Brown, Lane STAFF PRESENT: Dick Putnam, Planner I. MINUTES OF OCTOBER 28 �974 PLANNING COMMISSION MEETING. To clarify his intent Mr. Fosnocht recommended the following changes to P. I,II.A.2 . . . . have been erected repeatedly .in the zone north of T.H. 494. . . . not satisfied with the advertising company's efforts.. Under,Discussion - Mr. Fosnocht responded that he tried that avenue and was not satisfied with the advertising company's performance. Lynch moved, Sorensen seconded, to approve the minutes as published &corrected . The motion carried with 3 ayes and 2 abstains ( Schee, Meyers } II. MEMBERS REPORT. 7, Chairperson Schee Mrs. Schee reported that no immediate holiday conflicts are foreseen soihe Planning Commission meeting dates will remain the 2nd & 4th Mondays of each month. Schee then referred the members to the memo from Marty Jessen regarding the Purgatory Creek Open Space Study presentation to be given on November 25 , 1974 at Prairie View School and said she would like the commission members to attend but unfortunately it will be held on a planning Commission evening. 2. Other Members • a. Sorensen suggested that the Planning Commission be supplied with the Minnesota State Statutes on planning. The planner questioned if the statutes might be difficult to interpret and asked if the commission would prefer having the attorney highlight the statutues. Mrs, Schee suggested that the statutues and the attorney's highlights of the statutes• both be supplied to the commission.. Mr . Sorensen also suggested the Board of Zoning Appeals members receive copies. b4Mr. Sorensen recommended that avenues of controlling billboard violations should be explored and stated that other communities have similar problems. c-Sorensen asked if there was a report on the utility building pablem discussed at the previous meeting. The planner replied that- the report was not yet complete. III. REPORTS AND RECOMMENDATIONS . A. Grossman Corporation, request a zoning text change to allow automotive dealership and related automotive services to be built. The approximate 30 acre site is located south and west of Valley View Road and north of the 212/1697494 interchange on the Wheaton property. The site is currently zoned C-Reg. The planner said that Grossman Corporation picked-up the staff report on friday and copies were mailed to those who signed up to receive it also on friday. He said the report raises the question if the proposal is appropriate and cbm in the proper manner. The planner then presented slides depicting the site and slides of an innovative auto dealership site located in Des Moines where only select cars are displayed and storage is behind the building. He believed that an auto plaza could be . designed acceptable to the City and as an assest to the City in the long run. Mr. Greenberg told the- commission that their architects and staff are in the process of reviewing the staff report and they believe that a good avenue of communication Planning Commission Minutes 2 Nov. 11,1974 exists between them and the City. He said that when a decision as to what to do is _ made they may be submitting revised plans and - makd them available to the list of interested"residents. Sorensen asked Mr. Greenberg if he meant to imply that they have not had time to analyze the report. Mr . Greenberg replied certainly not. He felt they would have their response to the staff .in about a week and plans perhaps in 2 weeks. 0 Schee asked Mr. Greenberg .if they are considering submitting a different proposal and if they should withdraw their present proposal. Mr. Greenberg replied that it is a question .of Whether they can meet the criteria and change in investment. Sorensen entertained a motion to disapprove the proposal and recommend it be continued pending a response from Grossman on the staff report --but wished to ask•sbrne questions first. He asked .if the Watershed District and Highway 'Departments had responded to the proposal. The planner said respons-es are expected soon_and the PCA has been .asked- to take noise readings around the site. Sorensen remarked that the PUD proposal submitted did not appear to -provide the degree of detail that most brochures provide. The planner agreed and felt that if the standards proposed in the staff report are followed ample information would be provided. Mr. Greenberg staffed that they have discussed the atuo plaza concept with other dealers and they feel such an approach is more successful .in warmer climates but they would try to- meet the criteria. Mr. Sorensen remarked that open displays • might be just as inconvenient during the cold weather. Meyers asked if the Grossman Corporation was working with adjacent landowners as sLggested in the staff report. Mr. Greenberg replied that they are in contact with Naegele and Schoenfelder. Mr. Sorensen suggested that they contact Metram Properties who own land across the road from the sate. Mr. Lynch inquired as to the intent of (b)under Crime Prevention on page 14. The planner replied that work with the Public Safety , is ad-,.Ised , _ ?cx the purpose cf designing crime prevention in the proposal. Mr. Tom Grossman stated that if good police protection exists in a community that chain link fences and dogs usually are not necessary. Sorensen asked Mr. Greenberg .if they still wanted to be on the Council agenda if the Planning Commission did not take action on the proposal tonight. Greenberg replied that they do want to present the proposal to the Council.- Mrs. MacKinnion, 7020 Willow Creek Road, expressed her opinion that other uses would be less of an eye sore than a car dealership. Mr. H. N. Larsen,7011 Willow Creek Road, expressed his gratitude for receiving the staff report and asked what would be the visual difference between the Grossman proposal and an auto plaza. The planner responded that the City outlines criteria to be met in the rezoning agreement thereby controlling approaches which the ;City does not feel are appropriate in the development of a site Planning Commission Minubs 3 Nov. 11,1974 Mrs. Kaerwer, 12800 Gerard Drive, asked what the tax difference would be for the auto plaza compared to a motel or office use. The planner believed that an motel or office use would produce more tax but it would also .increase . traffic and the building image. Mr. Larsen said the City should consider that the auto proposal may decrease surrounding residential property values. The planner did not feel a devaluation would occur. Mr. Tuttle felt the standards .in the report were not specific enough. The planner said exact standards would be written when a final product is presented and that standards also evolve throughout the reviewprocess. Mr. Fosnocht suggested that standards at this stage be referred to as guidelines, Mrs. Kaerwer asked what would prevent strip zoning if the Grossman proposal .is approved. The planner responded that the MCA is reserved for commercial uses and that .if proposals are done in a resonable fashion they would be an asset to the City. Motion: Schee moved, Sorensen seconded, to: 1 .) Recommend to the City Council that the Grossman Corporation request for a zoning text change to allow site development for 3 auto dealerships .and/or auto related uses as outlined in the brochure dated October 4, 1974 be denied, and 2 .) Suggest that the Grossman Corporation consider an auto plaza corr;ept reflecting the objectives , guidelines, and performance standards oulined in the staff report • dated November 7, 1974. Discussion• Mr. Fosnooht questioned the denial of the rezoning request since Grossman Corporation i-s willing to submit a modified plan. Schee replied that the motion to deny covers the October 4 th proposal and does not cover any future submissions. Mr, Fosnocht suggested that motion # 2 read - 2.) Suggest that the proposal should be modified and continued so Grossman Corporation may consider . . . The amendment was acceptable to Schee and Sorensen. Mr. Lynch called question on the motion. The question was approved unanimously. Vote The motions ( 1 & 2 ) carried unanimously. B. 4/5 Mini-Sector Study, for about 550 acres surrounding the intersection of Co. Rd. 4 & T.H. 5. Discussion of study's progress The planner asked if the commission would prefer him to review the graphics on display, or a quick review of the study's progress. Schee directed the planner to give a short review. The planner reported that Brauer, Engstrom, and BRW met with the staff est.kiday& ccrnpiled a number of alternatives relative to transportation and corresponding land uses. He said that the team expects to meet their deadline and that notices will be mailed to land owners regarding the next meeting, C. Homart Development ComRari-y, request to rezone Lot 15, Auditor's Subd. No. 335 • from Rural to C-Reg. Lot 15 contains 2 .185 acres and is located at the west end of the Eden Prairie Shopping Center site adjacent to Highway 169. The planner reported that at the time the agenda was prepared the Homart rezoning did not seem to include lot 15 but further staff research indicates that-it was included. Planning Commission Minutes 4 Nov. 11 ,1974 The planner suggested the item be eliminated Chairperson Schee directed the planning staff to elimiraie the .item as there appeared no reason to cover it. IV. PETITIONS AN.D.REQUESTS . A. Red Rock Hills PUD , by John Houston, Houston Engineering, request for rezoning from Rural to R1-13.5, preliminary plat approval and PUD concept approval for 84 lots on approximately 59'acres. Located on the northeast side of Red Rock Lake., Mr. Houston introduced Denny Griswold the project's architect who presented the project, . Mr. Griswold. outlined the site's location, road systems, and proposed paths which would connect to Homart. The PUD would have 84 s.f. lots with a 1.4 u/a gross density. Sorensen questioned why paths would not be placed along the lake instead of along back lot lines. Mr. Griswold felt it would be harder to .grade .in paths on the slopes adjacent to the lake because of the 30 % slope. Meyers questioned why their option required platting down to the water. Mr. Houston said the land is. under a purchase contract requiring lots to be platted to the lake as is normal for meandered property, Meyers felt that a traffic problem would be created if- the collector connected to • Red Rock Road. Fosnocht asked what functions the HOA would have. Mr. Houston replied that they would have control of the outlots and would represent the area regarding City matters, etc, Fosnocht then inquired as to the terrain and elevation of the area to be dedicated to the City. Mr. Houston said that the area was a marsh with islands. Mr. Fosnocht suggested the staff evaluate the value of the land to be dedicated. The planner felt the Park & Recreation Department should rev.iewthe.goj�r-t to determine the land's value. Mr. Sorensen felt that .if it was decided there was no actual usable park property that either land or money in lieu of land should be considered. He also felt that if the outlot by the lake was used for docking purposes for the 84 s.f, lots that the lake would be over-used. He suggested the staff and Mr. Perbix investigate the platting to the shoreline referred to .in the purchase contract. Mr. Sorensen asked - if the lots fronting on Red Rock Drive could be redrawn . Mr. Houston responded that sewer is already in place for those lots and they are trying to. make the best use of e;dsting facilities. Referring to Exhibit D of the brochure Meyers questioned the narrow lots on steep slopes on the western side of Red Rock Drive. Mr. Houston replied that the road cut creates better platforms and driveway grades and that a good architect can successfully place a house rn such a lot. a Planning Commission Minutes 5 Nov. 11 ,1974 Eugene Martinson, 8317 Red Rock Road, believed a traffic problem would exist if traffic is dumped on Red Rock Road. The planner felt an alternate road - would be difficult to design because Red Rock already has curb, gutter, and sewer in. He suggested limiting the number of-lots to be built until an alternate road becomes possible. George johnstond, 15980 Lakeshore Drive, said that Red Rock Lake is the cleanest lake in the City and that they are investing money in the lake_through 'stock.ing and aeration to maintain .its cleanliness. He asked if the developers intended to discharge water into the lake. Mr. Houston said storm water would go to the pond.at the north, to the center pond�and then to the marsh. Mrs. Pidcock, 14901 Scenic Heights Road, inquired as to the development phases that would be proposed. Mr. Houston replied that the ist phase would be around Red Rock Road and the entire project is expected to be complbted in 3-5 years. Mr. Larson asked who approved the stubs left open west of Red Rock Road. Meyers responded that it is done .if development is anticipated so improvements do not have to be dug up later at a higher cost. Fosnocht asked if the de5nlcper& also .intencbdto build. Mr. Houston said they may build some houses themselves. Motion: Schee moved, to continue the .item to the 2nd meeting in November. Meyers suggested amerid.ing the motion to continue it until after the Park & Recreation Commission 'and staff have completed their reports. The amendment was acceptable to Schee.and Meyers seconded it. Vote; The motion and amendrYJent were approved unanimously. B. Village Woods 2nd Addition, by Zachman Homes, Inc. , requesting rezoning from Rural to RI-13.5 and preliminary plat approval on approximately 16 acres to contain 42 lots. The site is located south of VillageWoods Ist. Mr. Griswold presented the Village Woods 2nd Addition of 42 lots and outlined the road &pathway systems. . The houses to be built would be Zachman's 4 iypical.models. Meyers said during phase I there was concern for variety and Mr. Zachman had stated he would be using at least 6 models. She added that the original approval was for use of condominium/ townhouses and preservation of the high-plateau. She asked the staff to address themselves to the changes in use proposed. Mr. Sorensen felt a variance .in the 13. 5 zoning would be necessary. He suggested such variances be covered during the rev.iewal process and not later at the Board of Zoning Appeals. Motion: Sorensen moved to refer the .item to the staff and continue it until reports from the staff and Park & Recreation Commission are available. The motion carried unanimously. PLANNER'S REPORT. 1 . Community Based Care Homes, discussion of proposed additions to Ordinance No. 135 permitting residential care facilities to locate in residential areas. He said the Human Rights Commission would be.meeting tomorrow to review the. revised draft and may make a recommendation to the Council. He informed them Planning Commission Minutes 6 Nov. 11,1974 that the Outreach Center in Brooklyn Center would be open for inspection on Thursday, Oct. 21 , 2-4 o'clock. 2. Other Reports. The planner inf ormed the commission that Homart had submitted a service station plan that is fully enclosed and similar to Sears in .its exterior material. The station is located along 169. VI.
