PUBLIC HEARING ON COMNITY DEVELOPMENT BLOCK GRANT FUNDS FORYEAR V1 The Planner stated that this is a public hearing held to gain citizen and and Coamission input regarding needs Eden Prairie has in the category of housing, focusing mostly on low and moderate income family housing and low and moderate elderly housing. The C.D.B.G. fund is a Federal program or Revenue program which is Federal money that comes back to communities in order to help them with certain goals and objectives which would help elderly, low and moderate income. and handicapped people. The Planner reviewed what had been dam with the money in previous years. In year !,, Eden Prairie prograawda pathway to serve the Briar projectwhich is a project for iow and moderate income families. The pathway was constructed to connect these families with recreational facilities at Round Lake. But because difficulties with the project, it had not been done, therefore, the money for this project was carried into year two of the program. In year II. Eden Prairie Dlanned to out their CDBG fund money toward a trail wayalong County Ro'ad 4 which was to serve as a center spine trail from County I along County Road 4 to the Minnetonka border. But because of long process involved in getting right-of-way for this type of projects this prtject has not been done, but is planned to be started next spring. In year III Eden Prairie constructedtwo parks . This money was split up for different types of projects. $12,M was programmed for reftdeiing and construction at The Preserve . park site, 37.OW was programed far remodeling and con- ; struction at our. Senior Citizen Centeriand the bertancewas put into a category called lead banking. The purpose of this was to put year V. funding fo2ether with the 1979 and 19W funding which will - be about $70,000 each year, to begin to either purchase property to hold the prices of land down,, to purchase anti write the cost down or to participate with the developer to give them an incentive to gild elderly and low and moderate income projects in Eden Prairie, The Planner went on to explain that, last year Eden Prairie adopted it three year program (Eden Prairie is now in their second year of this program. The three year goal was to provide 166 Elderly housing unit. karman stated that he recalls the Planning Commission recon"Ming to pass along some funding to the Hennepin Technical . Center to be used for research into the possibility of solar energy heating for the elderly in order to keep their heating cost down. HeAnquired what became of this idea. The Planner replied that the Federal Government felt that to up grade housing by insulating and other methods would be a better idea. They olso felt that it would be a better idea to use solar energy ideas in mw projects instead of trying to incorporate them into old ones. We are in need of elderly housing goals. Torje3en stated that he feels that instead of thinking only of building new projectsfor the elderly, that the Commission should also think of rehabilitation of the homes that the elderly are already living in. The Flannner replied that part of the CDBG funding has been- set aside in previous years for rehabilitation. There has been aproblem findinq peopi a .that need help that qualify. He stated that they have gone to ser- vice organizations throughout the community and have published numerous articles in the paper in an effort to try and-find someone who has a need and would be eligible for this exact type of funding. . Bearman ' inquired whether there was time enough to allow for written comments regarding this years program. The Planner repl ied that this is possible He..add6d that there is a human .Rights Commission meeting on November 26 which deals with this very matter. Jerry Beauvais, 7736 Meadow Lane, state that he feels one of the reasons that people have not come forward is because of the way the CDdG funding is communicated, }nd that people do not really know what this money is for. The Planner replied that he realizes that this might be part of the problem, therefore they have decided to go through the Pioneer club to explain to the Senior Citizens the different types of funding that . is available to them through the CDBG Fund. Mark Flmburg, representative from Hennepin County, stated that WAD feels that it would be better to contact people who have already investigated solar energy instead of devel opirig your o+in program with a non-profit orientating group. Seaman stated that they had planned to use the students at the area vo-tech. Elmburg replied that they have found through t1e CETA workers and the use of them in the past that it is more expensive to use the trainino mechanism then it is to go out on the private market and hire a profit • orientated group to do the work, Elaftrg also stated that the County feels that rehabilitation of the -older homes is an excellent idea. - It helps to keep the neighborhoods - intaut. and they feel that it is important to allow !coney- for such a project as this. MOTION: Untley moved, Toriesen seconded to continue the public hPAring to the CD6G Fund to the November 26, 1979 meeting to allow further inpoat by the public and for further consideration by the Cancission. DEVELOPMENT PROPOSALS S . A. willow Creek Farm, By Vernon C. Geiger. Request to rezone approxi- mately 6.6 acres fran Rural to R1-22. Located west of Flying Cloud Drive and south of Willow Creek Road. A public meeting. Page Longeway, gave a brief presentation explaining than the Geigers want to rezone their property in order to find a buyer for their land. She stated that people are not interested in that much land unless it can be split into a few different lots. She also stated that there is no sewer on this land and that the residents on Willow Creek are not Sri 11 ing to have it put in, therefore the cost of having sewer and water put in Mr. Geigers land wwjld be prohibitive. Vernon Geiger -stated that in order to keep this area residential It is important to have it rezoned and that unless it is rezoned It i too costly for one person. He also stated that he would b c Y Willow Creek covenants regardinq his land. The Planner stated that the staff recommends approval subJect to Watershed District approval of gradinq and erasion control,. and that detailed site, grading.and home locations be submitted with the preliminary plat submission or prior to any grading on the site. Owner notify City and Watershed District 48 -hours prior to gran i ng. He also rvcorn, nda that the owner pursue the possibility of petitioning ' (along with other surrounding property owners) for the extension of sanitary sewer to serve the site pprior to City Council review of the zoning request. That thct pre- limipary plat should meet all City ordinances. Also all lots platted for horse construction be subject to cash park fee payment at time of building permit application. TorJesen stated that he felt that the Planner had a good paint, and that he also feels that this land should be kept residential . He then questioned that s proving zoning without a Plat is the Cmaisslon approXg this number of lo!s or is it possible that someone else might cane with this type of zoning and request half acre lots. The Planner replied that this is possible unless the Commission or City Council dr a s up a developers agreement stating that this land should be kept to five lots. A continued public hearing. 11:e Planner skated that there was a last minute netting with the Engineering staff, Planning staff and the Henner;n County Highway Department on Friday. November 9. At this meeting the ller4r.pin County NWY Dept. pre-sersted a concept of improvements for on County Road 4. This would include a dedication -of an additional In feet or R.O.M. from Prairie Village Mali along their eastern bmindary. The concept also proposed a median for a protected left turn lame into the northern entrance of Prairie Villvsge Mall . This world make the existing main entrance a right-out only. Mir. Norderhaus, representative from Eagle Enterprises Inc. gave a brief ppresentation explaining that he has revised his plan so that the drive-up facility for the bank is pox within the deve!%4aent site and no longer utilizes one of the Prairie 'pillage Mall exists. The Planner explained that the proponent owns the entire piece of property and they intend to own and manage the both the elderly housing project and the professional/bank building as well as the O�rairi` hill fse mall r thovroFn�+n ���� �v w� io8404 *i.� to"VU is too %o .ci%,.y line down the middle. .y Torjesen inquired when the area shown as future parking would be developed and if the wooded area north of this would be left in 4 its natural state perminately. Mr. Norderhaus replied that future parking was proposed for the elderly- housing in the event it would- be necessary, and that no further development was planned for north of this parking area. Bearman inquired 1f there were any type of landscaping plans to x show how this site was going to landscaped. Norderhaus then gave a brief presentation showing the type of land- scaping plans they have for this site and their relationship to the residents neighboring this site. The Planner .stated that the landscape plan presented at this time is only a concept landscape plan and that a more detailed land- scape plan is required before building permit issuance. Jerry Beauvais, 7735 Meadow Lane, stated that the residentsof Meadow Lane area have all met with Mr. Norderhaus regarding the privacy and security of their homes in relationship to this development. He stated that Mr. Norderhaus has been very considerate of their request and has taken all of them in to consideration when doing the landscaping for his development. Bentley inquired about the drainage and if there were any plans for drainage. Norderhaus replied that all the drainage would be taken to a private storm sewer system that would flow toward highway 5. Bentley asked Mr. Beauvaas if they were experiencing any drainage problems in the area currently. rr. Beauvais replied that there is no type of drainage problem, The Planner gave a brief presentation on the meeting that the Planning and Engineering staff had with the Hennepin County high- way Department. i Commission then had a general discussion as to what the intersection in4rovements would be, when they are to be constructed, how they are to be paid for, and who would participate. The Planner replied that Hennepin County has a tentative concept and that the Planning and Engineering staff will be meeting dul'ing t" the next week with the Hennepin County Highway Department and MnDot to work further on the answers to these questions. 4 " MOTION: TorJesen moved. NOTION: TorJesen moved to recommend to the City CQLmc i 1 approval of approved Planning Commission Minutes -7- November 13, 1979 the rezoning from RI -22 to Office and RM-2.5 for small office building and a 45 unit elderly apartment on 4.4 acres per the staff report dated 11-8-79 provided that item 6 read "That the developer understand that he maybe required to grant additional right-,Of-way and improvements to County Road 4 as determined by Hennepin County and other interested parties . Bentley seconded provided that the following be amended. Item 2 read "that all signage be according to city ordinance with the exception of the bank having a sign of up to 20 ft. and the land- scaping be according to city ordinance. That item 4 have the addi- tion that no cash park fee be required on the elderly housing. Also that the parking lot lighting not exceed 20 ft. in height and that fixtures be of a cut cif luminaire type restricting light to the parking lot area only. And also include the letter from MnDOT dated 10-15-79 and the letter from the Hennepin. Ounty highway Dept- ment dated 10-3-79. Amendment to the motion were accepted by the mover, Motion carried 6 - 0. D. Gonyea, PUD, request for PUD concept approval for 37 acres for duplexes , elderly housing, offices , and restaurant uses. A con- tinued public hearing. Howard Dahlgr,%--n, representative frcm Howard Dalgren Assoc.gave a brief presentation explaining the changes he made on the plat. He y,-plained that they i;ave now incorporated a lot for a 40 unit elderly housing project in place of one of their. office building sites . He also explained that the original office building that was whomi on highway 5 has been reduced from 18,000 sq. ft. to 14,000 sq. ft. and the access road to it has been brought out to make an intersection on highway 5 directly north of Fuller Road. The Planner stated that the staff recommends that the Commission recommend approval of the request for PUD concept to the City Council provided that the site shown as fast food Burger King restaurant be converted to either office or a very • low trip generation restaurant use. That this approval be subject toconformance with all city ordinances and proper site plan review at time of zoning and pre- liminary platting. That• pedistrian system be incorporated within the project including a five foot wide concrete side walk along county Road 4 and a five foot wide concrete side walk along the southern loop road from County Road 4 northeasterly to the single family area. That adequate right-of-way area be reserved according to Hennepin County requirements in order to allow improvement of the intersection in the future. Cash park fee of $1400. per acre or what ever fee isapplicable at time of building permit issuance be required on this site. Modification of the pond subject to Dept of Natural Resources approval . If the elderly housing site is not to become an avai 1 abl a opti o n in the future the concept must be modi fied through a PUD amendment. All site plans submitted for preliminary platting and zoning approval will be subject to preliminary archi- tectual drawings, detailel,- site plan and all provisions of City ordinances. Bearman inquired whether a joint access had been worked out between the eastern proposed offi,;e building and the Prairie lawn and Gar- den Center. Dahlgren replied that although they have contacted Mr. Riegert of the Prairie lawn and Garden, he was not acceptable to joining the access. He continued to say that he doesn' t feel. that just omitting the Burger King Restaurant is fair because any type of restaurant is going to add to the traffic problem. Torjesen stated that he Peals that the proponent: has work hard to solve the problems and has revised his plans to comform to the recommendations of the staff. He continued to say that if the proponent has definite plant of how he will help improve the inter- section of TH 5 and County Road 4 at the time of rezoning, this PUD concept should be apprdved. MOTION: Bentley moved Martison seconded to recommend to the City Council approval of the PUD concept dated November 7, 1979 and oer the recommendations of the staff report dated 11-8-79 with the following additions: under recommendations item 3 should have the addition that cash park fee would not be required for the elderly housing units , item 7 have the addition that any commercial development on this site he contingent upon specific traffic improver;ent requirements and solutions to be determined prior to rezoning and or preliminary platting. Request to rezone b. 6 acres from Rural to RM 2.59 preliminary plat approval for 7 lots, and approval of an Environmental Assessment 8orksheet. A public hearing. Gregg du'Monceaux gave a brief presentation explaining the improvements which they have made on this protect. He explained that they have reduced the number of units, changed the position of the access and improved their buffering. Beaman inquired if the eastern portion of this project was on the same grade as the Hanson Auto property, du'Monce�ux replied that it is not, that that there is an upper eleva- tion of about 880 feet and then a decline to about 855 feet. Torjesen inquired if the developer planned to continue 70th St down to the southwestern part of this project. du' Monceaux replied that they are having problems with that very items and that they have not yet decided exactly where the road Mould go. Bentley inquired if the developer, was planning on extending that road at all . du'Monceaux replied that at the present time they do not feel there is any need to extend that road. The Planner stated that the road continuing through seemed very impor- tant at the time of initial stages, and that they have been trying to get some easement through on the southern part of Mr. Anderson's 5th addition of his industrial park. However the road seemed more impor- tant at the beginning for a few reasons. 1 . Because if the road is not continued it is just a cul-de-sac development, with a long cul-de- sac going back to a very difficult area. 2. From the proponents stand point their main entrances coae from either a junk yard or through a wajor industrial park. He stated that from a city stand point he feels that the road system should be built. . Searman inquired just how long the cul-de-sac is. Planner replied that it is approximately . Bearxer, inquired if they have investigated the possibility of building core into the slope to prolide for better energy conservation. du'Monrea,:s replied that they are investigating that presently. Torjesen lr,,iired if with that east-west road being conceived as a private road does the rule that there must be to ways out apply. The Planner replied that the development has two ways out. Torjesen inquired it the planner felt that the industrial park would wake use of this road. Planner replied negative.
