as published and amended. Levitt seconded. motion carried 5-0-2 , with

Levitt inquired about surrounding land use and expressed concern with
transitional uses in going from, ..,edium density to industrial . The
Planner explained there was existing vegetallon that would help wdke
the transition.
Sundstrom ouestioned why the change from the 1971 PUD plan? Gustafson briefly
explained the three major changes that havehad an impact on
the plan : clear industry that needs office warehouse space has increased ;
the development of this whole region as an employment base; and the demand for
townhouses and multiple-family hotisinr, is not as strerg as it was in 1971 .
Mr. Steve Rowland, 8125 Ensign Road , was concerned with his property becoming
landlocked without an access . He pointed out that the area to the north of his
property is high and that his access will have to be to the south of the proposal .
Gustafson commented that this property was landlocked when Mr . Row'dr. pur-
chased it and there has been a line of access through this property by
easement only from parcel to parcel
Levitt inquired whether any other type of use for Highway-Commercial besides
a restaurant type of use could be prpposed for the area .

Levitt felt that medium densi�y homes would to logical in this site, and
doer not see any more opportunity for medium density in this area.
Mr. Leonard Uherka, 6301 Shady Oak Rd. , commented that when they purchased
their property, they expected this type of development and they did not see
any conf'1 i ct.
MOTION: Levitt moved to continue the Shady Oak Road PUD request by D. H.
Gustafson & Asso4. Inc. to December 11 , 1978, until -the proponent could answer
more of the questions. Retterath seconded, ration carried unanimously.
Chairman Stindstrom suggested proponent work with the Staff to resolve the
questions.
Gustafson was concerned that he may not have complete information for the
Commission to make a decision on the llth. He explained
that they have spent
two years slecting a site and they have a plan fore their building; their staff
is making an unqualified recommendation to approve the plan. He will work with
Enger to try to resolve problems identified in the staff report. He explained
further that the outcome of the option with the corporate headquarters will be
known by December 14, and they realize that they have created the problem on tltie
southern half of the site and any recommendations will have to be based upon
what happens on the southern part .

C. 1978 Guide Plan Update (cont` d)
Levitt pointed out the feeling of the Planning Commission toward
the Centex proposal , in contrast to 1heVi 11 age Woods proposal ,
explaining that it is not ,lust a lot size question.
Lynch commented that each lot size regdirement should stand on its
own merits etc. , which comes down to the P .U .D . process , which
accomplishes this point through trade-offs . Ile felt that perhaps
restriction should be made or the size of house on the smaller
lots rather than on the size of the lot.
Martinson felt that in reducing cost of the lot by making it smaller,
that the cost will come up to 13. 5 lot size after house is built.
Enger pointed out that the developer should show proof of his
ability and committment to bijild a moderate income home, if given -
approval on the smaller lots .
Various other points were discussed such as trend of people not to
iiv� in one house for a lifetime; antiquated labor methods ; timing
and pre-fabricated housing.
The Planner asked the Commission to consider whether it is still their
intent to provide housing in the low and moderate income
field.
Sundstrom pninted out that previously lots were set aside as open
space, with Homeowner association maintenance, and inquired whether
The Community Block Grants could be used for this purpose.
Beaman commented that he would rather use various enticements to
the developer, rather than subsidies .
The Planner pointed out that a mobile how park is non-subsidized
and provides low, moderate type cost limes .
Lynch felt there were problenm with mobile homes , such as no tax
base, more children for the schools to accomodate, and etc.
The Planner comnnented that F.N.A. has been a source of subsidy to
the middle income home owner in reality for years.

NOTION: Levitt moved to reschedule December. 25th meeting to December 18th
at 7:00 Ply, for the purpose of discussion of the 1978 Guide Plan Update
and the Community Development Block Grant. Retterath seconded, motion
carried unanimously. (Retterath commented that she may be unable to attend
the meeting)
ADJOURNMENT - Levitt moved to adjourn at 10:30 PM, seconded by Retterath.
Notion carried unanimously.

Iv. REPORTS AND RECOMMENDATIONS

Development Plan approval and preliminary plat for 72 lots
on 34 acres . Project is located SW of Round take. A continued
public hearing.
The City Planner noted the letter received from Mr. Eliason re-
questing a continuance of the public hearing.
MOTION: Levitt moved to continue the Round Lake Estates , 2nd Addition,
until December 11 . Retterath seconded, motion carried unanimously.
B. Shady Oak Road PUD, by D. H. Gustafson & Assoc. Inc . request
for PUD approval on 108 acres for Highway Commercial , Office and
Industrial uses . Rezoning from Rural to I-5 for 29 acres of
108 PUU and preliminary plat approval for 48 acres . Site is the 71 -02
Shady Oak PUD located South of Cr, sstown 62 , east of Co. Rd. 61
and west of U.S. 169. A public hearing.
Mr. Dan Gustafson, D. H. Gustafson and Assoc. Inc. , presented
the request, explaining that in 1970 they had purchased land .and
:n 1971 received PUD approval for their land use
plan. Since that time, they have made numerous attempts to develop
the property. Recently the e'Yhave sold 48 acres %n R L. Johns^n Invest. Co.
and have entered an option w.ith a major corporation for corporate
headquarters on the" southern 60 acres. He showed aranhir.r, n.f _a11
aspects of the proposed plan and answered questions.
The Planner explained the basic problems of the plan , pointing out
that according to the 1971 PUD, the southern and Eastern areas of
the entire triangle were being designated as medium density resi-
dential , and the Staff is concerned that many of the multiple
family sites in the city were being converted to other uses They
feel that the property along the freeway would come under pressure
to develop as industrial also. He also expressed concern with
industrial traffic through residential areas , that would be possible
with the road system.
bearman asked what the plans were if the corporate headquarters
proposal did not materialize. Gustafson explained it could be
revised to office designation. He would be willing to re-analyze
road alignment ! through the pond in the proposed industrial area.
Martinson asked whether they had worked with the watershed District
and Department Of Natural Resources on their drainage plan.
Gustafson responded that they have met with those two bodies. t

Lynch pointed out that unless the southern suction of the site is
more definite, he does not have a basis for his opinion.
Sundstrom called for a five minute recess .
Swendseen Road Donation Offer
The Planner explained that he had requested that this item be
added tc the Agenda in connection with the Shady Oak Industrial
Park proposal submitted by Richard Anderson , and the Shady Oak Rd.
question. He further explained that the City is being asked to accept
donation of- the Swendseen land in connection with the construction of
the road.
MOTION : Levitt moved to recommend to the Ciay Council to accept the
Swenseen proposal and request Staff to give s .!-matic of roadwav already
accomplished. Retterath seconded, motion carried _6-C-1 . Bearman abstaining.
C.* 1978 Guide Plan Update
Beaman expressed concern with a 10,000 square foot lot size as a new
zoning district to accomodate arbitrary lot sizes . He felt that the
City should have specific goals for that specific lot size as far as
density.
The Planner explained that a 9,000 sq. ft. lot size was first considered,
but after discussion , it was felt that size was not entirely consistent
with what was brought up at the Guide Plan Forums regarding housing.
Beaman felt, that in his opinion you are not seeing any difference in the
cost of houses being put on the smaller lots , and questioned having more
people in relatively expensive single family homes on smaller lots . He
was in favor of keeping the portions of the Guide Plan that have been
successful in Eden Prairie.
The Planner explained that the 10,000 sq. ft. lot size would be considered
only if it helped provide middle income or io•:v income housing. There
has to be some type of co.nniott:mnt frcm the developer perhaps as to
the . maximum home size. He explained further that staff has discussed
the idea of maximum Floor Arep Patio being used as the criterea .
,Bearman pointed out that 60S of the residents like the idea of "open
space" . He commented that Hopkins has used smaller concept for cluster
housing, but with landscaping behind them. He felt we should leave it
"loose" as far as size of house built on the lot.
