PLANNING AND ZONING COMMISSION
Tuesday, August 5, 1969 7:30 P.M. Village Hall
Members present, Odmor Skjelbostad, Chairman, -Messrs, Vernon
Emerson, Homer Raguet, Henry R. Hauser, Norma Schee, Marvin LaGrow.
George C. Hite Village Manager was also present.
I. PUBLIC HEARINGS
A. R. Kerber. Property Division. Section 7. The Village Manager
presented and recomme;`..:ed favorable action on a report by Mr.Kerber
to divide off a 220' (E.'W.) by (N.S.) portion of his
property. The tract, labled Tract A on Mr. Kerber's survey, would
have access to Gilmer Avenue. The proposal included a 30 foot
easement for road purposes along the north side of Tract A to
accomodate the future extension of Kilmer Avenue. The Manager
futher recommended that the Kerber's be required to enter into
anagreement with the Village wherein their Tract A would be included
in the future platting of the remainder of their property. Mr.
Schultz moved that the Planning Commission recommend to the
Council that the property division be approved; as recommended by
the ;Manager. Mr. Emerson seconded. All voted aye. Motion carried.
Ii. PROPOSED ZONING ORDINANCE
T e Village Manager reported that the Council had asked the Commission
to give additional consideration to the land classification• partiCularly
in light of the presententations made to the Council at their meeting
on July 8, 1969.
Planning Consultant Don Brauer and the Village Manager presented a
series of recommendations with respect to the Zoning Map which they
said would futher the objectives and purposes of the proposed Zoning
Plan, while adequately safegarding the rights of property owners.
They recommended that a new district, labled Plan Study (P.S.) , be
added to the text portion of the Ordinance, for the purpose of
permitting an intermediate classification, without prejudice, for
properties in areas of significantly changing conditions, or inadequate
Zoning regulation. Where new or revised classifications or regulations
may be necessary during the period of specific study and recommendation.
The Plan,►er and Manager responded to a number of questions about their
recommendation.,
Mr. Howard Dahlgr��n a E lanni ing Consult n-' representing the owners of
approximately 520 acres of land west of Co. Rd.4 and north of Co, Rd.
1 said that his clients 'land had great industrial development potential
and that such development would be an asset to the Village.
Mr. Bruce Barton, an Attorney representing, Minneapolis Florel Co.
the owners of about 53 acres between T H 5 and Valley View Road
just west of the railroad stated his client was opposed to the
proposed Rurel classification and presented Mr. Maurice Scroggin who
+ said the highest and best use of the land would be multiple family.
Mrs.George Hussman a resident of Golden Ridge Road, presented and read
a letter dated August 5, 1969 in which she and seven of her neighbors

stated their objections to the Guide Plan designation of the Area
bounded by T.H. 169, the Crosstown and Shady Oak Road as an
industrial area. The letter asked that the Planner give greater
recognition to the desires of those now living in the Village, when
he prepared his recommendations.
Mr. Loren Knott, an Attorney representing Union Oil Co., stated
that his client had purchased the northwest corner of Co. Rd. 4
and T.H. 5 at a commercial price and had made a substantial
investment in planning for its use as a commercial site. He
said that Union Oil Co. would strongly object to anything other
then Commercial Zoning of their property.
Mr. Leonard Gran ps, 6990 Merlann Drive, asked about the revision
clause in the proposed PS District provisions and was advised by the
Village Manager that the Zoning districts now in Village Ordinance', No.
8 would no longer exist upon the adoption of the new ordinance.
Mr. Grannes also asked about the reason for the Guide Plan proposal
for Multiple Family use in the northeast quardant of Valley View
Road and Baker Road and was advised that the proposal included the
relocation of the intersection futher to the south and that the
land in the N E corner of the present intersection was designatted
• single family.
Mr. Bill Rosen, Attorney, representing the land owners west of'Co.
Rd.4 noted that the Plan Study District proposel was newly presented
that evening and asked that no action be taken until all concerned
had had additional opportunity to study it.
Chairman Skjelbostad, said he thought the Council wanted the
Commission to review and recommend on the matter of the immediate
Zoning classifications and not conduct a full scale review of the
Guide Plan until the new Zoning ordinance was on the books. He
asked that the Commission meet again at 7:30 P.M. on Monday August
11 at the Village Hall to futher consider the presentation made this
evening and to prepare a recommendation for the Village Council
The meeting adjourned at 10.15 P.M.
