Planning Commission - 04/07/1970 MINUTES EDEN PRAIRIE PLANNING COMMISSION Tuesday, April 7, 1970 7:30 P.M., Village Hall Members present were Chairman Skjelbostad, Wise, Nesbitt, Raguet, Meyers and Schee. Also present was Village Manager George C. Hite. I. MINUTES OF FEBRUARY 17, MARCH 2, and MARCH 17, 1970. The minutes of February 17, March 2, and March 17, 1970 were approved with- out correction. II. PRESENTATIONS A. Carter & Gertz, Inc. "The Rreserve". Mr. George Carter representing the firms of Carte-F-Ge-rtz, Inc. and t e inneapolis Gas Company, co-developers of"The Preserve" project, addressed the Commission regarding their proposal to develop approximately 1000 acres of land near Anderson Lake. He said their proposal included a wide range of land uses, but that,.mott of the area would be devoted to housing of various types and densities, He stressed the developer's intent to retain as much of the existing ecology as possible, particularity in the areas adjacent to Anderson Lake. He said they anitici- pated that about 15,000 people would be housed within the development over the next ten years. He noted that their economic feasibility studies suggested that it would be necessary for them to develop the area at an overall average density of 4.5 dwelling units per acre. Mr. Jim Stageberg, representing the Planners for the proposed developments, presented a series of photographs, drawings, and comment regarding the project. The photographs included a number taken at Montgomery Village in Maryland. Mr. Stageberg indicated that the housing types and design quality exhibited in the Montgomery Village project were typical of those proposed in "The Preserve". His presentation included a brief report on their plans for the major community activitiy area to be developed on the Saunders Farm property. The presentation included a number of photographs and drawings of housing types and densities similar to those proposed within the project.area. The Commission received the report for staff review and subsequent Commission consideration. B. Joe Ruzic. Office Industrial . Flying Cloud Drive. Mr. Ruzic presented his proposal to constuct a combination o ice-ware Ouse behind the Eden House (Branding Iron). The Manager noted that the property was currently zoned rural and that a rezoning to either office district or industrial district would be necessary. The Commission agreed to receive the proposal for staff review and Commission consideration at a future meeting. III. PUBLIC HEARINGS A. o er is erger. Property Division. 9870 Franlo Road. Section 25. The Manager presented the proposal to divide the Listberger property into two parcels, the smallest of which would have an area slightly less than 5 acres. Mr. Nesbitt noted that the smaller parcel had adequate shape, area and street frontage to permit additional subdividing when utilities were available and that the proposed d4vision would not interfere with the orderly development Planning Commission Minutes April 7, 1970 Page 2. of land in the area. He moved that the Commission recommend to the Council that the proposed division of the Listberger property be approved. Miss Wise seconded. All voted aye. Motion carried. B. Mrs. Helen Brown. Property Division. 8516 Franlo Road. Section 14. The 4anager presented the proposal to ivi e a acre parce into parcels of 0.89 and 0.76 acres. He mted that the existing home on the property would be located on the 0.89, or northerly parcel . He recommended that the divsion be approved subject to a restriction on the southerly or 0:76 acre parcel prohibiting its use as a residential building site until such time as the parcel were served by public sanitary sewer facilities. Mr. Raguet moved that the Commission recommend to the Council that the division be approved, subject to the deed restrictions recommended by the Manager. Mrs. Meyers seconded. All voted aye. Motion carried. IV. RECOMMENDATIONS AND REPORTS A. Waste anagement, Inc. Sanitary Land Fill. Flying Cloud-. Mr. Phil Rooney, representing Waste Management Inc., briefly described his firms interest in the proposed project, and asked Mr. Don Ripple, their planner, to present their proposal . Following Mr. Ripples review of the proposal the Manager presented a staff report dated April 9, 1970. The report reviewed the proposal and the interests of other agencies such as the County of Hennepin, The Pollution Control Agency, and the Metropolitan Council in the project and generally recommended that the proposal be approved. The report also reviewed earlier applications for land fill operations s.-1thin Eden Prairie. The land fill proposal as presented by Mr. Ripple and as reviewed in the staff report, included consideration of the future use of the property. This use included the possible relocation of Flying Cloud Drive through portions of the property and the development of industrial , multiple family and public park uses on the remainder. The staff report concluded that these future uses seemed to be consistant with the Guide Plan objectives. The Manager reviewed Hennepin County's proposed Ordinance No. 1 which would regulate sanitary land fills within the county. He said that he felt the ability of the County to propertly enforce landfill operations regulations was a key issue. Mr. Nesbitt moved that the Commission recommend to the Council that the proposal of Waste Management Inc. to develop the sanitary land fill in the area south of Flying Cloud Airport be approved, subject to the condidtions set forth in the April 9th Staff report. Mrs. Schee seconded. All voted aye. Motion Carried: B. George Mauer. Industrial Zoning. County Road 1 Near Flying Cloud Drive. The Manager reviewed the Commission's March 17, 1970 consideration of the request and presented a staff report dated April 6. The report noted that the proposed industrial zoning would represent an expansion of the existing commercial-industrial land use pattern to adjacant residential areas. He also suggested that the proposed developement would be inconsistant with the objectives of the Village's Comprehensive Guide Plan. On the basis of these findings plus the fact that the property was not served with public utilities, the report concluded by recommending that the zoning request be denied. Mr. Stewardt Gayle, an attorney representing the petitioner, said that he felt that the staff report was in error concluding that the proposal was inconsistant with the Guide Plan . He did not feel that industrial development of the type proposed would present a hazard to the public health and welfare if it were develo�ed: dn sites not served by public sewer systems. Following considerable discussion between the Commission and the petitioners regarding the matters mentioned by the staff report and Mr. Gayle, Mr. Raguet moved that the Commission recommend to the Council that the request for industrial zoning be denied for the reason reviewed by the Manager. Mrs. Meyers seconded. On roll call , all voted aye. Motion carried. C. Edina Building Int. 'H60sin -Recreation Complex. Duck Lake Trail. Mr. Don Ripple, a planner representing the petitioner reviewed their previous application for a planned unit development of housing and recreational facilities. . The Manager presented a staff report dated March 17th which reviewed a variety of factors affecting the consideration of the project and -concluded by recommending that the project concept be-,approved subject to restricting the number of units to that permitted by single family densities; a determination of the location and desing of the parkway proposed within the westerly portions of the project area; a restriction that no apartment unit could be closer than 400 feet to existing single family dwellings; appropriate utilization of existing topography, grading and plant material to screen multiple dwelling units from existing single family developments; and the inclusion of the unp .atted area to the south of the project near Duck Lake Trail in the project design. A--number of residents from adjacent subdivisions were present and expressed their opposition to the proposal . They specifically objected to the proposal of locating the proposed parkway adjacent to the westerly boundry of the applicant's property and the proposal to provide garden apartment and town- house housing types. Mr. Ripple, the Manager, members of the Commission and i affected residents engaged in a thorough discussion of the project proposals and reached a general agreement that it would be appropriate to discuss the project futher at a meeting to beheld in the affected nieghborhood. Mr. Ripple was asked to prepare alternate development proposals for consideration at the meeting. Mrs. Schee moved that the Commission defer futher action on the proposal until the applicant and the residents had had an opportunity to discuss it at their neighborhood meeting. Mr. Raguet seconded. All voted aye. Motion carried. D. Zonin Application Fee Policy. The Manager advised the Commission that the Council had recently enacted a Resolutionestablishing the Village's policy on charges for handling zoning review and appeal applications. The policy generally declared that all costs incurred by the Village, in the process of handling these applications would be paid by the applicant. Meeting adjourned at 11 :45 P.M.
