, County Road 1, or any other operations in the areaas the hole at the present time ran from 50 to 100 feet deep and they would be worki-n g in the bottom of the area. Mr. Grill had certain plans for the operation of the Dump which he presented verbally to the Planning and Zoning Commission. There was some discussion on this particular piece of property as it had been previously considered for a site for a possible land fill dump in order to make the particular area more useable then it presently is. ZONING AND PLANNING COMMISSION MEETING -4 19 July, 1966 Motion was then made by Dr. Wright, seconded by Ralph Nesbitt, to have the Chairman appoint a committee to study the M. F. Grill dump site and report back at the next Zoning and Planning Meeting. The motion carried. Chairman CDuse had appointed on the committee Dr. Wright, Ralph -Nesbitt, Anthony Hirt, and David Dale. They all agreed to serve on the committee. ITEM 7-C-66Z RESEARCH INCORPORATED Mr. Herb Johnson, President of MTS Division of Research Inc. appeared before the Planning and Zoning Commission. He presented a letter signed by Mr. Kenneth Anderson, President of Research Incorporated, requesting a Special Use Permit for the construction and operation of a plant in the property which they have recently pur- chased at the triangle made by the Intersection of old State Highway 5 and State Highway 169 on the property formerly owned by Kenneth Anderson, and L. M. Warden. Mr. Johnson also presented a drawing showing the area that they have the proposed plant location and additions which would be built on the plant in the future. They also had a mock-up model showing the area with the area showing the contours presently on the ground and the area which would be necessary to be regraded in order to accommodate the plant and how the additions of the plant would be fitted in this particular area. The Planning and Zoning Commission was impressed with the work done by the people of Research Inc. in preparing this information for them and felt that the site plan, the building, the architecture, and the over-all use of the area would be an asset to the Village as presented by the people from Research Inc. and Mr. Johnson. Motion was then made by Ralph Nesbitt, seconded by Dr. J. Wright to recommend approval to the Council of the plat plan or site plan in the Special Use Permit. The motion carried. ITEM 7-D-66' HENNEPIN COUNTY HIGHWAY DEPARTMENT PROJECT 6518 and 6622 for CSAH 625 61 and 18 from 400 feet west of CSAH 61 to the trunk '.Highway 169 CSAH 62 and 18 Interchange Mr. Wood presented a request from the office of L. P. Paterson, Hennepin County Highway Engineer that we approve layout 8C on the above subject project. The change in layout 8C involved the road which would provide access from old 169 to old County Road 18 or the Service Road along the area by Research Incorporated. They had changed the original plan which was a weaving plan to a normal straight corner type access in the area. This gave a better traffic control feature to the area and appeared to be a good change in the plan. Motion was made by Dr. Wright, seconded by Ralph Nesbitt to recommend to the Council approval of layout 8C. The motion carried, Motion by Dr. Wright, seconded by Ralph Nesbitt that the meeting adjourn. The meeting adjourned at 11:30 P.M. The motion carried. Ja s C.
