The approximate 30 acre site is located south and west of Valley View Road and north of the 212/169 - 494 interchange on the Wheaton property. The site is currently zoned C-Reg. Action: continue to first meeting in November for consideration of staff review,or approve the rezoning request;or deny the rezoning request. :_ 0:35 B. Action: motion delegating sign review responsibility to Building Department staff as specified in section 4, (a) (8) ; (b) (7), (c) (2), (d) (6), (e) (7), (f) (8), (g) (1), and (h) (3) 'of Ordinance No. 261 , or retain ordinance as written with Planning Commission. review of all signs, or continue. 9:45 IV. PLANNER'S REPORT. 1. Community Based Care Homes. Discussion of proposed additions to Ordinance # 135 permitting residential care facilities to locate in -residential areas. The first draft additions to Ordinance 135 will be discussed by the Human Rights Commission on Wednesday, October 30th, at 6:00 PM at the Eden House Supper Club. 2. Population estimates -for the City of Eden Prairie through the year 1980. Refer to letter addressed to Mike Munson of the Metropolitan Council which discusses the population estimates made by the*Metro Council which seam grossly low. 3. Report on Community Design Conference attended Oct. 24-26 at the University of Wisconsin, Madison. 10:35 V . MINUTES OF OCTOBER 15,1974 PLANNING COMMISSION MINUTES. P. 5, 4th P - remove the sentence starting with'Mr. Fosnocht . . ' and erjbr it at the end of the 3rd P to read , Mr. Fosnocht personally saw no reason to pressure the church one way or the other on the issue and suggested that this church property be treated as other church properties for tax purposes. P. 6, last P - should read lot S, not F. P. 7, Ist P - add at end of P, . , because _such a use on this part of the property would dictate restrictions on the Schoenfelder property. 6th P - should read, Mr. Sorensen said that the MCA Report . . . Lane moved, Fosnocht seconded to approve the minutes as published, corrected and amended. The motion carried with 3 ayes and 1 abstain ( Lynch) . II. MEMBER'S REPORT A. Chairperson Schee. 1. Next Planning Commission meeting date. Mr. Sorensen suggested that since the staff is willing to meet on November 11th that Monday, November llth, be retained as the Planning Commission's next meeting. Meeting on November Ilth was acceptable to the commission members. 2 . Other Members Mr. Fosnocht remarked that .in the last couple of years billboards not in conformance with City regulations have been erected repeatedly in the zone north of T.H. 494. He said he has reported such violations to the building department and was not satisfied with the advertising company's efforts. He suggested that daily fines be strictly implemented and that perhaps the City should conside, the type of information that .is placed on the billboards. Mr. Lane questioned if the City could regulate information placed on billboards. Motion: Fosnocht moved, Lane seconded , that the City r€co'nslder the billboard ordinance, especially regarding the frequency of offenses , and that if penalties are provided within the ordinance that it should be recommended to the City Council that they . take steps to see that such fines are applied. Discussion Mr. Sorensen suggested that the motion be directed to the building department. Mr. Fosnocht responded that he tried that avenue and was not satisfied with the advertising company's performance , Vote: the motion carried unanimously. Grossman Corporation, request a zoning text change to allow automotive dealership and related automotive services to be built. The approximate 30 acre site is located south and west of Valley View Road and north of the 212/169-494 interchange on the Wheaton property. The site .is currently zoned C-Reg. The planner stated that a staff report had not been completed for a number of reasons. He said that Brauer & Associates have been asked to review the proposal, and submit a report by the end of the week,and that input from the Highway Departments and the Watershed Districts is also anticipated on the proposal. Mr. Greenberg stated that he and the other representatives are:present to show their display of good faith and asked for direction . from the Planning Commission in order to reach a comprornise on the auto dealership plan. He said they, cbsire to be on the Council's November 12th agenda because the price of their option substantially increases after the 15th and the Chevrolet and Ford Corporations must have an answer as to location by the 15th of November. Mr. Sorensen informed them that the Planning Commission would be meeting on the llth prior to': the Council meeting. on the 12th. Mrs. Ma✓Kinnion, 7020 Willow Creek Road, stated that the residents of Bryant Lake are very much opposed to the project and remarked that such a project is regression not progress. Mr. Larsen, 7011 Willow Creek Road, said he disliked the thought of a used car lot on that site as it is an inappropriate use. Mrs..Kaerwer, 12800 Gerard Drive , felt that the use wo uld disrupt the traffic pattern and lower the quality of zoning. The planner responded that the site is currently zoned Reg.-Com. and that an auto dealership would not be a high traffic generator. Mrs. Kaerwer then stated that a car lot is not a good use for one of the City's major lakes. The planner felt that an auto dealership - could be constructed in an attractive manner. Mr. Sorensen asked how many .in the audience had come for the Grossman item — -- about 35 people raised their hand. After asking if they would be interested in reviewing the Grossman brochure and the future staff report on the proposal and receiving positive replies he directed the secretary to circulate a sign-up sheet for those interested in reviewing the brochure and/or staff report. Mr. Greenberg said they would be willing to distribute the brochures. Mr. Reilly . expressed the opinion that people sometimes become over_concerned about a proposal without being fully aware of the proposal. He cited past examples , i.e. ',Rosemount & Research Inc. , who at first received negative Planning Commission : Minutes -3- Oct. 28, 1974 reactions during their introduction but later proved.very beneficial to the City. Mrs.Kaerwer remarked that since th:re are car dealerships within 5 minutes of Eden Prairie that one is not needed 'in the City. Mr. Sorensen informed the audience that the Planning Commission had not yet takena position on the Grossman proposal and reminded all that their comments and suggestions are valued and could be submitted .in writing or they could present their views at following meetings. Motion: Lynch moved, Fosnocht seconded, to continue the item to the November llth meeting. The motion carried unanimously. B. Mini-Sector Plan, for about 550 acres surrounding the .intersection of Co. Rd. 4 and T.H. 5. The City Council approved the study on 10-22-74. Discussion of time schedule and preliminary work. The planner said that the study was approved and money appropriated at the last Council meeting. He bri0ied the commission on the study's proposed outline and informed them of the work accomplished to date. He asked .if any commission members were interested in being on the Management Board. Mr. Lane expessed his interest to participate. Sign Ordinance No. 261 , discussion of ordinance provisions for Planning j . Commission review of all sign applications, Section 4 : (a) (8) , (b) (7) (c) (2) , (d) (6) , (e) (7) , (f) (8) , (g) (1) , and (h) (3) . The planner felt that the responsibility of reviewing signs could be delegated to a committee which could possibly be comprised of staff and elected or appointed officials. 1 Mr. Fosnocht asked if the sign reviewal could be done by the staff. The planner replied it would be _ possible. for the staff to do the reviewals. Mr. Sorensen believed that the Planning Commission would still desire ;:etairing reviewal of PUD signs and suggested that they have the right to review the initial and subsequent signage programs of PUD s. Motion : Sorensen moved, Lane seconded, to recommend that section 4:(a) (8), (b) (7) , (c) (2) , (d) (6), , (e) (7) , (f) (8)- excluding (g) (1) , and (h) (3)- be amended to the Sign Ordinance to delegate the responsibility of those sign reviewals to the building department staff. Discussion: Mr. Sorensen stated that the intent of the Planning Commission is to have sector and PUD signage programs approved by the Planning Commission in their initial presentation but not to encompass minor signage thereafter. Tom Hissink, of the Preserve, asked if sign approval would be required for each plat subm.itted . The planner responded that the Preserve's signage program has already been approved. V.ote••The motion carried unanimously. Planning Commission Minutes -4- Oct. 28,1974 IV. PLANNER'S REPORT. 1. Community Based Care Homes. Discussion of proposed additions to Ordinance # 135 permitting residential care facilities to locate in residential areas. The first draft additions to Ordinance 135 will be discussed by the _ Human Rights Commission on Wednesday, October 30th at 6:00 PM at the Eden House Supper Club. The planner reviewed aspects of the poposed amendments to Ordinance 135 that would allow care homes .in the community. Mr. Fosnocht asked what would be done about the parking problem if residents of such a home had a number of care. The planner stated that the City Council can stipulate criteria and restrictions they consider necessary. The planner then stated that Federal and State Governments would soon require communities to provide care based homes. The commission members then discussed the placement and setbacks of utility buildings in the community and their possible non-conformance with City ordinances. Mr. Sorensen said that the Building Inspector informed him that permits are not required for buildings less than 100 'sq. ft. It was suggested that the staff investigate the problem of utility building placement and city regulations concerning such buildings. 2. Population estimates for the City of Eden Prairie through the year 1980. Refer to letter addressed to Mike Munson of the Metropolitan ' Council which discusses the population estimates made by the Metro Council which seem grossly low. The planner reported that the letter was precipitated by the Metro Council's predictions, concerns expressed by The Preserve and Edenvale, and truth in statistics, The commission and planner briefly discussed units constructed and .future population projections . 3. Report on Community Design Conference attended Oct. 24-26 at the Unviersity of .Wisconsin. ' The planner said that a summary of the conference would be prepared. V. ADTOURNMENT.
