Letter from Mr. Dorenkemper and staff report. Suggested Action: recommend approval, denial, or continuation, B. Mitchell Lake Estates, request for concept approval of Mitchell Lake Estates Single Family detached ( mobile home ) development and rezoning the property from Rural & . PS to Mobile Home Park. The site is approximately 100 acres and located west of Mitchell Lake and approximately z mile south of Highway 5. Proposal is for 350 mobile home units on lots not less than 5,000 sq. ft. Sorensen moved, Lane seconded to approve-the minutes as published and. corrected. The motion carried with 5 ayes. II. REPORTS OF COMMISSION MEMBERS. A. Chairwoman Schee- l. Revised Planning Commission Meeting date. Chairwoman Schee reported that planning items would be placed on. the 2nd and 4th Council meetings, thereby permitting the Planner to attend the Planning Commission Meeting on the first Tuesday of every month.. . A brief report on alternate meeting places was given by the Planning Secretary. The Commission members agreed to relocate their first meeting of every month (the first Tuesday of every month) , to the Eden Prairie High School at 7:30 p.m. Schee requested that the change be published in the paper, reflected in public hearings, and printed in the Eden Prairie Newsletter. Flood Plain Ordinance: A Public Hearing was set for the Flood Plain Ordinance on August 6th, 7:30 PM, in the Eden Prairie High School. 2. Special Meeting of July 30th, the 5th Tuesday, regarding Homart; etc. The planner reported that the staff has had discussions with Homart and that they would be meeting with Homart again on Thursday or Friday. He said that if the plans could be worked out prior to August 6th the plan would be submitted to their owners. Mr. Fosnocht objected to reserving an evening unless the matter was of more importance. Schee stated that she would not be present on the 30th but felt that handling -few items on the 30th would relieve the the amount of work on the first meeting in August. Motion: Sorensen moved, Lane seconded, to set a Special Meeting for July 30th at 7:30 PM in the City Hall for the purpose of discussing proposals along Co. Rd. 4 & Hwy 5 , and Homart. The motion carried with 4 ayes and 1 nay ( Fosnocht } . _ r Planning Commission Minutes -2- July 16,1974 B. Mrs. Meyers- absent, C. Mr. Sorensen 1. Status of Attorney's presentation to Commission. A tentative date around mid-August was set for the City Attorneys presentation to the Commission. III. PLANNER'S REPORT 1. Smetana Lake notification research requested at July 2, 1974 Meeting. The Planner referred the Commission to the research done by the Planning Secretary. He added that he has spent a lot of time covering the various proposals with the Smetanas and Kostecka's. The Smetana Lake Sector Study is expected to be on the Council's August 23rd Agenda. 2 . Neighborhood Facilities Study for parks and open space as recommended by the Park and Recreation Commission. The Planner suggested that perhaps the Park and Recreation Commission and the Planning Commission should meet to consider the Neighborhood Facility Study. Mr. Fosnocht asked for clarification of the study's objectives. The Planner responded that the plan better outlines park needs and phasing. Mr. Fosnocht noted that items such as trailway systems, cost and source of finance were missing. The Planner said that presently the Bikeway/Hikeway Task Force is reviewing the Bikeway/Hikeway Report and that last evening, a rough draft breakdown was presented to the Park and Recreation Commission. . Mrs. Schee felt that the study clarified why things weren't done in certain areas. 3. Status of Homart Plan review. - already covered. 4. Other Planning Projects . The planner reported that the Council and staff met with the County staff last evening and discussed building a bridge over 494 and up-grading the roads suggested by the City staff. 5. Mobile Horne Park Ordinance status report. The planner stated that the staff has not yet commented on the ordinance and that the Commissioner's opinions would be appreciated. IV. REPORTS & RECOMMENDATIONS. Continued Public Hearings. A. Opus II, Rauenhorst Corporation request for PUD plan approval rezcning a 20 acre parcel located north of Crosstown 62 and west of Co. Rd. 18 from Rural to OFC, and preliminary plat approval. Residents in Minnetonka were notified 7-8-74. The planner oultined the staff report dated 6-16-74 and stated that the residents in Minnetonka had been notified'. Chairwoman Schee asked if the - representatives had any comments. Mr. Bob Worthington, Director of Planning & Governmental Affairs for Rauenhorst, stated that the approach in the report seemed reasonable but they are looking for guidance so they may know what story height is right. Mr Sorensen asked Planning Commission Minutes -3- July 16,1974 when they anticipate development. Mr. Worthington replied that development is expected in about 2 years. Mrs. Schee suggested that they should keep posted as to the City's ordinances and policies before submitting final plans. Mr. Harold Pavelka a Minnetonka resident, said he had no comments one-way or another and that development is inevitable and similar to what already is around them. Motion: Lynch moved, Schee seconded, to recommend the rezoning from Rural to PUD OFC District and preliminary plat approval for the 19.71 acres located within the northwest quadrant of the intersection of C.S.A.H. 62 and Co. Rd. 18 and as to the recommendations in the staff report dated 7-16-74 as follows: 1 . Based upon previous adopted City policies and ordinances such as Ordinance 135, the Comprehensive Guide Plan, the Major Center Area amended to the Comprehensive Guide Plan, and the recent motion limiting buildings over 5 stories to the Major Center Area. I would recommend the ::•approval for Office development subject to . site plan review consistent with the standards established in the Zoning Ordinance. I 2 • The rezoning of the 19.7 acre parcel in Opus II from Rural to PUD-74- 06 for-the use as office OFC development consistent with the provision of Zoning Ordinance 135 , sections 6- Subd. .6.1 .. 'Variance • Section 17 with Subd. 17.1 . 3. Approve the preliminary _ plat dividing the 19.7 acre parcel into 2 i lots , block I & 2 , as indicated on the preliminary plat dated May 28, 1974. "k 4. At the time Rauenhorst Corporation , or future purchaser of. the site, applies for rezoning to OFC District consistent with Ordinance . 135 a petition f or variance of building height may be filed with the City of Eden Prairie and that application to be. considered on its merits subject to the provisions of Ordinance 135. The motion was approved with all voting aye. B. _Clifford Fraser, Crosstown Apartments, a mid-rise rental apartment project of 600 units proposed on the previously approved Garrison/Jeres/Ginkel PUD 71-02 to RM 6.5 and PUD development stage approval. City attorneys report answering the questions in the July 4,1974 Motion. The planner said that on July 9th Mr. Fraser, Mr . Cardarelle, Mr. Mork, other landowners, and he met to discuss planning and road usage in the area. The planner's recommendation was that the proposal is an improvement over the previous PUD and that it . be .. redesigned. Mr. Lynch stated that based on the attorney's opinion he thinks it can be worked out. Mr. Lane felt the basic plan is reasonable and the parties can work things out and present a final project. Mr. Sorensen had grave reservations about the . project . He felt the traffic off this project increases the problem he envisions in the Smetana Lake Sector. Planning Commission Minutes -4- July 16, 1974 ; The planner stated that the real problem is the peak hour and the residential use can possibly help the traffic problem by allowing people to live and work in the same area. Fosnocht agreed with the residential suggestions but his concern was that it has not been proved by evidence that it works. The Planner said with todays,patterns and habits the traffic will not work , but changes in habits are expected. He felt that development in the Smetana Lake area could not be halted because the traffic system will not work and for the next 10 years there probably would not be a problem. Lane moved to continue the hearing until the August 6th meeting. The motion died clzeto lack of a second. Motion: Lynch moved, Lane seconded, to recommend redesign of the Crosstown Apart- ments to incorporate the original 537., du and the 21 points in Brauer's report, and ask that Mr. Fraser work with the staff and other landowners involving the circulation . The motion carried with 4 ayes ( Schee, Fosnocht,. Lane, Lynch ) and 1 nay ( Sorensen ) . Mr. Sorensen's objection was because he believed the modification of the PUD is more than a minor modification. C. Bruce Hubbard, proposed-Mini-Storage warehousing project located north of Flying Cloud Drive in the Lake Smetana Sector. Requesting rezoning from Hwy Com, and Rural to I - 2 Park. The project was continued from the June 18, 1974 Planning Commission Meeting. • The planner said that Mr. Hubbard had not been able to make the meeting with Cardarelle and Fraser but he had spoke to Mr. Cardarelle afterwards. Mr. Hubbard said that Mr. Cardarelle was interested in his parcel C Mr. Fraser said that they were waiting to see what would happen tonight and that Sorensen's comment frightened him. Mr. Sorensen responded that it was only his personal observation. The planner suggested that the Mini -Storage proposal and road pattern be jointly presented with the other lanlowner's proposals at the next meeting. Motion: Fosnocht moved, Lane seconded, to recommend the item be continued until the August 6th meeting at which time cbfinition of the road system would be expected. The motion carried with 4 ayes and 1 abstain ( Sorensen } . Sorensen abstained because of possible conflict of interest. V . PETITIONS & REQUESTS. PUBLIC HEARINGS. A. _Crestwood 73 Outlot A, by Alex Dorenkemper located south of Co. Rd. 1 in southwestern Eden Prairie. Request to divide outlot A into 3 lots. Letter from Mr. Dorenkemper and staff report. Mr. Dorenkemper presented his request of dividing outlot A into 3 lots ( 4,5 ,6 ) . He felt that if he was to provide 135' of road with a cul-de-sac that the lots should be buildable. Presently the road access is about 80' long. Mr. Sorensen asked how a building permit was granted on lot 4 where the Wilson home is located. 'The planner responded that the Wilson home was on 5 acres Planning Commission Minutes -5- July 16,1974 when the permit was granted. Mr. Sorensen expressed concern about such • practices stating deed back provisions create situations the developers :desire. Mr. Dorenkemper responded that it was the only way to legally put a house. on a lot that would inevitably be a lot someday, The planner said that the City Engineer is investigating the situation. Mr. Sorensen said that from talking to the City attorney that this is not an isolated case; some people are selling off 5 acres with deed back provisions and if so the 5 acre requirenent is unnecessary. Mr. Dick Coleman, purchaser of lot 5, requested the Commission to help his family out of a problem. He said that Mr. Dorenkemper had not been square with them a nd after lot expenses the title problem was discovered by his attorney. After signing an purchase agreement with Mr. Dorenkemper Mr. Coleman sold his house and has had to live in an apartment . He asked that restrictions . be placed on Mr. Droenkemper and how he performs his business. The planner said that he had talked to Mr. Perbix about Coleman's problemand a solution is being worked on. He suggested that the matter , be handled on the July 30th agenda to expedite the matter . Mr. Larry Johnson, purchaser of lot 6, said that Mr, Dorenkemper lead them to • believe the lot was buildable when in fact it was not. Motion• Lynch moved, Lane seconded, to continue the matter to the July 30th meeting. The motion carried with all voting aye . Mr. Sorensen added that he was tremendously concerned about this and the recommendation from the staff and attorney will be closely reviewed by him because. he would not tolerate this in Eden Prairie. ' He felt the solution must take into account all past actions of Mr. Dorenkemper and prohibit anything like this from happening again. Mr. Dorenkemper denied that in 1969 he was told he could no longer plat in the City. Mrs. Schee replied that both he and she were present at that meeting and that he: had been allowed to plat because of hardship in one case. B. Mitchell Lake Estates, request for concept approval of Mitchell Lake Estates Single Family detached ( mobile Home) development and rezoning the property from Rural & PS to Mobile Home Park. The site is approximately 100 acres and located west of Mitchell Lake and approximately a mile south of Highway 5. The proposal is for 350 mobile home units on lots not less than 5,000 sq. ft. The planner said that the people proposing the park have had contact with the staff for 8-9 months and now they feel prepared to present their proposal. Don Brauer, of Brauer & Associates, presented slides of various housing types, including mobile home sites,and stated that the site is, goodyand' he has Planning Commission Minutes -6- July 16, 1974, confidence in the owner/management of the proposed mobile home park. He said that utilities. can be extended or the park can be serviced by private facilities. • Tom Walters, of the Mn, Mobile Home Asso, , gave satistics on mobile home production and stated that the Metropolitan area is short of park space. He said that no adverse affect has been found to properties surrounding mobile home parks , rather it can increase values because multiple or commercial use may develop. He stated that they provide housing, app licances, .furniture, and lot rent for less than �,300,00/month. Mr. Lynch asked if the $ 300.00 figure inlcudes the trailor mortgage. Mr. Dick Matheus, of Inland Realty, said that it does and added that rmrtgage, insurance, lot rent, utilities, and taxes for a single wide would be approximately $230.00,/month; and $ 2 64.0 0/month for a double wide. Mr. Sorensen inquired as to trailor depreciation, Mr. Tom Walters stated that the industry developed economic obsolence due to widths starting at 10' and going to 12' & 14' , but now the market is stabilized at 14', and if the owner takes care of his home , adds amenities, and the home is in a good location it is possible for the home to appreciate. Mr. Lynch asked if a shelter would be provided for severe weather. Mr. Brauer said that the administration building could accomodate people in the park. Mr. Matheus added that on Septemper 1st all trailors will have built-in die downs • which will make the units safer. The planner suggested that the developers . bring in a unit to be viewed. Mr. Fosnocht asked if comparable units were within driving distance, Mr. Brauer resonded that B^ardondale in Chaska would be the most convenient with River Bend in Elk River being the most comparable. Mr. Lynch asked how a 1947 model could be restricted from the park. Mr. Walters responded that minimum square footage and a State certification seal would be required. Mr, Sorensen asked if they owned the southern part of the site. Mr. Brauer said that it was included in the legal description. Mr. Art Miller, a landowner, stated that he sold that property to Sills & Haglin, He then said that when he was on the Zoning Board they restricted mobile homes from the City and asked that the Commission look into all aspects ; roads, schools, utilities, etc. Some residents felt that the public would not want a mobile home park in view, and expressed concern in developing adjacent properties. Planning Commission Minutes -7- July-16,1974 Discussions followed regarding road access, 169/212, and 178th Street. Motion: Fosnocht moved, Lynch seconded, to continue the public hearing to the August 6th meeting. The motion carried with all voting aye. VI. ADJOURNMENT. Lane moved, Sorensen seconded, to adjourn the meeting at 11:40 PM. The motion carried unanimously.
