Motion : Schee moved, Bearman seconded, to approve the minutes as submitted and corrected. Motion carried unanimously. III . MEMBERS REPORTS A. Chairman Sundstrom 1 . Sundstrom reported he attended the council meeting regarding the Bluff' s proposal. He asked the planner to outline the council 's action. The planer informed the commission the Council approved the EAW and authorized its publication and distribution. Also they approved the concept and asked the city attorney to draft the agreement prior to other approvals. 2. Sundstrom reported he had not conveyed the conmission's concerns to the council at the last meeting but would be de g so in the future. B. Norma Schee 1 . Schee inquired if the council discussed the coanxssion ' s stand on reviewing Pillsbury' s site plan. Sundstrom stated he was unsure. Bearman Bearman inquired if the council approved the ordinance rezoning Helle'S property. The planner replied negative. IV. RESORTS AND RECOMMENDATIONS A. Country Kitchen / Mobil Station, by CEDO Builders, request for PUD Concept arid' Development Stage approval for the construction of a restaurant/station combination on 1. 7 acres at 80SO Flying Cloud Drive with variances. The planner referred the commission to the staff report completed that evening and stated the council has a public hearing set for May 17th. Jesse Schwartz Jr. , W. Gordan Smith Company, outlined the changes to the plan as : greater setbacks provided, less parking on the east side and improved access to the site. He stated their sign request is 1 sign on the east side for Mobil , a small price sign on the west side, a Country Kitchen pylon along US 169 and retention of i tSv'x- 1. �-d Planning Commission Minutes Max. 9 , 15-- the Flying Red gorse as a roof sign . He esti:ated the total square footage of the signs to be less than 100 square feet . Due to the hardship of developing the site he stated variances are being requested from city ordinances. Schee asked if the site parking plan was excessive. The planner replied the number of spaces proposed is in response to Country Kitchen's standards and are in excess of city minimums. Dave Gustafson, Country Kitchen International , stated the restaurant would not locate on t'-is site if the proposed parking spaces are reduced as spaces are also needed for employees and storage of station i cars . Schee suggested that the spaces for employees and storage be o tlined and located on the eastern side of the site therzfore minimizing possible customer traffic conflicts with in-out traffic. 1 Schee stated she personally feels the Pegasus sign should remain as part of the site. Bearman inquired if the request and variances cmld have been handled by the Board of Appeals and Adjustments . The planner responded that avenue was dis- cussed , but it was the staff' - advice, and the applicant agreed , to pursue the PUD route with variances and have the commission make a recommendation to the council . Lynch stated he believes the site is unique and that the parking and signage problems can be dealt with. He added the site is presently in violation, of city ordinances and the proposed plan is an improve.uent . McCulloch felt the variances being requested are major not minor. j Sundstrom inquired how many employee and storage spaces would be needed. Jesse Schwartz Jr. , estimated the station would need 3-4 spaces. Gustafson estimated the restaurant would require 6-8 spaces_ Sundstrom asked if the applicants had contacted Homart in reference to pedestrian circulation. Mr. Schwartz Jr. , replied he has contacted Homart f Mr. Sahli ) , and no agreement was reached as problems of liability and cost are involved. He pre- ferred the city install a walk along US 169. The plaimer stated the staff is recommending a pedestrian walkway from :he NPL site through the Titers property to the Country Kitchen/Mobil site and access from the EP Center to the site. Mr. Schwartz Jr. , stated such a walkway would be important to their use, but they do not desire to be tied to an exact location now. Bearman inquired if the signs could be combined. W. Gustafson stated it may be possible but they do not feel they would be as attractive as the proposed plan. Mr. Schwartz Jr. , stated they would attempt to meet the Sign Ordinance rapirements. `1 Planning Commission 'Minutes -3- May 9, 1977 Motion: Schee moved, Lynch seconded, to recommend approval of the revised site plan for PUD Concept and Development Stage approval for the Country restaurant combination contingent --- -� -%-- ..•..rr -----art dated May 9th the revised site plan , and request Country Kitchen/me—bil to outline the parking spaces adjacent to the eastern entrance to US 169 as employee parking amid/or storage not available to customers and to limit the Country Kitchen sign to 80 square feet. Discussion : . Sundstrom stated he would like to see an attempt for joint parking between the site in question and Homart. Bearman stated the benefits of having a transi•L'ion ordinance and a MCA ordinance are again evident and would be appreciated as quickly as possible in reviewing requests as this. Vote: Motion carried 4 :2 with Bearman and McCulloch voting nay. Bearman voted nay based upon concerns expressed during the meeting. McCulloch voted nay because he believes , as stated by the applicant , the site is too small for the uses proposed. B. Guide Plan Update. Item moved to end of Petitions and Requests. V. PETITIONS AND REQUESTS A. Hipps Mitchell Heights Third Addition, request for preliminary plat approval for Outlot A Mitchell Heights Addition and Outlot E Mitchell Heights 2nd Addition for 32 duplexes on It lots . The site is located on 7.8 acres west of Mitchell Road and last and north of Tamarack Trail . A public hearing. Mr. Doug Goriesky . engineer, outlined the location of the plat and stated minor diffie-ulties have been encountered in utility service because the lots are very deep. tie stated the city staff is recommendi»g a common space in the center and a water- main loon through the project. ;'he planner referred the commission to the May 3rd staff report outlining the staff's concerns of the need for a trail system along Tamarack Trail and Mitchell and a common oper, space it, the center of the plat . Lynch asked who would manage the common space. The planner believed a volunteer homeowner's association or some other arrangemetit could be investigated. Mr. Goriesky agreed with the planner and asked the cot:aaission to approve the plat and allow the proponent. and staff to work out the common space management prior to council review. Bearman inquired if the lots meet the minimum front setback of 90' in RM 6. 5 Districts. The plar_ner replied each unit is 4S' back making two units a total of 901 , therefore meeting the ordinance. F.carman asked if individuals would be able to 1my single units or double grits and if legal problems are anticipated. None were raised. Motion 1 Lynch moved, Bearman seconded, to close the public hearing on the Mitchell Heights Third Addition preliminary plat Motion tarried unanimously, _Motion 2 : Lynch moved, Bearman seconded, to recommend approval of the Hipps Mitchell Heights Third Addition preliminary plat contingent on the May 3 , 1977 staff report and: a. That the developer consider an alternative that allows the center of the proposed site to be used for a common open area. That a trail sy3tem be provided along Tamarack Trail or the rear lot area; and Mitchell Road. These trails could be constructed much like a sidewalk either concrete or asphalt . c. Thatthe plat be contingent upon the Engineer's report of • May 5, 1977. d. Insure that the open space delineation does not bring any of the lots below the district minimum. Vhte:.%otion carried unanimously. B. Bermel Smaby Realty Inc. , request to rezone from Rural to Office a}proximately 1 acre at 8110 Eden Road. The planner requested r ` p er stated the 1 acre property being r..que_ _.ed for rezoning is presently a single family home and detailed plans would be submitted prior to the next tweeting. Mr. Bruce Bermel stated they are requesting utiliziation of the site for an office for 3-6 years, they intend to paint the structure, provide 12-14 parking spaces and landscape the site. He stated in the future they plan to move the structure and construct a new building. Lynch inquired if notices to adjoining properties had beer mailed. The planning staff responded affirmative. Mr. Bermel stated he has also personally contacted some of the owners. Motion : McCulloch moved, Bearman seconded, to refer the item to the staff for a ieport , Motion carried unanimously. Chairman Sundstrom suggested the staff investigate the avenue ofan agreement vs. spot zoning for this request. C. Condor Rezoning. request to rezone from Rural to 1 -2 Park approxims-tt ply nacres for office/warehouse use The site is located 433 feet west of Washington Avenue and 2,100 feet south of Valley View Road. -The planner located the site within the Smetana Lake Sector. Mr. Riley, Condor, stated the 400 feet fronting onto Washington Avenue is zoned I-2 Park and they are requesting the area behind the lots be zoned to 1-2 Park in order to construct additions. He stated adequate setbacks will be provided for the future road alignment on the north side . of the site. r approved Planning Colranlssion Minutes -5- May 9 , 1977 Sundstrom inquired how close this site is to the future road alignment . The planner estimated 300 feet. Mr. Helle, 6138 Arctic Nay, interjected the dis- tance is 306 feet. Motion : Schee moved, Retterath seconded, to refer the item to staff for a report. Motion carried unanimously. IV. REPORrS AND RECOMMENDATIONS B. Guide P.'.an Update Mr. T)on Brauer informed the commission the Guide Plan Workbook is now available and as new sections are completed they will be mailed out to the individuals who have the Workbooks. He stated he would prefer a city wide meeting this summer prior to commencing with sects.: meetings. Bearman inquired what percentage of the city participated in the guide plan process. Mr. Brauer estimated 9% which is a good percentage for the city's size. He added that the individuals who did participate represented a good cross section of the city which is more important than a high percentage . Sundstrom inquired if the Goals and Objectives Section reflected the responses of the individuals attending. Brauer replied the Goals and Objectives were developed by the r1a.nning team. The planner asked that the commission feel free to contact Mr. Brauer or himself with any questions or comments. VI . OLD BUSINESS Lynch excused from meeting. 1 . Mr3. Retterath asked if the staff is. compiling background information packets. Sundstrom responded that he will be meeting with the staff relative to that item . 2 . Procedures for public hearings . The commission made some minor changes and .asked to have the redraft on the next agenda for approval and signature of the chairman. 3. Schee inquired if the commission could receive a copy of the city' s park classification system and definitions . The planner stated he would ask the Park and Recreation Department to submit material to the commission. VJI . NEW BUSINESS None VIII. PLANNER'S REPORT None IX.
