Planning Commission - 09/21/1965 Zoning & Planning Commission Meeting 21 September, 1965 The Zoning & Planning 6ommission met in the Eden Prairie Village Hall on 21, September, 1965, at 8 o'clock P. M. Present were: A. W. Miller, Chairman Dr,John H. Wright Anthony R. Hirt Cecil C. Cruse James C. Brown, Clerk David W. Dale Ralph J. Nesbitt James Hawkes Quentin K. Wood, APW ORDER OF BUSINESS: MINUTES Approved minutes of 7 September, 1965, as published. SALLY FISTIER SHAPER Request for special use permit for addition to residence to house dogs. There was much discussion on this matter. The Village attor- ney advised that the building inspector could issue permit for ad- dition if it met building standards. As our Ordinances do not de- fine a kennel other than stating a kennel requires a special use permit. The point of contention was whether this was or T•ras not a kennel operation. Mr. Dale requested a short recess and the Board adjourned to the lower level where Dr. 7Tright stated that the party was what was known in the trade as a "groomer" and had operated com- mercially in the past in Edina. After further discussion with Mr. Branstetter as to the use for the property they withdrew the applica- tion for a special use permit and will request a regular building per- mit for an addition to a residence. DEFUTITION OF KENNEL Motion made by Anthony 'R. Hirt and seconded by David W. Dale to recommend to the Council adopting the following definition: Kennel - is a property on which three (3) dogs over six (6) months of age are kept for I�he purpose of a pet, boarding, stud service, train- ing and shall also include grooming, hair cutting, obedience schools or other purposes where a service is offered on the site. Motion carried. NAEGEIE OTITDOOR ADTTERTTSING COITPANY Request for a sign on F. T. Smisek property. ITotion made by Dr. John H. SrTright and seconded by Cecil C. Cruse to recommend denial of request. Motion carried. Zoning & Planning Commission Meeting --2 21 September, 1965 JD.l ROSS Variance for a garage on Lot 1,, Block 3, Padon Dorms 2nd Addit- ion. Mr. Ross's house faces Barberry Lane - the garage to exit on Padons Drive. Request a variance for 33 to 16 feet. Mr. Kelly, own- er of the adjoining property to the east, signed a statement approving the variance. Motion made by David W. Dale and seconded by Dr. John H. T,Tright to recommend variance be granted for the reasons that the adjoining property owner ar>proves, it does not change the area and the basic distance between buildings is maintained. Motion carried. S TEWART I -FRA-RED COPSIISSARY OF MINN. These people had received approval of their basic site plans etc. at the Zoning meeting of 7 September, 1965, but at that time were den- ied approval on the drive-in restaurant. Mr. Sween, Mr. P-Torehouse, 11r. Taylor and others requested the drive-in be given approval. Motion made by David W. Dale and seconded by Anthony R. Hirt to deny the drive-in restaurant operation in this S-I zone. Aye - Dale, Hirt, and Brown . Nay - Dr. T,Tright, Cruse, Nesbitt, and Miller Motion defeated. Motion made by Ralph J. Nesbitt and seconded by Cecil C. Cruse to recommend approval of the drive-in sugject to the ordinances. Aye - Dr. TnTright, Cruse, Nesbitt, and Miller Nay - Dale, Hirt, and Brown T''otion carried. M LLER BROS. REZONING RE -VEST Mr. Morehouse representing the Miller Bros. presented a request to rezone land in Parcels 2000, 8230, 5820, 58303 5000, 5810, 6200 in Section 17, from 11-1, POC, RC, R-21 C-1 to C-2. Notion made by Anthony R. Hirt and seconded by Dr. John H. Wright to accept petition for hearings. The Village attorney to check the petition for co °rect zoning and description so proper area can be des- cribed. Hearing set for 5 October, 1965, -,check for85.00 received. TZotion carried. S TGNS Motion made by David W. Dale and seconded by Anthony R. Hirt to recommend to the Council a policy of no new signs except on the pre- rise advertising the oi,:mers business or product.
