Mr. Dahlgren, Howard Dahlgren & Associates , stated they have meet once with the neighborhood ar.d another time with the Northwest Eden Prairie Steering Committee and are presenting the application from the standpoint of working erith the neighborhood and City in beginning a process towards a solution. Ik then introduced Mr. Jim Dorsey, attorney for the proponent. Mr. Dorsey briefly reviewed the .court suit over the past 2 years and handed-out "FINDINGS OF FACT CONCLUSIONS OF LAW ORDER FOR JUDGEMENT", File No. 719041 , for the Commission's information relative to detailed court happenings and findings. W. Dahlgren stated they believe the land is zoned Planned Unit Development for .:lt#.ple =a :!:ey l:a attz=pting the btst possible use of the land as multiple. Wr. WhISTen then presented slides and diagrams depicting past submissions and 1provals , location of site, gelation :o roadway systems , surroundisig dtvelopom s, topography, unit layout , etc. He stated the present application is for 198 townhouses ( no rental , all to be sold) , with a 400 foot buffer between tie. project and the single faxily to the rest . He stated the Steering Cammittee has suggested the 400 toot buffer be rzasured -from the single family rear lot lives aM they concur Dad have revised the plan to reflect that idea. He added that it has been proposed to the single family lot owners contiguous -to the project that the prWm t is swilling to deed over some land to , approved Planning Comission Minutes -2- Aug. 8, 1977 increase the lot depths, thereby increasing the distance between the project and tha rear lot lines. He stated it seemed acceptable to the residents, but has not been formally agreed upon. Mr. Dahlgren informed the Commission a homeowner's association is envisioned to maintain the units, grounds, 2 tennis courts, pool and possibly the wetlands If the City does not accept dedication of the wetlands. Mr. Dahlgren then outlined the following constructive ideas they received from the Steering Committee: 1. 198 units appears reasonable. 2. Hill should be left intack. 3. No emergency access to Edengate through Tartan Curve. 4. 400 ' buffer should be measured from the single family rear lot lines. S. No objection to the units being placed along the hill. 6. Duch Lake access to project as shown is acceptable, but should be moved further north after construction of the parkway. 7. City should construct parkway. S. Outside materials should be other than 4x8' plywood. 9. Exterior of buildings ' should include fireplaces. 10. Roof colors should be varied. Mr. Dahlgren stated they concur with the 10 points, realizing of course they do not reflect all of the residents feelings. eMr. Dahlgren asked that the item be continued to the Commissions August 22nd meeting allowing the proponent to further work-out details. He added that they are willing to work further with the residents and supply any information they can . Bearman inquired if the City Attorney concurs with the applicant 's interpretation of the judge's findings. The planner replied the City Attorney will be subr+itting aiii opinion. Dennis Flagg , 6820 Park View Lane, asked if any plantings are being proposed. Nr. Dahlgr,&.n replied the project will be landscaped as per City ordinance. Mr.Cook , 6920 Park View Lane, asked how much ts:e units would sell for and what School District they would he in. Mr . Dahlgren replied the units would sell in the aid-$50,0009 and all of the project is within the W nr etonka School District. Mfrs. Fritz , 6960 Ticonderoga Trail, inquired what type of road the proposed Dell Road would be. The planner replied the road has been envisioned to have 100- ' right-of-way with 4 lanes of traffic. Mr. Catt , 18600 Duck Lake Trail , asked if an overlay of the Purgatory Creek area could be seen to vf �w the project' s location relative to the creek and its impact i upon the creek. The planner believed such an overlay could be prepared by the next Meeting. Nr. Kruell , 6780 'tartan Curve, stated more tim would be appreciated so that the neighborhood could be better organized. Dahlgren replied ar. Unvironmental Assessment worksheet would oe 'prepared for the City's approval. Mr. Cole, 7160 Park View Lane, felt a permanent solution to the Uell. Road/Valley View Road intersection should be achieved and inquired about the traffic studies; on Duck Lake Trail. The planner replied a traffic study was conducted in September, 1976, and 1,000 trips were measured ct Duck Lake Trail and TH 101; and 2,000 trips at Duck Lake Trail and Co. Rd. 4. W. Follese, 6800 Park View Lane, stated he feels Duck Lake Trail is an unsafe road and should be improved. Mrs. Nisscn, 6721 Tartan Curve, stated her greatest concern is the traffic on Duck Lake Trail and at the intersection of Thick Lake `Frail / Tartan Curve. . Motion &Edpath moved, Retterath seconded, to continue the public hearing on the PUD Develop- ment Stage request to the August 22nd reeting and direct the City staff and City Attorney to prepare reports, Motion carried unanimously. B. Knoble Addition, Universal Land Corp. , request for rezoning from Rural to R1-13.5 and platting of 14 lots. The site is located east of 168th Avenue on approximately S.5 acres, east of Coachlight Manor. A public hearing. The planner referred the Commission to the brochure, plat , staff reports and revised plat for 13 lots. Mr. Peterson stated the plat was Tevised to meet the concern in the staff report relative to lot size.-now all lots exceed 13,,S00 square feet. He stated the lots are intended to provide for homes in the $60,000 range and he feels the homes will be compatible with the surrounding neighborhood. He did not believe a totlot would be necessary for this small subdivision. Bearman inquired if the proponents are willing tc. meet the conditions w:U'Sa . the Engineering Report asking for soil borings. Peterson replied they will do borings as asked by the City Engineer and believe the soils can be improved for single fasily construction. Mr. Fetei-son stated the project is proposed as R1-13.S as sewer and water are available, whereas Coachlignt Manor was zoned R1-22 because at the time of its approval no sewer and water were available. Mr. Blunt, 6501 168th Avenue, stated he has no desire to subdivide and he had understood the area around them would remain 5 acre tracts. Mr. * Baker , 6940 North Manor Road, felt a need exists in the neighborhood for a play area. Mr. Peterson stated he does not believe the City desires having a small totlot to maintain in this area c;id instead the lots would be subject to the park cash fee in order to purchase a neighborhood park of greater scale. Steve Schultz, 6490 168th Avenue, felt the lots proposed would compound the street problems presently existing on 168th Avenue. Mr. Roeder stated if he had known the 5 acre tract could be subdivided he wculd have tried to purchase it. Peterson requested the item be continued to allow him time to reevaluate the plat. Mr. Moot, 6591 168th Avenue, believed soil borings would shcw that the property is unbuildable. Peterson replied, hued on their experience, the site is developable. Motion Bearman moved, McCulloch seconded, to continue the Knoble Addition plat to the August 22nd meeting to allow the proponents to reevaluate the plat. Motion carried unanimous ly. C. Olympic Hills 3rd $ 4th Additions, Phase 4, request by Olympic hills Corp. , to rezone and plat 32 lots from Rural to R1-13.5. The sites are located north of the northwest co':mer of Franlo Ruad and Pioneer Trail. Bruce Knutson, Bruce Knutson Architer.ts, presented the plats for Olympic Hills 3rd and 4th Additions south of the golf course stating they meet the requirements of the R1-13.S District and all will be for single fmily homes. Sundstrom asked if any protection against golf balls striking vehicles or individuals using the street to reach lots 1 and 2 will be proposed. Knutston replied negative. The planner stated the staff has concerns regarding tee, fairway and green locations in relation to the proposed lots as liability problems would be encountered if someone is injured on a public street. He stated such concerns will be outlined' in the staff report. Mr. Don McGlynn, Olympic Hills Corporation, stated based upon their experience with golf courses, the distances from the lot lines and the course are adequate, but if necessary perhaps the street to lots 1 and 2 could be private, not public. Pon Hess, The Preserve, stated they have reviewed the staff rev_ ort and concur 3 wi Cis the recommendations of the report. Retterath questioned the reasoning behind the "modern"light fixtures , as they f are not similar to other light fixtures within The Preserve. Mr. Hess replied the fixtures proposed give "down lighting" as requested by some residents. � Retteratn suggested The Preserve investigate other "dawn light" f;.xtures that would be ' more compatible with existing fixtures. Hess stated he would investigate alternatives. Motion x N Lynch moved, Rcdpath seconded, to apprcve the Poolside Apartment site and lighting and landscaping plans as per the staff report dated August 4, 1977. Motion carried tmanimous ly. V. REPORTS AND RECOMMENDATIONS A. Garrison Forest 2nd Addition, the Preserve, request to rezone from Rural to R1-13.5 and preliminary plat 43 lots on approximately 25 acres . The site is located west of Co. Rd. 18 and South of Amsden Road. A continued public hearing. Mr. Hess presented the revised plat dated 8/8/77 outlining lots 4-7 as possible double lots and the 3 lots within the play whi.�l; would become unbuildable if the southern parkway alignment is chosen, thereby constituting a taking. McCulloch questioned why the proponent believes the snh,tildability of 3 lots in a } 1 proposed preliminary plat would be considered a taking when there is rio existing approval. Hess felt the southern parkway alignment is inconsistent with the standard 50:50 RON split. � Sundstrom rescinded Hess of the Commission's action on Ansden Hi?is 2nd at their previous meeting, with the specific parkway alignment to the north and the continuation of Garrison Forest 2nd to allow the proponent time to redesign the p!at accordingly. The planner informed the Commission the utilities and streets are already in place in Garrison Forest 2nd. McCulloch believed existing utilities ' and streets Are the developer's problems. ; Lynch expressed concern over the future rroposed commercial/multiple at the Co. Rd. l8 intersection as incoming residents may not be nails: aware of i.twhen purchasing their homes. The planner stated the staff is recommending denial of the project as it contains unbuildable lots, the commercial/multiple request is not sufficiently defined and the Co. Rd, la interchange is u.,known at this time. Motion 1: McCulloch moved, Bearman seconded, to close the public hearing on the Garrison Forest 2nd Addition preliminary plat. [notion carried unanimously. Motion 2: McCulloch noved,Bearnan seconded, to recommend to the City Council denial of the request of rezoning from Rural to R1-13.S for Garrison Forest 2nd for the reasons stated at the Commission's July 2S, 2977 meeting and because of the 3 unbuildable lots within the proposed plat.
