Motion carried unanimously. H. MINUTES OF TIE MAY 9, 1977 MEETING Schee moved, Lynch seconded, to approve the minutes at submitted. Motion carried 4:0:1 with Redpath abstaining. III. MEMBERS REPORTS A. Chairman Sundstrom-none B. Others-none IV. REPORTS AND RECOK4ENDATIONS A. Walnut Addition, by Dirlam Properties, request for rezoning from R1-22 to RI-13.5 sand preliminary plat approval for 18 lots on approximately 8 acres. The site is located in the northeast corner of Co. Rd. 4 and Valley-View SRoad. A public hearing. Mr. Leo Stern, Attorney for Mr. Dirlam, stated the plat has been revised down to 17 lots as requested by the City staff and the zoning requested is for RI-13.5 . Sundstrom inquired if the developer would be constructing the berm along Co. Rd. 4 . Mr. Stern replied the property is heavily wooded and perhaps covenants can outline the necessary berming and landscaping to be done by the developer along Co. Rd. 4 . Mr. Harold Marquardt, 16301 Valley View Road, stated the adjacent property owners had received a letter from W% Dirlam stating no multiple is being requested. He asked if the holding pond near Valley View Road would still be in use. The planner stated the pond will be temporary until curb and gutter are in. Mr. Marquardt asked for the distance from the Valley View Road/Co. Rd. 4 intersection to the entrance of the project . The planner estimated the distance to be 265 feet . Mr. Gordon Carlson, 7352 Franklin Circle, inquired if the grading at the north end of the project would still drain water towards Mr. Berne's property. The planner stated th.; City Engineer has reviewed the drainage and it is assumed some drainage from back lots will still drain to the north but the majority of drainage would be to the street. Mr. Carlson stated he appreciates the City C.ouncil 's and Mr. Dirlam's efforts as he feels the neighbors' concerns have been met. Motion 1 :Schee moved, Redpath seconded, to close the public hearing on the Walnut Addition preliminary plat. Motion 3 : Schee moved, Redpath seconded, to recommend to the City Council approval of the preliminary .plat for Walnut Addition as per the May 19, 1977 plat , the staff report of May 16, 1977 and Engineer' s report of May 18, 1977. Motion carried unanimously. B. Bermel/Smaby Rezoning, request for rezoning from Rural to Office for approximately 1 acre at 8110 Eden Road. The plminer located the 1 acre site within the Major Center Area which has been conceptually approved for commercial/office uses in the MCA Report. He stated the staff is recommending approval of the request . Mr. Bermel , Executive Vice President. of Bermel Smaby, outlined the site' s rela- tionship with adjoining properties through overlays and slides. He stated they intend 'to fill the southern h of the site ( maximum of 18' fill) ,relocate the driveway further south, provide parking for 18 cars mild landscape the parking lot and building. He informed the Commission they desire a "V"shaped sign approximately 80square feet in size with exposure :.o US 169, (material not submitted) . - Redpath inquired if the %ity had transitional use procedures or an ordinance by • which to review the request, or if the only option is to "snot" zone 1 acre. q � Y P The planner stated agreements have been entered into between the City and proponent in similar cases without zoning approval grar_ted. The planner added that the staff believes office use on this site appears to be a legitimate long-term use. Lynch inquired if the house to the north was vacant . Mr. Bermel stated the house is occupied and he has personally spoken to the residents relative to their plans. Schee asked what uses Bermel/Smaby foresees for their remaining acreage. Bermel stated he is unsure at this point in time. Lynch asked if a fast food use could locate on a 1 acre office site. The plane: replied negative. Sundstrom asked if the council is reviewing a transitional ordinance. The planner replied such an ordinance would be difficult to formulate prior to the Guide Plan update and hopefully will be completed along with the update. Schee asked if the planing staff feels a staff report is required on the request. The planner stated the believes the Commission can act upon the submitted material as it is straight forward. Lynch felt the zoning of 1 acre at a time can result in negative encroachments to existing single family He would prefer an agreement with a time limit . Mr. Bermel replied that the residents along Eden Road have been aware of the future 0higher use of their properties since 1970. He did not feel this office zoning would diminish the value of the other homes. Discussion: Bermel asked if the Commission is including approval of their signage request . Schee replied negative. Redpath empathtically requested the Council to proceed on adopting a Transition Ordinance. Vote: Motion carried 4 :1 with Lynch voting nay because he believed it would be spot zoning and not in the best interest go t he residential neighbors. C. Condor Corporation, request to rezone from Rural to I-2 Park approximately 5 acre-s for office/warehouse use. The site j s located 433 feet west of Washington Avenue and 2,100 feet south of Valley View Road. Mr. .Jim Riley, Condor Corporation, stated the 400 feet fronting onto Washington Avenue is zoned I-2 Park and they desire having an additional 365 feet zoned I-2 Park so the existing buildings can be enlarged to the west and more parking can be added. He stated they will be working out det�.iled grading and _utility plans with the Engineering Department . The planner stated the request is consistent with the Smetana Lake Report and the staff is recommending approval contingent upon street right-of-way dedication on the entire north side of the property owned by Condor. Schee remarked the staff report had to make some assumptions because insufficient material was submitted. She believed the staff and C ommission should require that all material included in the Draft PUP, Platting and Zoning Procedures be submitted with land development applications. 1 .1e planner stated the staff does prefer having all the material submitted but the - procedures are not yet adopted. Motion: Schee moved, Lynch seconded, to recommend to the City Council approval of Condor Corporation's rezoning request from Rural to I-2 Park for office/warehouse use on approximately 5 acres to include the recommendations of the staff report dated May 19, 1977 and to require the grading plans and architectural drawings be sub- mitted and agreeable to staff. Motion carried unanimously. Motion: Schee moved, Redpath seconded, to instruct the Eden Prairie planning staff not to process any land development applications which do not address all items contained in the Draft PUD, Platting and Zoning Procedures. Rieman Road Vacation, located in Edem,ale Industrial Park 2nd Addition. Mr. Peterson stated the industrial park was approved 2 years ago for small light industrial uses. He stated the uses do not require Rieman Road and he has 100% petition of the users to vacate Rieman Road. The planner informed the commission the vacation could leave some of the lets with no access to a public street. He stated the City Engineer and he are y recommending vacation of the street and a replat of the lots to insure all have frontage onto a public street . Mr. Peterson replied the staff' s suggestion is acceptable. i a Motion: Redpath moved, Retterath seconded, to recommend approval of the Rieman Road vacation contingent upon the proponent filing a new plat by June 13, 1977. Motion carried unanimously. E. Minnesota Protective Life, request for approval of signage program. The planner informed the commission the council in their approval of the MPL Office rezoning did require that the signage plan be presented and approved by the Planning Commission. The planner outlined the request as 1 ground panel sign, (41x201) and 1 building sign of 99 square feet. He added that MPL may be requesting twu � lai-- tional signs in the future , one a possible bank sign and the other an entrance sign. Schee inquired what materials would be used on the ground panel . Mr. Rock, Federal Sign Company, replied it would be block with stucco, and aluminum letters . Lynch asked if the signs requested were consistent with the draft sign ordinance. The planner replied affirmative. Notion : Schee moved, Redpath seconded, to recommend approval of the NPL Sign program as follows : 1 building sign of 99 square fact, 1 entrance ground panel 4' x 20 ' as per the -May 4 , 1977 submission. Motion carried unanimously. F. Minneapolis Floral CMany, request to purchase Lot 16, Westgate Addition, and dedicate a portion or all to the city for road access. The planner stated the road access proposed is consistent with the 4/S Study adopted rs a reference document and the staff is recommending approval. W. Hedlund, Ninneapolis Floral Co. , stated he has walked the site with the City Eagineer and the Engineer concurs with this lot for road access as the lot to the north is in very poor soils. Lynch inquired if Fuller Road aligns to Westgate Boulevard. The planner replied negative. Motion: Lynch moved, Redpath seconded, to recommend approval of Lot 16, Westgate Addition, street dedication as proposed by Minneapolis Floral and according to the iingineer's ammo dared May 192 1577. Motion carried unanimously. Y R approved Planning Commission -S- May 23, 1977 V. PETITIONS AND REQUESTS PUBLIC HE:MGS: A. Outlot F, £denvale Industrial Park 2nd Addition, request to rezone from I-General to I-2 Park and platting of the existing 3 lots into S lots. ,r The planner reported the original zoning was granted but no ordinance was ever p drafted, therefore the City Attorney, Engineer and himself will be meeting to determine the property's present zoning and to draft a staff report. Mr. Peterson stated the platting recpiest is in response to the demand for small - industrial lots. He added that he will be .requesting setback variances and will be submitting such request to the staff for their review. • Motion: Redpath moved, Schee seconded, to continue the Outlot- F public hearing to the June 13th meeting and --efer the item to the staff and City Attorney for a staff report. Motion carried unanimously. B. Highpoint 4th AdditiM, The. Preserve, request to rezone from RM 2.S to R1-13.5 and preliminary plat 36 lots on approximately 17 acres. The site is located west of Co. Rd. 18 and South of Amsden Road. Mr. Hcys, The Preserve, presented Highpoint 4th and the following two items concurrently. C. Garrison Forest 2nd Addition, The Preserve, request to rezone from Rural to R..-13. 5 and preliminary plat 43 lots on approximately 2S acres. The site is located west of Co. Rd . 18 and south of Amsden Road. D. Amsden Hill% 2nd Addition, The Preserve, request to rezone from Rural to RI -13. 5 and preiini• gry plat approval for 33 lots on approximately 1S acres . The site is located west of proposed Garrison Forest 2nd Addition and South of Amsden Road. [fir. Hess :,tated the Highpoint 4th site was previously approved -for the Trails Townhouses, but instead of constructing the iS4 townhouses, they are requesting rezoning to RA-13.5 for 36 single family lots. He outlined the site's location and stated the outlet %Jjacent to Olympic Hills Golf Course would be dedicated to the homeowner's association. W. Hess informed the 'Commission Garrison Forest and part of Amsden Niiis 2nd are not within the Preserve's PUD boundary and they would be agreeable to a park fee for Pimsden Hills 2nd similar to that required .for Garrison Forest . W. Hess said they are unsure at this time what exact commercial and multiple uses will be proposed at the southwest corner of Co. Rd . 16 and Amsden Road, but they will be dedicating the necessary road right-of-way. He then outlined the County Highway' s preliminary draft plans for a interchange at Cb. Rd. 18 and Amsden Road. Ross stated another project (Ar ien Hills Ud Addition) may be proposed yet this year if additional single family lots are needed. He informed the Commission tbey are regretting the standard setback variances for all three projects. Sundstrom inquired if any member in the audience had questions or comments on any of the three projects. None were raised. Notion Redpath moved, Schee seconded, to continue the public hearing on Highpoint 4th Add;tion to the June 13 meeting contingent upon the developer submitting to the staff the r_ecesaary information requested in the Draft Land Development procedures. Notion carried unanimously. Cash Park Fee, Discussion The planner referred the commission to the memo dated Apr. 29, 1977 which outlines The Preserve's , Edenvale' s and Hidden Ponds ' park/open space commitments . The Commission, planner and Mr. Hess, The Preserve, briefly discussed the differences between private and public areas, their use, park fees vs. land dedication, etc. VI I I. PLANNER'S REPORT 1 . The planner reported the City is expecting to receive a letter from Pillsbury relative to their decision not to locate in the C ity. IX.
