MINUTES EDEN PRAIRIE PLANNING COMMISSION TUESDAY , May 7, 1974 7:30 P.M. City Hall • MEMBERS PRESENT: Charwoman Norma Schee, Joan Meyers, M.E: Lane, Herb Fosnocht, Don Sorensen , Wayne Brown, Richard Lynch. MEMBERS ABSENT: None STAFF PRESENT: Dick Putnam, City Planner I. _MINUTES OF APRIL 15 , 1974 PLANNING COMMISSION MEETING. Corrections or additions to the April 15, 1974 Minutes will be handled at the May 21, 1974 meeting due to the members not having adequate time to review them because of late.delivery. II. Smetana Lake Sector Study, discussion of citizen input regarding land use transportation, and conservation. Specific input from owners. Chairwoman Schee thanked all owners for their past input in the form of letters and verbal communication. The planner informed the Ccr;mission and audience that Mr. Pearson had submitted a document containing his comments on the Smetana Lake Sector Study this evening and the document could be viewed, or copies.received..' at the City Hall. • Mr': Bob Naegele, representing Condon-Naegele, presented their general comments, through the use of various maps, on the Smetana Lake Sector,. He outlined the basic histoy of the area and complimented the City on their foresight in planning and the resulting 1968 Comprehensive Guide Plan. He believed that it was Brauer-. and AssociatWs feeling that because of the mining and development taking place in the Smetana Sector the following* ' use should consist of high density uses. Following the 1968-Guide Plan they saw changes that affected the Guide Plan such as; The Preserve and Homart. When the MCA Task Force set-up andreeacnmended the assessment method they agreed, -but disagreed with the assessment area because'the property across the ravine to Washington Avenue should be viewed as a contiguous piece of land. Mrs*. Schee asked Mr. Naegele if they had actively participated in the MCA meetings. He responded that they had attended some of the meetings. Another area to which they disagreed was the enlargement of the green way area in MacCulan's report from previous studies on the area. They do not favor the dual off-ramp from 169 because it breaks-up prime acreage. He felt that the state's reasoning was to prevent their involvement in sharing the Ring Road cost, Mr. Sorensen asked if the State still needed local approval. • The planner said they did ; but we need their approval also, and that the Highway Department was not influenced by the objections of the City and Task Force, Mr. Sorensen asked what type of influence would be necessary, Mr. Don Brauer, of Brauer & Associates, said that if participation in such regional roads was appropriate here it will be 1 ogical in other areas and Planning Commission Minutes -2- May 7, 10*374 the M.H.D. did not wish to enlarge thier responsibilities at this time of restricted budj ets. Mr. Naegele said that they still 'support the basic pretence of the_1968 Guido Plan but they don't think that the multi-family in MacCulans report fits in. They would like to see the extreme S.E, end of the southern section of the sector as Industrial/Office, and across the ravine east to Washington Avenue as Commercial/ Highway using the ravine as a natural separation. He said that they think the Ring Route should be pulled back towards the east because the western alignment goes through buildable soils . The western alignment would take out a substantial stand of red pine and they think that it is more important to save red pines than a marsh. Putnam asked if they believed the red pine (planted stock) would be retained by development that would occur on the site, especially if the Ring Road -was moved east down into the marsh or lake. Mr. Naegele was not sure if they would remain. Mrs. Meyers stated that Condon-Naegele was at the Ring Route meeting and that the lake level and preservation of Anderson Lakes was established by the D.N.R. and that there is no possiblity of change ,nor did Condon-Naegele suggest such an alignment .to the MCA Task Force. Mr. Sorensen asked if multiple uses were possible in their proposed Commercial/ Office areas and if the line respected the flood plain of the creek. Mr. Naegele said that .a mix of uses is possible and that they did respect the.flood.plain of the creek. Mr. Putnam inquired as to how the road system would work in their plan Mr. Naegele responded that the area east of the ravine would be on--ntated to Washington Avenue and the western _ portion would be orientated• . to the Ring Route. Mr. Fosnocht did not feel that it would be practical for only 1 service road (Washington Ave.) to serve the proposed Commercial/Office area. Don Brauer said that the fire response time would be as a good as most other areas and that it would be better than a frontage road which further complicates traffic. Mr. Fosnocht restated his past concern of the need of a detailed traffic study. Chairwoman Schee then-asked if there were any comments from the audience either previously mentioned or new. Mr. Bundlie, Mr. Pearson's attorney, said that a new item has come up that is not in Mr. Pearson's report. Mr. Pearson explained the new item---the forestry department had discovered diseased trees, .(e.g. oak wilt) , on his property. The diseased trees may kill other trees within a 50 foot.radius. Mr. Pearson said that they will be receiving a report on the tree disease within a• - month and that the state can require him to remove the diseased trees. Mr. Helle stated that he was in agreement with Mr. Pemon's proposal, but had not seen the plan before this meeting. The planner said that, he would follow up the possibility of Mr. Fosnocht's request for a traffic study, he would appreciate further input or questions from• interested.persons, and that he expects the staff report concerning Smeta a Lake to, be prepared for the next meeting, Mr. Bundlie stated that the Commission should be aware of the legal implica- Planning Commission Minutes -3- May 7, 1974 r tions of Their decision and that Harlan Perbix, the City attorney, should see his report. Chairwoman Schee then said that the Smetana Lake Sector Study would be continued to the next meeting, May 21 , 1974. B. Chairwoman & Members Report: I Mrs. Meyers - postinq rezoning signs. Mrs. Meyers said that she had noticed signs which Minnetonka posts and has received a call from a Eden Prairie resident who is much in favor of the Idea. Information received from the City of Minnetonka by the Eden Prairie Planning Department estimated the cost of 2 -- 4' x 8' signs, installation _ ,and removal, as approximately $ 120.00-140.00 which is paid by the.developer. Meyers then asked Mr. Putnam what the present .cost of rezoning is to the developer. He reported the the fees are $150.00 Rezoning fee . $150.00 PUD " $.25.00 . Preliminary plat plus $1.00/lot . $ ----- Building permit fee based on the appraised value Mr. Putnam suggested a possible alternate way- of informing residents of rezoning requests such as- the newsletter. Doubts were raised by some Commissioners about the signs necessity and • problems of vandalism. Mr. Brown suggested that the signs might be able to be smaller than the 4' x 8' , perhaps 4' x 4' Mr. Sorensen valued the notification that the signs might provicb.• & felt that they would be very beneficial in increasing participation. He suggested that more information from Ray Earls, Eden-Prairie-Maintenance Department, would be helpful. Mrs. Meyers agreed with Mr. Sorensen and requested infor- mation about inventory and cost projections by Ray Earls . 2• Chairwoman Norma Schee-Commercial Needs Study. Four firms have been interviewed by five interviewers,, ( Joan Meyers, Norma Schee, Bob Heinrich, Dick Putnam, John Frane ), and will soon be presented to the Council. It was suggested by Mrs. Schee that a workshop should be held to further understanding of the proposals and opinions involved in the Smetana Lake Sector Study. C. Planner's Report: 1 Status of Sears/Powers Store Designs. Mr. Putnam reported that Sears, Powers and Homart are working together to resolve the architectural differenes . and that the City Manager , Building Department, and the Planner agreed to grant a footing permit to Sears because the footings would be the same; but that a shell permit would not be issued until the building design is approved, 2 Meetin4s - with Landowners of Crosstown Industrial Park regarding future planning. A meeting with the landowners is expected to be on a June agenda perhaps with the.meeting -held at King's Forest School, _ Planning Commission Minutes -4- May 7, 1974� 3 Up-date on Windslope Project located in The Preserve. The Planner reported that the project has received :funds and must be under construction within 90 days. He said that more detailed plans will . be presented to the Commission. 4. PUD/Controlled Growth, and Staffinct: The PUD/Controlled Growth Ordinance will first be distributed to the staff and then to the Coundl and Commissions for their comments. Staffing-The position of Assistant Planner was not handled at the last Council Meeting. 5 Other Lunch Tours During, Tune 1974: A June or July tour of Woodlake Park may be taken.. 6 Gelco Park-dedication and around breaking: The ground breaking and dedication has taken `place btt the dedication line implemented was not in accordance with the Council and Commission's recommendation instead about. 1 acre of property was deleted by Gelco's request.' 7 MCA Southwest Ring Road Alignment. Meetings have been held with the land owners with alignment approval from Bermel-Smaby, The Preserve, Teman. HNTB will not begin detailed work until the alignment has been resolved with the Feeders Inc. property . THE REMAINDER OF THE MEETING WAS CHAIRED BY MR. SORENSEN • x III. PETITIONS AND REQUESTS: PUBLIC HEARINGS. A. Bonnet/Waters, 7 lot single family subdivision located west of Frnalo Road and adjacent to Olympic Hills Golf Course. Request rezoning from RLal to . R 1-13.5 and preliminary plat approval. The planner briefly outlined the staff report and stated that the- proposal was quite straight forward. He recommended approval of the Bonner/Waters proposal to R ti-13.5 for 7 single family lots'. He said that the City Engineer suggests that the final plat-approval be withheld until sewer and water are available. Mrs.Meyers asked how the Franlo Road access .lined-up with the Prairie - East intersection. The planner responded that the distance between the accesses were approximately ] 00'-200' She then asked if it was safe to assume that , 60 '. ' would be a sufficient right -of-way. The planner felt that the'66' right-of-way proposed would be adequate unless the road became a major arterial. Because of the degree of slope on lot 1 Mrs. Meyers asked if there was a sufficient building area on that lot. Mr. Bonner said that the lot would dictate a tuck-under type house and that they don't expect to harm the existing trees. Mrs. Meyers then suggested that a reasonable charge of money in lieu of . land dedication be added. • Mr. Sorensen stated that he had not had a chance to read the report, so he would not feel comfortable voting on the proposal. The remainder of the Commission members although had read the report and were willing to take action. Planning Commission Minutes -5- May 7, 1974 .. Motion:,Brown moved, Lynch seconded, to recommend rezoning of the Bonner/ Waters proposal to R1-13.5 with the staff report of May 1 , 1974 • & the recommendations therein., adding to that : 5. That final plat"approval be at the time sewer and water is available. 6. That money in lieu of land dedication be worked out-with the Park lirector. The motion carried by a vote of 5 ayes, ( Lynch, Lane, Fosnocht, Brown, Meyers) and 1 abstain, ( Sorensen). Mr. Sorenserf,sabsiafning was because he had not had the opportunity to study the proposal. B. Bruce Hubbard-Minnesota Mini-Storage, proposal for warehousing of-private goods in garage size spaces. The site is located east of New 212/169 north of Dr. WHght's Animal Hospital. He is requesting rezoning from- Highway Commercial and Rural to I -2 Park . with variances as to the amount of land required in I -2 Park and for a caretakers house. • Beoause the proposal is part of the Smetana Lake Sector the planner suggested that perhaps the Commission may want to defer action until.after the Smetana Lake decision. Mr. Bruce Hubbarb presented the proposM'and its relation to the roads and existing structures. Parcel B will have the mini-storage facility and,parcel A the office buildings. The berming will prevent view of the pacing from the -_-highway and ' the • site"line from-169 would be of the sumac and tree plantings. Mr. Hubbard stated-that he has been unsuccessful � in renting the exsiting building as commercial but has had inquiries for ' office/warehousing from 2 major industries in. Eden Prairie and also from apartment owners. Motion: Mrs. Meyers moved, Lane seconded , to continue the Bruce Hubbard Public' hearing to the 2'nd meeting in June. The motion carried by a vote of 5 ayes, ('Lane, Lynch, Fosnocht, Meyers, Brown, ) and 1 abstain, ( Sorensen). Mr. Sorensen abstained because a client of his has had discussions with Mr. Hubbard applying to parcel A. Planning Commission Minutes -6- May 7, 1974 C. • Northmark, single family subdivision of 28 lots of approximately 9,000 • sq. ft. ave. size lots located north of the Westwinds single family homes f n The Preserve, Request rezoning to RM 6.5 and preliminary plat approval . Mr. Lee Johnson, of The Preserve, said that they were almost in 100 agreement with the staff report and only had a few items to clarify, such as; the cul-de-sacs will be built according to the City's standards, there are 28 s.f. home lots, they will be requesting set-back variances, and the price range will'be between $ 45,000.-- 47,000 OQ Although the utility plan is not yet completed they do intend to put utility and drainage easements on all side and backyards. He disagreed with recommendation # 4 of the report because.such property is under the control of those who.own it and±they-do not_.wish:_ oat._•haive-a IL.the-liability.-and responsibility'of.con-- - - - trailirig-unwantecT-persans` destructfan=._. He sugg - 'that-�thaf- the- City might share the maintenance and responsibility. The planner stated that the City attorney is working on the problem and that the developers should partake in the. bikeway/hikeway task force. Mrs. Meyers asked if the same builders would be involved in this project as in Westwind, and if The Preserve would review the plans. Mr. Johnson said that some of the same.builders would be involved and they would be reviewing the plans. Motion: Lynch moved, Brown seconded, the rezoning to RM 6.5 and preliminary plat approval for 28 s.f. home sites per the staff report of May 2, ]974, (with the deletion of recommendation # 4) and the Engineer's report of May 7, )974. Discussion: Mr. Sorensen' strongly opposed the cbbtbn• of recommendation # 4. Mr. Brown amended, Lane seconded, the motion to. read--That trailways or greenways would be subject to any future master plan of the City. The vote on the amendment passed with a vote of 4'ayes, (Lane, Lynch, Brown, Meyers ), and 2 nays; ( Sorensen, Fosnocht) . The:motion passed a with- _vote of 4 ayes,: ( Lane Lynch Brawn, Meyers) j = 2 nays ( Sorensen Fosnocht) . Changing zoning from Rural in PUS 70-3 to RM 6.5 The planner said that because-the revised plan was brought in Wednesday- that there had not been time for a staff report. Mr. Peterson presented different views of the project through a slide demonstration. The first stage of constructirn will be around the S.E: cul-de-sac taking some trees and perhaps splitting the road to bypass a large tree Thirteen or fourteen feet will be taken off the knob and then units will, be clusterered around the knob to save the top. They agree with the staff that there should be berming along the railroad tracks and - in the alternate site"plan - they propose to set the garages back to the railroad ' and -have 150' of easement: Four central parking spaces will be removed which will leave a minimum of 4.15 parking spaces/unit. Continuing with the slide presentation Mr. Peterson compared street distances and distances between units of other proposals and the Suncrest proposal. Informing the commission .that distances between units is 80' in Suncrest • and only 40 " in other projects and the width of streets in Suncrest will be wider than other existing projects_, They intend to create a natural pathway system of limestone make-up. Their alternate site plan incorporates townhouses on the knob. Edenvale does not feel that the condominiums will be marketable because there already exist a glut- - of them in the market. They reported that the fi_nanciar preferred . the original site plan. Mr. Peterson said that he world be meeting with Chris Enger for the purpose of resolving issues and constructing a firm position paper giving the commission one thing to consider. The Commissioners then directed the staff to provide an evaluation of the Suncrest proposal for the next meeting, IV. ADTOURNMENT Lynch moved, Brown seconded to adjourn the meeting at 12:00 midnight. ". The motion carried unanimously.
