APPROVAL OF AGENDA Bearman moved, Lynch seconded, to approve the agenda as subwitted. Motion carried unanimously. II. MINUTES OF THE AUGUST 8, 1977 MEETING Lynch moved, Beaman seconded, to approve the minutes as written. Motion carried 5:0: 1 with Schee abstaining. III. MEMBERS REPORTS A. Chairman 5unds t rom 1. Sundsti-om directed the staff to request proponents submitting plats to clearly date such plats. 2. Sundstrom reported that Commission member Redpath by letter has requested an approximate 6 week leave of absence to pursue his school bond concerns. The Commission unanimously agreed to the requested leave of absence for Mr, Redpath. B. Retterath 1. Mrs. Retterath informad the Commission Council Member Dave Osterholt desires having a joint meeting between the Commission and Council . Bearman felt such a request should come from the Mayor on behalf of the Council to the Chairman of the Planning Commission. Sundstrom stated he would contact Mayor Penzel relative to a joint meeting. 2. Retterath stated Osterholt also expressed interest in having a Commission representative at Council meetings. Sundstrom stated he has been unable to at and recent Council meetings but intends to have the time later this year. He suggested Commission members interested in attending Council meetings do so as a Planning Commission representative IV. REPORTS AND RECOMMENDATIONS A, Edengate, by Gerald B. Pautz and Pau.tz Franklin Realty Co. , request for PUD Development -plan and preliminary plat approval and rezoning from Rural to RM 6. S for 198 townhouses. The site is located north of' Duck Lake Trail 2/4 mile east of TH 101. A public hearing. Motion Dearman moved, McCulloch seconded, that since the legal opinion has not been rece3 ved from the City Attorney and no staff repr•. . has been prepared todate, that the item be continued to the September 12, 1977 meeting. I ' • , approved Planning Commission -2- August 22, i977 Discussion: Sundstron inquired when the City Attorney's opinion could be expecte3. The planner replied the City Attorney has verbally informed the staff that :#i. The area has an avcroved PUD, and#d. the application should be processed and reviewed. considering the public's haalth safety and welfare, etc. , just as any other submission. Beaman stated >>e would prefer to have the Attorney's opinion in writting so to .� have for record and guidelines. Vote: The motion carried unanimnusly. ; t Motion: Lynch moved, Beaman seconded, to consider- item VIII. A. American Family Insurance Sign Request before IV. B. Knoble Addition as the proponent for Knoble Addition was not present at the time. Motion carried unanimously. VIII. PLANNER'S REPORT ' A. American Family Insurance Sin Request The plamier briefly reviewed the sign locations stating the sign by the Crosstown is proposed 201xl2' and the sigra by the access street 4x12' He stated the staff is recommending approval of the signage request. aBearman inquired how far the sign. is from the Crosstown highway. The piawwr estimated 4S0 ' , with the lot having approi.xmately 400 feet of frontage. McCulloch expressed concern that other uses along the highway asy also request variance from the Sign Ordinance. Notion: Lynch moved,, Schee seconded, to approve the signage request for American Family ' Insurance for a 120 square foot sign and a 40 square foot sign as per the staff report of August 18, 1977. Notion tied 1:3 with Bearman, McOu l loch and Sundst rom voting nay. Motion Schee moved, Retterath seconded, to table the Sign Request for American Family Insurance until later in this evening. Motion carried S: l with Lynch voting nay. IV. A. Knoble Addition, Universal Land Corporation, request for rezoning fv.vu Rural to R1-13. 5for 11 single family lots and preliminary plat approval of 11 lots. The site is located east of 168th Avenue on approxim*t*1v S. S scv*s **st of Conchlight Manor Addition. A continued public hearing. The planne .'i£ormed the Commission the proponent has redesigited the plat dam to 11 lots , t'. ._ plat meets all conditions of Ordinance 13S, and the staff is reconow4ing approval of the request . t Mr. Peterson, represer:ting Universal Crud :.corporation, stated the revised plat of 11 lots fits the land better, the lot sizes range from 14,400 to 19,200 square feet and the minimum front frontage is 102 feet. approved Planning Commission -3- Auvu_,i. 22, 1977 Bearman inquired if further soil tests had been done. Mr. Peterson replied the lots are large enough so homes can be placed sway from bad soils . Mr. Grant Gilderhas, 16855 No. Manor Road, stated the proposed project dnPc „nt enhance the neighborhood and is spot zoning. lie requested the Commission to deny the project as it would be premature development of agricultural land. W. Peterson stated the '68 Guide Plan depicts this area as single family resi- dential and within the City Zoning Ordinance , District R1-22 is for areas without sewer and water , and R1-13.5 for areas with sewer and water as is available to this site. Mrs. Roeder, 6435 168th Avenue, expressed concern that the grading of the lots would increase water runoff onto their property. She stated that backholes had been dug on the property in question, not soil borings and that it is her opinion the site is not buildable. Mr. Peterson replied backholes were dug in 1973. Mr. Gilderhas did not feel the culvert under the Roeder's drive would be able to hanyle the additional runoff. Mr. Roeder also felt the culvert under the drive would be inadequate as it functions poorly now after heavy rains. Mrs. Huntley, 6581 Undestad, stated homes in Coachlight Manor are on top of an old water bed and felt the same grater bed will effect the proposed Knoble Addition. Mr. Knudsen, 6511 thidestad, inquired if the corner lot house would be setback properly from the Blunt home. The planner replied the building location will have to meet city setback standards in Ord. 1.35. Gilderhas stated the petition presented at the last meeting still stands and is the position of the neighbors who signed. McCulloch inquired if the approximate $11,000 assessment dropped from the property could be recovered if it is developed. The planner replied affirmative. Bob Harrington, 16391 So. Manor Road, expressed opposition to the project. Motion 1 : Lynch moved, Bearman seconded, to close the public hearing on the Knoble Addition preliminary plat . Motion carried unanimously. Motion 2: Lynch moved, Beaman seconded, to recommend to the City Council approval of the rezoning from Rural to RI-13.5 for Xnoble Addition. Motion carried unanimously. Notion 3: Lynch moved, Bearman seconded, to recommend to the City Council approval of the preliminary plat dated Aug. 1, 1977 for 11 lots for Knoble ,Addition as per the staff report dated July 27, 1977 and the Engineer's report dated August. 4, 1977. Mr. Peterson located the site at the Southwest corner of Mitchell Road and Valley View Road. .He stated the convenience center will house a PDQ, offices, Eden Land Office and other retail/office uses . Ed Kodet, Dickey/Kodet Arch. Inc. , reviewed the building design, materials and parking plan. He stated a detailed landscaping plan had not yet been done. He felt a 30 foot setback from Mitchell would be adequate as they intend to extensively berm and landscape the area in between_ the street anal parking lot . He stated a pylon sign and wall identification signs are anticipated. Peterson said they asked to be on the agenda to familarize the Commission with the plan and ask the commission to continue the item so they may complete their plans . Motion : Bearman moved, Schee seconded, to continue consideration of the revised Edenvale Convenience Center until all the material is completed and submitted. Motion carried unanimously. _ D. Oi)Mic Hips 3rd 4 4th Additions, by Olympic Hills Corporation, request to rezone and plat 32 lots from Rural to R1-13.5 . The sites are located north of the NW 'corner of Franlo Road and Pioneer Trail . A continued public hearing. The planner informed the Commission the staff had Don Rippel, golf course architect, review the plan, and Mr. Rippel had some concerns that Olympic Hills is considering and it is expected that revised plans will be submitted. He stated the proponent wishes the item be continued to the next meeting. Notion: Bearman moved, Schee seconded, to continue the public hearing on Olympic Hills 3rd & A th Additions to the September 17.th meeting. Motion carried unanimously. F. Crosstown Industrial Park, by Frank Cardarelle, request to rezone and plat 12 acres nto 3 lots and rezoning from Rural to I-2 Park. Located east and north of the Prairie View Motel. A public heating. S Mr. Brauer, Brauer $ Associates, stated Mr. Cardarelle and he concur with the staff report on the project. Mr. Brauer informed the commission that Brauer & Associates have purchased ene of the lots for their future office. Lynch inquired if the proposed plat leaves any land-locked parcels. Mr. Brauer ; responded negative. the planner asked if the Brauer Office would be ar. office/warehouse use or an office building. Mr. Brauer stated it would be an office / warehouse use. Motion carried unanimously. Motion 3: Schee moved, Retterath seconded, to recommend to the City Council approval of the Crosstown Industrial Park preliminary plat as follows : 1. that the cul-de-sac be extended to northeast corner of property to insure future development access off - of Flying Cloud Drive. Road should be extended as shown in Figure 2. 2. outlet A not be zoned to I-2 Park, but should remain !Rural until future platting of adjacent properties occur. . 3. all industrial lots subject to cash park - fee. Motion carried unanimously. V. PETITIONS AND REQUESTS A. Trumpy Homes Inc. , request to preliminary plat 34 single family lots on 13. 8 acres. The site is coned R1-13. 5 and is located in the NE corner of Duck Lake 'frail and 168th Avenue. The planner reviewed the project' s location and stated the proponent was unable to s the material from the engineers and therefore has asked that it be continued. Wtion: McCulloch moved, Schee seconded, to continue the public hearing on Trumpy Homes to the September 11th meeting. Motion carried unanimously. VI. OLD BUSINESS none VII . NEW BUSINESS none Motion: McCulloch moved, Dearman seconded, to reconsider the American Family insurance Signage Request. Motion carried unanimously The planner produced a 3iagram of the site and sign locations. He estimated that Sign B is approximately SO feet from Crosstown and Sign A is approximately 15-20 feet from the street access. Sundstrom inquired if there was an elevation difference from S=.gn B and the Crosstown. The Planner believed the twe locations would be similar and a ditch exists between. Sundstrom inquired if the sign could be located closer to the building.
