The Planner replied that he felt that Gonyea, Cor Investmeiit and Prairie Village Professional have a commdn denominator, that being the intersection of County Road 4 and TH 5 and the traffic problems pertaining to that intersection. Therefore the agenda should be altered to keep them f n ;;hat order. • Levitt inquired whether or not the proponents had been notified. q p P The Planner replied Affirmative. MOTION: Bentley moved, Levitt seconded, to approvalthe agenda as modified 1.n the letter of transmittal . Motion carried unanimously. II . APPROVAL OF THE SEPTEMBER 24 1979 MINUTES. Considered under Old Business. III. #1EMBERS REPORT artner brie ly reported on 212. She reported that there has been no adoption of a route, but, they feel that they will reach a final decision by their December meeting. Their meetings are the second and fourth Wednesday of each month at 7:00 in the Carver County Court House in Chaska. IV. "SPORTS AND RECOWiEDATIONS A. CONY A PUD, request for PUD Concept approval for 37 acres fci• duplexes, elderly housing, offices, and restaurant uses. A con- tinued public hearing. Proponent had requested a continuance. Planner reported that the proponent has completed a traffic study which illustrated the impact of this project on the intersection's traffic flow. This study indicated that the intersection is approaching unstable flow and with the addition of traffic from the Gonyea P'.U.D., the intersection will almost be at a point of intoleralbe delay. The intersection is rated on a letter basis of "A" through "F" . '"Fr" being the worst. Mr. Levitt inquired whether the traffic study was done with con- side.•ation of the development The Planner replied, the intersection was first studied with out consideration of the development giving the intersection a rating of D+. It then included the consideration of the development, giving r it a rate of 0-. a , The Planner also said that the report recommends that TH 5 be devloped into 4 lanes so that the traffic has additional stacking on the through lanes allowing more "green tim," on the turn lanes so that it' s not stacked u so deeply. The Highwa Ce artment s'-ated that any improvements to the intersection at tf�is tip me would require the developers help for financing. : Joe Kissinger, 6601 Barberry Lane, Eden Prairie , MN stated that he felt than a tast food restaurant was not an appropriate use for this land and that he didn ' t feel that TH 5 should become a : fast food stretch. He also stated that he would much rather see something such as elderly housing go Into that area . Joe Lawler, 7621 Ontarie,stated that he is concerned with the drainage, and he wandered if dredging the Meadows outiot area would help the drainage problem behind his house. The Planner repl ied that he would-check with the Engineering Department. The Planne► also reported that he", suggested to the proponent that they reintroduce the originally proposed elderly housing into the piar in place of the offic4c building north of the restaurants. NOTION: Levitt moved, Gartner seconded to continue the Goneya public hearing to the November 12 meeting. Motion carried unani- mously. B. COR Investment Corp. , By Cor Investment Inc. Req!..est to rezone 4 acres from Rural to Office. Locatea South of TH 5 and West. of SA station. A public hearing. Lyle Folkstad site otanner 'for Cor Investment, gave a brief presentation on the Cor Investment project explaining the problems with the parkinq tot and parking lot lighting of their first plat. He then presented their revised plat showing that after meeting with the staff they have decided to scale the building down, which will require less parking and allow more area for buffer around the site, and also reduce the traffic impact. • Levitt inquired why the Cor Investment Corp. had changed its land use from a 48 unit housing development to a professional building. Folkestad replied because of- lack of financing. Retterath inquired about where and if there was going to be a frontage road around that project site. Lance Norderhus gave a brief presentation on the proposed project = and stated that after talking to the Planner they know revisions must be made. The Planner explained that the arrangement of eliminating the western preimelter road of existing Prairie Village gall as a second access to the Center by utilizing it as a bank drive-up was a problem becaus of fire safety, elimination of parking and poor - approach for the bank. He explained that by revising the plan to have the drive-up facilit on either the north or south side of the building '(on the E st end and moving the entire office building west there would be more space provided for proper stacking of cars approaching the drive-up bank, it would eliminate the problem of fire safety, and the problem of parking. W � approved Planning Commission Minutes —4— October 22, 1979 Planner stated--that the existing Theresa Place R.O.W. is 60' .. Front yard setbacks are taken from the R.O.W. In order for the set backs and utility placements to be consistent there should have 60' R.O.N. This request came from the Engineering Department. Bentley inquired about lot sizes in terms. of depth. If Theresa Place R.O.N. is widened then lot 6 will lose footage and cause it to fall under 22,000 sq. ft. Planner replied that the lot lines could be slightly adjusted to wake the lots 22,000 sq. ft. Levitt inquired what the zoniinq of the surrounding areas was. The Planner replied R1-22. On the basis of the plat itself the project meets the character of the surroundina area . Levitt inquired whether the 50' radius on the cul-de-sac was in compliance with the standard cul-de-sac. The Planner replied that is the standard size for a cul-de-sac. Levitt required whether it would be possible to have the cul- de-sac made larger. The Planner replied that the City Engineering department felt that this was as large as a cul-de-sac needed to be. Gartner reported that Don Peterson had some concern- about a path that goes behind his home which the children use to get to school . Mr. Miller replied that they could accommodate the pathway . The Planner stated that this matter should probably be brought up with the Park and Recreation staff. Richard Jocobs, 6995 Mariann Drive stated that he has property west • of Sutton first addition which is currently unsewered. He stated that at the time of review on the Don Peterson proposal the City assured him that future opportunities for sewer access would come from the land currently under consideration as Sutton First. Orlyn Miller, site planner fo Fir. Sutton, replied that a sewer --- - easement between the western lots could be granted to allow for future sewer access. MTION: Gartner moved, Bentleyseeonded to close the public. hearing on Sutton First. Motion carried unanimotisly. MOTION: Gartner moved, Bentley seconded to recommend to the City Council approval of the preliminary plat - dated 8-20-79 per the staff report of 10- 16-79, subject to Park and Recreation looking into the possibility of a pathway, Engineering reviewing the sewer problems out lot and checking the drainage, particularly. on W"t 4 and 5. Planner explained that this item had previously been reviewed by ' the Planning Commission as 14 duplex buildings or 28 total units and referred to the Council for approval . The City Counc i l sub- sequentey revieied the request and felt that the duplex land use was inappropriate as a transition between two single fa,>tily projects. They, therefore, have referred this item back to the Planning Com- mission. Hustad has since that time revised its plat to single family units. Dick Putnam gave a presentation explaining the size of the lots, the number of lots and the grading plans for this project. II* also explainew that after talking to the Planner there was some concern over the amount of trees to be cut for the development of this project. Therefore Putnam reviewed the site plan and found that the tree line hdd been drawn incorrectly and that they mould not be. coUtting as many trees as Anticipated. the Planner reported that the staff recommends that the area shown as e park be graded with berms and a totiot installed according to Community Service Department reccxemendati ons, the cash park fee be paid at time of building permit issuance on all 29 lots , there be resolution to the satisfaction of the City Engineering Dept. of the drainage and sanitary sewer utility questions. Side yard set- back variances of 5' garage side and a 10" living side be limited to lots 1 - 7 block 1 and lots 1 - 10 Block 2, the request for no garages at initial construction be limited to lots 1 - 7 Block 1 and lots 1 - 10 Block 2 and that foundations and block up to a sill plate for a garage be installed as an attached portion of the house at the tire of initial construction. The project must be reviewed and approved by the Riley-Purgatory Creek Watershed District prior to grading. Bentley asked whether there had been any plans for a pathway which Mould allow access to the totiot for the children at the bottom of the hill . Levitt inquired why lots �ere a»pwrmd ar, o,e twl-de-sac, when in the past, projects were not allowed to have more than 3 lots fronting on a single cul-de-sec. He noted that if the house did not have garages there would be -no alternative other then to park in the cul-de-sac. Dick Putnam, Hustad Developf nt. Planner replied that the staff felt that the lots on the top of the hill could be a neighborhood similar in character to Yorkshire Point. Bentley stated that he felt that Phere would be less transitions with lots e-10, Block 2 all without garages. He felt this reinforced the image of small home on small lots. He felt that a better transition would occur if only the western lots adjoining Yorkshire Point were given a garage_ option. The remainder of the lots-- in the Bevelpment would be required to have garages accordi nq to ordinances Stewart Loper, 9506 Woodridge Circle, Eden Prairie, MH, felt that there was a definite need for a totlot for this area. He a',en stated that he would prefer to see the houses custom built with gar;,ges. Dick Putnam, Hun tad Corp, replied that the lots had not yet i een sold therefore, he had rto.way in knowing whetiter or not the hones would be custom built. He also agreed with Mr. Loper that the houses should have garages or atleast garage options. Carolin Koschinska, 9379 Creekwood Drive, Eden Prairie. M. stated that she thought there shoud definitely be some type of pathwy that world lead to the park or totlot. Planner replied that currently the Community Services Staff is invest- igating the possibility of a mini park site to serve the Creekwood area east of Creekwood on The Preserve property. Bentley then suggested that the motion be amended to read Cw. nission recommend to the City Council the rezoning fray RM 6.5 and Rural to F.1- 13. 5 for Overlook Place per the staff report dated 10-17-7q with the change that only lots 1 - 7 Block 1 be allowed the garage as an option. The balance of the lots would be required to have a garage according to city ordinances. Mover accepted amendment. J VOTE: Carried 3-1 G. VALLEY KNOLLS 2nd, By Marvin Anderson. Request to preliminary plat single family—lots on 4, 5 acres zoned R1-13.5. Located west to Duck Lake Trail . A public hearing. Mr. Fred Haas, Anderson Construction, gave z presentation explaining fiat in 1972 Valley Knolls was rezoned from Rural to R1 -13.5 and preliminary platted into 49 lots. - In 1973 a portion of that addition (39 lots) was preliminary and final platted, The present request for preliminary plat -approval will complete the -platting* and will include jiving Mrs. Miska approximately 15 feet on the south side and 20 feet on the north side of her property, in order to a i l ow her platting of three of the thirteen lots being requested. 1t a Planner reported that the staff feels that the plat should be revised so that each lot meets the requirement of 13,500 square feet, that the developer work with the Engineering Dephrtment regarding number and location of service hook-ups Payment of cash park fez at time of building permit application would be required, and the developer submit gradinq and development plans to the Aline Mile Creek Watershed District for review and approval . Levit` inquired what the density of the 13 acres would be. Planner replied that there would be 3 units per acre. Levitt inquired why the whole develupm-iient was not platted at the sam time. Planner replied that it was not platted because the utilities had not been installed along Duck Lake Roau. - Glen Olson, 1700 67th St W. , Eden Prairie, Mn, stated that he is con- cerred about the cutting down of the oak trees on 1of 7, and ft drainage of cSte area. He states' that he felt that there should be a definite grading plan and that the grading should be supervised to insure that it is done correctly. He also stated that he is concerned about the amount of traffic that will be generated after Deck LaKe Road 'is paved. MOTION: Bent?ey moved, Levi tt seconded to recommend approva i of Val 1 ey 'Knol 1 s 2nd preliminary plat dated 9-24-79 based upon the staff report dated 10-9-79, contingent upon a signed contract between Elaine Miska and Marvin Anderson Cnnstr-uction stating that the parcel to be conveyed to Elaine Miska from Marvin Anderson Construction according to the pre- liminary plat dated 9-24-79 be free and clear of existing assessments.
