In Pauly' s absence, the planner reported the city attorney is redrafting
the Planning 6 Zoning Coamission _Ordinane. And the draft will be d; -tributed
for the cwmission's review.
Sorensen suggested the eomaeission also review the board of Appeals and
Adjustr..ents Ordinance as the Flaiiniag S Zoning Commission has the right
to review and commey�t on actions of the Board of Appeals and Adjustments .

2. Lynch inquired if the commission would like to try the council 's present
system of adjourning meetings at 11 :30 P11 unless a motion is passed
unanimously to go beyond that time.
Motion:
Lynch moved, Sundstrom seconded, to adjourn all Planning & Zoning Commission
meetings at 11 :30 PM unless a motion is passed unanimously to go beyond that
time.
Discussion:
Bearman felt it may be difficult to stop an item right at 11 :30 PM.
11,.a planner stated the council does finish the ite: they are on, and then votes
on whether to continue with further items on the agenda or to adjourn .
Sorensen opposed the 11 :30 PM adjournment because:
1. The commission has an obligation and duty to handle all items on
the agenda. Notices are mailed prior to meetings and if indivi-
duals stay through the meeting for an item it would be unfair to
adjourn and require them to return another date.
2. No reasonable way to achieve the intent of the motion unless
there is more flexibility.
3. If the commission has an arbitrary cut off time then the audience
may receive the impression that the items are handled arbitrarily.
Lynch felt the commission should attempt to finish agendas by 11 :30 PM-and
he would be Milling to attend council meetings to see how the adjournment =
at 11 :30 works for the council .
Vote: The motion f3: led 2:3 with Fosnocht and Lynch voting aye.
Soa-ensen directed the staff to prepare procedures in order to achieve the motion 's
intent.

A. Miley Sprinkler System, Co. Rd. I/ US 169
The planner reported the agenda and staff report. was mailed Friday A.M. to the
landowners and the staff_ had not had a, opportunity to meet with the landowners .
The planner reviewed the report and the reconimendat i ons of:
1 . designate the study area as an industrial/multiple PUD,and
2. rezoning of the Miley Sprinkler site to 1-2 Nark.
Bearman inquired as to the status of the US 169/Co. Rd. 1 intersection
ijr.15'rovements . The planner replied a county improvement contract J. square
intersection and signals, is expected to be let in 1978 with completion -
expected late 1978.
Sundstrom, referring to page 9, asked how the noise influence line was drawn
and if the line would be compatible with future residential development .
The planner stated the line was a determination from footprints , as depicted
in the MAC report or, Flying Cloud Airport. The drop in elevation and the
distance from the airport determined the area of reduced impact. -

Mr. Kortz, 13420 Picr_eer 'trail , inquired when the $SO/acre charge would be
due .' The planner responded that if the amount , or some other amount , is
approved by the council, then it would be payable at the time of site development .
Sorensen , referring to Figure 1, suggested the city staff investigate if any
county deed restrictions still exist at the northwest corner of the intersection.
Sorensen asked why the staff is suggesting -Miley use a holding tank while other
uses wait for city sewer and water. The planner stated the Miley use will be a
low sewer user and that the other uses are not anticipated for some time and
can be dealt with at the time of application.
Sorensen questioned if the proposed multiple land could be used for single family.
The planner believed because of the site's proximity to future industrial and the
noise of the airport, the site would be inappropriate for single family. He also
believed it would be difficult to place lots on the slopes and would require an
expensive street system to serve a limited number of lots.
Sorensen then asked if Mr. Gjertsen would be dedicating the hill and slope area.
The planner stated he was unsure whether it would be dedicated or if the proponent
would pay the cash in lieu, of land fee.
Mr. Bcarman asked if the staff had received any l.ur_dow-nerr input . The staff replied
negative.

Motion 1 :
Beamman moved, Lynch seconded . to recommend approval of the Co. Rd. 1/US 169 Planned
Unit Development for approximately 25 acres as outlined in the staff report dated
1-19-77.
Discussion:
Sunustrom suggested including an alternative to the multiple shown .
Beamman felt if no residential type is recommended, the owners would have no
assurances.
Amendment :
Sorensen moved, Sundstrom seconded , that the recommendation for pud approval is
made with deletion of specific type of residential usz on the northern portion of
the pud leaving it to the future developer to determine which residential use
he feels appropriate.
Motion Amendment : The motion amendment carried 4 :0 :1 with Lynch abstaining.

Motion 2 :
Beaman moved, Sundstrom seconded, to recommend rezoning of the approximate 2 acre
Miley Sprinkler site from Rural to 1-2 Park as first phase implementation of the
US 169/Co. Rd. 1 PUP as per the staff report dated 1 -19-77 .
Discussion: Beamman suggested the staff underline the first sentence in the 2nd T
under "G. Utility Schematic", page 11, assuring the understanding that Miley's site
mould be the only use to have a holding tank.

The planner referred the commission to the staff report and stated it contains
4 alternatives, but the staff does not yet have a recommendation as they are

The planner informed the commission Mr. Moe, representing Kamstra Communications
Inc. , owner of 6 acres in the southeast corner of 4/5, desires retaining the
property' s commercial zoning and will be submitting additional comments.
Mr. Red path, 16308 Lincoln Lane emphasized the need for an effective screening plan

and complained that the previous screening was not properly done.
Mr. Berne, 7332 Franklin Circle, felt new industrial uses would increase traffic
on Co. Rd. 4 and :asked if it was to be improved to 4 lanes. The planner responded
the road is maintained and improved by the county and is not contained in the county's
5 year improvement program other than for safety improvements.
Mr. Robertson, 16417 Lincoln Lane, favored Alternate D and stressed the importance
of enforcing an adequate landscaping bond.
Mr. Andrew Justus, landowneer, stated he felt the planner did a comprehensive plan and
he and other owners would like art opportunity to meet with staff and discuss the
alternatives.
Jack Eide, Roll Tank, stated he is anxious to build another ouilding -Md have outside
storage.
Motion:
Fosnocht moved, Lynch seconded, to continue the Eden Prairie Industrial Park public/
private PUD to the commission's Feb. 14th meeting. The motion carried unanimously.

V. PETITIONS AND REQUESTS
PUBLIC HEARINGS
A. Walnut Addition, by Dirlam Properties. Request to preliminary plat and
rezone 7. 7 acres from ki-22 to xm 2 . 5 and Km b.5 for double bur_gaiows
and apartment units. The site is located in the northeast corner of
Valley View Road and Co. Rd. 4.
Dennis Dirlam, Dirlam Properties, stated he is requesting that the 7 . 7 acres be
rezoned to allow 16 doubles and 2 lots for '8 plexes. The duplexes would be 2 stories
with garages .
Sorensen, referring to page 3 of the 12-29-76 submission, asked why it is not
believed economically possible to develop the site as R1-22. Mr. Dirlam stated
the cost of thelots under the R1-22 zoning would be very expensive and dictate
higher cost single family than is reasonable for the site. He believed very few
R'_-22 lots are being developed in Eden Prairie because of the cost .
Sorensen asked how many stories the duplexes would be. Mr. Dirlam replied 1-1 . 5 x
Bearman, r the�o page 1 ,#4, inquired �f _he developer would proceed with the
project if the school is not built at Round Lake. Mr. Dirlam replied affirmative
as a market exists for the units whether the school is built or not .
Fosnocht asked, considering existing surrounding land uses, why the applicant felt
the proposed land uses are appropriate for this s.:te.
Mr. Dirlam, responded that since Co. Rd. 4 is such a busy street he believes the
site would be mor;; appropriate for the duplexes than, single family.
Fosnocht remarked that the nursery stock on the site is planted in rows and may be
difficult to retain. He asked what percentage of the stock the applicant Feels will
be retained. Mr. Dirlam estimated up to 90% could be retained or transplanted . I
Sorensen asked how wide the lots are in the Estheihills Addition that adjoin this
proposal . Mr. Dirlam estimated 100 feet
Gordon Carlson, 7352 Franklin Circle, on behalf of approximately 47 families sur-
rounding the proposal , submitted a petition with sig^atures opposing the rezoning
of Walnut Addition ( petition attached ) . He ctated some of the single family
homeowners would not have bought lots if they had known this site could be changed
to multiple. They believed the project is inconsistent with the s-urrounding single
family character and should not be rezoned.
Tom Bartel, EP 'dews, asked when the property was zoned to R1-22 and if the Guide Plan
depicts the area as multiple. The planner estimated the property was zoned in 1959
and the Guide Plan does show M3 in this general area.
Mr. Ron Conley, 7305 Franklin Circle. stated he believes the proposal will be
inconsistent with the surrounding single family of one-half acre lots.
Don Peterson, Edenvale Inc. , stated multiple is shown on the Guide Plan for this
site and across Valley View Road.
Al Upton , 16163 Edenwood ar:lve, believed the access to the proposal is too close
to the C o. Rd. 4/ Valley View Road intersection.

Don Berne, 7332 Franklin Circle, believed the grading required on the site would
dictate tree removal and expressed concern that in the spring water runoff from, the
site passes through his yard and driveway.
Jerry Rose, 7336 Franklin Circle, believed the project would adversely affect the
single family values. He felt the distance between single family and multiple
should be greater than the distance in this proposal.
Mr. Dirlam stated he lives 1/2 mile from the Proposal and believes the proposal
will be beneficial to the city.
Marco Jones, 163S4 Edenwood Drive, stated he developed Edenwood Ridge and at the
time of development he was told to align Augusta Lane so that it would correspond
with the proposed single family plat for this area.
Mari Dragseth, 15071 Summerhill Drive, inquired about the costs of the units, tax
benefits and if they would be owner occupied units. Mr. Dirlam replied the duplexes
would probably be owner occupied on one side and the other side rented out .
Ae units wou; J cost approximately $40,000 apiece , and he believes the tax benefit
to the city would be greater than if the site is developed as single family.
Tom Bartel , inquired how such the 8 plexes would rent for. Dirlam replied $ 22S-250
and they could possibly in the future be converted to ownership units.

to the corurissions Feb 14th meeting and instruct the staff to prepare a report

R. Norseman Industrial Pa: k ?nd_ Addition , by Herleiv Helle, request to prowl iminary
plat and rezone 16 acres frov.. Rural to Industrial . The site is located south of
Co . Rd. 35 approximately i00 feet east of Washington Avenue.
Mr. Helle staved his request is very simple, 4 acres per lot and sewer and walker are
available and will be worked out with the City Engineer. He stated he has tried to
sell the property, but buyerm, want zoning. He felt the zoning will be consistent
with the Guide FIan and he will retain the tree line between the property and Hillger ' s
and Bearman 's hoiaes. He expressed his opposition to Co. Rd. 39 going through his
property and objected to the road system proposed by the Smetana Lake Report .
lk-aman gtiestioned which way Co. Rd. 39 would be relocated . The planner replied the
,runty will be addressing t7ic issue and the city may be seeking traffic consultants '
assistance in reevaluating the road system in this area of the &ietana bake Sector.
The planner stated one problem with widening Valley View is that as it crosses the
creek it is li-sited to the existing right-of-way and no adCftlonal right-of-way can
be -acquired because of park dedication along Nine Mile Creek.
Mr, Bill Perarson stated he has no -objection with the roan bystems.

Lynch moved, Fosnocht seconded, to continue the public hearing to the commission's
Feb. 14th meeting and rirect the staff to prepare a report and recommendations.
Helle objected to any delays and requested the commission take action tonight or
he would proceed to the City Council .
Sorensen asked Mr.Helle -�o allow the commission ro consider the motion and ruled
Mr. Helle out of order.
Mr. $ Mrs. Belle further objected to continuing stating it was a delay that was
uncalled for.
Sorensen informed the Belles they were out of order.
Mr. Putnam reminded Mr. Belle, according to turd. 135, the commission has 60 days
from the date of referral to make a recommendation on .an item before it goes to
the City Council .
Vote: The motion carried 4 :0 :1 with Bearman Abstaining
Mr. Belle again expressed his displeasure of having the item not acted upon and
stated no further study should be done on the road systems . He said he would
ash: tc be or, the Council' s agenda with or without a Planning & Zoning Commission
recommendation .

in Edenvale' s Northwest Area.
Peterson pointed-out the site's location in Edenvale' s Ncrthwest Area . The project
would be 2 . 4 u / acre and lots would be 70-110 feet wide across the building pad .
He proposed to cross the dry mars:, with a street in order to retain some of the
large historic trees in the area. He stated when Edenvale Boulevard is completed,
2-3 years, it will greatly reduce the traffic congestion in the area.
Fosnocht inquired what use is proposed northeast of Woodland Addition . Peterson
replied cluster units.
Joyce Miller, 7036 Springhill Circle, asked what uses would be or. outlot A.
Peterson replied 2 single family lots And open space.

garages . Peterson replied negative.

be protected even after the lots are sold to builders or individuals. Peterson -stated
he would work with th! city staff mid walk the site to personally place the road
location and mark trees to be retained.

The site is located mast of Amsden Hills and west of Co. Rd IS.
Don Hoss illustrated the site's location and stated it would be similar to
Northmark II and access is planned by Garrison Way to Amsden Road for the lots.
Dearman asked how far it is between A&sden Way and Co. Rd. 18. Hess estimated
700 feet.
The planner stated no commercial exists at the corner of Amsden Nay and Co. Rd. 18
as shown in The Preserve' s submission. Hess informed the commission the commercial
of 2,000-3,000 square feet may be proposed in the future.
Motion :
Lynch moved, Dearman seconded, to continue the public hearing to the Feb. 14th
meeting and refer to staff for report wid recommendations. The motion carried
unanimously.
E. Prairie East 'Third, by Hustad. Request to preliminary plat and rezone SO acres
from Rural to RM 6.5 for 88 single family lobs. The site is located west of
Co. Rd. 18, south of Prairie East 1st and 2nd Addition.
Jim Ostenson presented the proposal which is located south of Prairie East Second.
He stated the 3 outlots would be developed at a later date. lie stated the trees
would create a buffer between the project and Co. Rd. 18.
Bearman inquired where Noble Lane would gb. Ostenson was unsure as it is not owned
by Hustads.
Sorensen asked for the net area of the plat . Ostenson estimated 3S acres . Sorensen
then asked for the average lot size. Ostenson stated he had not vet computed the
average.
