Planning Commission - 02/03/1970 MINUTES • EDEN PRAIRIE PLANNING COMMISSION Tuesday, February 3, 1970 7:35 P.M., Village Hall Members present were Chairman Skjelbostad, Hauser, LaGrow, Emerson, Schee and Nesbitt. Also present was Village Manager George C. Hite. I. MINUTES OF JANUARY 6, 1970 e Minutes of January 6, 1970, were approved without correction. II. RECOMMENDATIONS AND REPORTS Lana 'Mini:ng' PoTity. The Village Manager presented a report entitled "Policies and Regulations for Mining Operations" dated February 2, 1970, which had been prepared by Brauer and Associates. The report and accompaning maps reviewed present activity and made recommendations relative to policies the Commission and Council might establish regarding the future regulation of mining activity within Eden Prairie. The recommended general policy statements were as follows: Mining is not an end (land use) in itself but a step toward develop- ment an interim land use. Eden Prairie should be divided into two areas, residential and non-residential , in conformance with actual development and the comprehensive Guide Plan. • Mining should be a regulated, permitted, interim land use, in non-residential districts, without justification by evidence that feasible development requires mining. Mining should be permitted in residential districts as an interim land use only when it has been justified by evidence that development w1t' iout mining is not feasible. Regulations for mining in residential areas should be more strict than in non-residential areas. The report also recommended amendments to the existing mining ordinance (No.36) intended to implement policy recommendations. The Manager reviewed the procedure for securing Village approval of mining operations. It is first necessary for the Council to issue a permit to mine in a particular area. The actual mining operation was governed by a annual business license. The Manager reported that there were nine permits currently in effect and that the Council had recently issued 1970 licenses at seven of these locations. Three requests for permits were pending. Mr. LaGrow moved that the Planning Commission recommend to the Council that the policy guidelines set forth in the February 2nd "Policy and Regulation" report be formally adopted. Mr. Hauser seconded. All voted aye. Motion carried. • Mr. Nesbitt moved that the Commission recommend to the Council that the amendments to Ordinance No.36 as set forth in the February 2nd report enacted. Mr. Emerson seconded. All voted aye. Motion carried. Planning Commission Minutes • Page 2 Tuesday, February 3, 1970 Mr. Emerson moved that the Commission recommend to the Council that any future requests for mining permits in residential areas be referred to the Planning Commission for recommendations before Tieing acted on by the Council . Mr. LaGrow seconded. All voted aye. Motion carried. B. Off Street Parking and Loading. The Village Manager presented, reviewed, and recommended the adoption of Sections 12 (Off Street Parking) and Section 13 ( Off Street Loading) of the Zoning Ofdinance. Mr. LaGrow moved that the Commission recommend to the CouncilAhat it enact Section 12 and 13 as proposed for the deletion of subdivision 12.5 (C). Mr. Emerson seconded. All voted aye. Motion carried.
