plat approval for 142 lots . A continued public hearing .
Chairman Sundstrom briefed the audience on the public hearing
process .
The planner reviewed the revised plat of 142 lots ( original 146 lots ),
He believed the traffic on Duck Lake Trail could become a significant
problem as it may become overloaded . He stated the staff is recommending
approval of the rezoning and platting of the sin ale family and believes
the community commercial makes sense for the future as this area of
the community would benefit from a neighborhood convenience store . �
Denni-s Griswold , Griswold & Associates , project designer, stated the
lots have been increased to an average lot size of 14 , 177 and no lots
are under 10 , 000 square feet .
Bearman inquired if the proponents are still requesting commercial
zoning . sir. Griswold replied affirmative stating the specifics of the
commercial are still unknown .

Bearman inquired if Valley View Road ' s improvement would be completed
by the completion time -�f the single family lots . The planner was unsure .
Sundstrom inquired as to the capacity of Duck Lake Trail . The planner
replied the City Engineer ' s estimate of two years ago is 2 , 000 trips .
Lynch arrived .
Bearman asked when the project would be completed . Mrs . Irvine esti -
mated 3- 5 years .

Radpith informed the audience that the road systems of Dell Road
and Valley View have been depicted on the City ' s Guide Plan map
since 1968.
Bill Karl , . 7286 Tartan Curve , felt the natural environment is being
destroyed by the road extensions and small single family lots .
Bob Cole , 7160 Park View Lane , asked where Dell Read would go beyond
Valley View Road . The planner replied it is planned to connect with
T. H. 101 or T . H. S .
Jerry Catt , 18600 Duck Lake Trail , expressed concern about the density
that may occur if the Edengate project is constructed along with numerous
single family lots . The planner responded that a large amount of develop-
able land still exists in the northwest corner of the City and this pro-
ject is compatible with existing single family . He also stated that
the Judge ' s decision on the Fdengate project is that the City should
review the application of March , 1976 if -resubmitted .
Frank Marquette , 18340 Ginavale Lane , stated all lots were . S acre
when he bought his hcme and he believes smaller lots than . S acres
ara undesirable . He stated the City should not accept variances from
the ordinance .
Marilyn Catt asked what would be done withthe petition submitted ,
Chairman Sundstrom stated the Commission would review the petition ,
forward it to the City Council and file it at the City Hall .
Bob Maxwell , 7269 Tartan Curve , asked if the commercial site is zoned .
The planner replied the site is presently zoned Rural.
Mrs . Irvine informed the Commission the Parks , Recreation and Natural
Resources Commission reviewed the project and has recommended i270/ lot
cash in lieu of land.
Mr. Romoss , 7138 Ticonderoga Trail , stated there are no shortages of lots
for single family construction in the northwest corner of the City and
the traffic that additional lots will bring will be detrimental .
Motion 1 :
Bearman moved, Retterath seconded , to close the public hearing on the
ldaple Leaf Acres Third Addition . Motion carried unanimously.
Motion 2 :
B ae rman moved , Retterath seconded , to recomat-A PilD Concept approval of
the Maple Leaf Acres Third Addition for single family residential leaving
aside that area shown commercial on the site plan dated 7-6-77 to be
reviewed at later date . Motion .carried unanimously. \
Notion 3 :

Leaf Acres Third Addition from Rural to RI - 13 . S with no variances from

Discussion :
Redpath Redpath inquired if no variances was to become a policy .
Dearman responded that 32% variance is too much .
Retterath asked if the mover intended to exclude commercial zoning .
Bearman replied affirmative .
Sundstron stated he agreed with the intent of the motion but feels

Lynch stated he felt it was a poor time to surprise the developer .
Bearman felt the Commission in the past has voiced - concern on variances .
Vote on Notion 3 :
Motion failed with 1 aye (Bearman) and 4 nays .
Notion 4
Redpath moved , Lyncl seconded , to recommend rezoning from Rural to
RI- 13. 5 for Maple Leaf Acres Third Addition based on the 7 -6-77 plan
excluding the commercial request . Motion carried 4 1 with
Bearman voting nay because of the 32% of lots being under 13 . 5 .
Motion 5 :
Redpathmoved, Retterath seconded, to recommend approval of the Maple Leaf
Acres 1 ird Addition preliminary plat based on the 7/6/77 plan, as per
the staff report dated June 9, 1977, with lot size variances only , having
the specific commercial use to be returned for review. Motion was defeated ;
2 ayes and 3 nays ( Bearman, Sundstrom and Retterath) .
B. Round Lake Estates 2nd Addition , by Eliason Builders , request
to preliminary plat 37 lots for single family development .

The planner identified the area and stated the request is a rep= at
of a previous preliminary plat with reduction in the number of lots
and wit}l larger lot sizes . The planner informed she commission the i
Round Lake approval in 1972 stated that another access should be
provided primer to completion of the development .

Mr. Eliason stated the prelipinary plat request generally conforms
with the 1972 plat approval .
Bearman inquired what the overall density woult be . Mr. Eliason
replied slightly less than 1 . 8 units/acre .
Lynch asked if the staff would be preparing a report . The planner
reppo:ded t':c staff is awaiting further material to be submitted by
the proponent as outlined in the Platting Procedures .
Mr. Bernhard Stoeber Jr. , 7661 Atherton way , read the following

Mr . Stoeber then expressed concern over the traffic safety if addi -
tional lots are built plus the difficulty of emergency vehicles
entering the addition if the only access is blocked . He stated
another access should be provided before additional homes are built .
Ken Geason , 7621 Atherton Way , stated it is very difficult to get
onto TH S . anytime of the day and extremely dangerous .
Motion
Bearman moved , Redpa,:h seconded , to continue the public hearing to
the July 25th meeting and direct the staff to prepare a report with
special consideration given to the traffic problems . Motion carried
unanimously .
C. Garrison Forest2nd Addition , The Preserve , request to rezone
from Rural to R1 - 13 . 5 and preliminary plat approval for 43 lots
on approximately 25 acres . The site . is located West of Co . Rd .
18 and South of Amsden Road . A continued public hearing .
D. Amsden Hills 2nd Addition , The Preserve , request to rezone from
Rural to R1 - 13 . 5 and preliminary plat approval for 33 lots on
approximately 15 acres . The site is located West of proposed
Garrison Forest 2nd .addition and South of Amsden Road . A
continued public hearing .
Garrison Forest 2nd and Amsden Hills 2nd were considered jointly .
The planner referred the commission to the staff report dated 7/ 7/ 77
and stated the staff is recommending approval based upon modifications
oultined in the report .
Don Hess , The Preserve , disagreed with the varied setbacks recommended
in both staff reports ; as previously fireplaces and overhangs were
not considered to be encroachments . He stated they would be willing
to construct the path along the north/south street alone , not both
the north/south street path and the green space path between the two
projects .
Liz Retterath asked how many lots are below 13 , 500 square feet . Hess
replied he was unsure but the density average is 2 . 2 units/acre .
Marty .lessen , Director of Community Services , outlined the parkway
alternatives and the ownership of property involved . Under The Preserve
proposal 1 . 78 acres of road would come from parkland and 3 . 13 acres
of road from The Preserve . He stated he would not recommend asking
that parkland purchased with federal and metro funds be converted
for road purposes . If it is requested , he stated replacement land
would have to be traded (no replacement lard available within park
boundary in his opinion) , or the City would have to reimburse the
grants for the value of land removed .
Lynch inquired how long it would take to receive an indication from
the government bodies . Jessen estimated 3- 4 weeks .

ABearman stated he would like to have an Engineer ' s report- prior to
taking action on the projects as the parkway location is important .
Hess stated The Preserve ' s location preserves more trees and slopes

Sundstrom asked if Mr . Jessen felt this an arbitrary taking •ofland
for road purposes . Mr . Jessen felt any road taking is of concern
to the Federal Agencies .
Bearman and Redpath expressed concern on taking action unless the
exact road location is . known and an Engineer ' s report is prepared .
Sundstrom asked if the staff has cost studies on the two alternatives . 1
The planner stated soil borings have been asked for , but not yet
received .
Motion :
Redpath moved , Bearman seconded , to continue the public hearings on f
Amsden hills 2nd Addition and Garrison Forest 2nd Addition to the
July 25th meeting for additional reports .
Discussion
Hess asked to present plans for Outlot D . He stated they believe
community commercial uses can be distributed throughout The Preserve
and not localized in the Preserve Center as in the original approval .
The planner did not believe a small scale community commercial

store would remain small if located near such a major interchange
and that the use would slot be a : suitable use near an entrance to
The Preserve .
Vote : Notion carried unanimously .
