Council Representative Sidney Pauly. Pauly reported the Council referred the item of small commercial outlets to the Commission. She also stated that the council liaison would continue. Notion: Fosnocht moved, Sundstron seconded, to direct the staff to investi - gate and report on small commercial outlets. The notion carried unanimously. C. Others. none P PORTS AND RECOMMENDATIONS. Mr. Steven Naill , Director Residential Services Muriel Humphrey Residences, read the January 21 , 1976 letter to Mr. Putnam regarding statistics and facts on the mentallyretarded crime and property devaluation. P P Y � Sorensen listed other input received todate as information from; thr City of Richfield, City of Bloomington, Cie; of Coca. Rapids, City of Victoria, Kenney Realty, The Hope United Presbyterian Church , League of Noma Voters, Mr. Rollins, Mrs. Wenke, 8 Mr. 'Tonnemaker. Mr. Phil Riveness statedd almost all similar proposals have been revitmed by the South Hennepin Human Services Council and th&� the Council voted unanimously � to recommend approval of the Fraser program in The Preserve. � t Sorensen asked it the South Hennepin tb man Services Council had am concerns regarding the project . Mr. Riveness responded that the only concern was that -the project say become a community within a community but they have .strong faith that the Louis* Whitbeck Fraser School will stress coa■mity � involvement. The planner reviewed the staff report dated January 22, 1976 and staff recom- � mendatiorms on the rezoning .from Rural *,o RN 6.5, replatting of L2, 58 Nestwinds and review of the proposal per Ordinance 289 .vnd the State Law, � Planning Commission Minutes -2- 39HP18"4976 The planner stated that according to proposed state regulations Edell Prairie is considered a 4th ^lass city ( under 10,000 population ) , which restricts retarded to not more than 5% of the total city population. A 3rd class city would be restricted to retarded less than 10% of the city population and not Ciuber Llian 5i4 miie from any existing or proposed facility . Sundstrom asked if the 12 person home with 2 house parents is experiwerital? Dr. kowalcyzk responded it is experimental but based on studies of ment311y retarded needs and the project in Victoria . Bearman, referring to #5 on page '.0 of the staff report, inquired what type of input the homeowners association would have. The planner stated the HOA would not have voti;ig power but would insure dialogue and communication. Lynch asked if any negative responses concerning crime, property devaluation, etc. , had been received. The planner stated the city staff did not request information and the information supplied was supplied by the Fraser staff. Mr. John Sekulla, Preserve resident, stated contrary to similarities being made between the Michigan home and the MHR site, the Michigan home is on 36 acres and not near single fawily. Mr. Jordano disagreed saying the Michigan home is on 6-10 acres. W. John Davis . Preserve resident, inquired if any information had been received regar3ing affects on property values . Sorensen - informed the audience that letters have been received from Kenney Realty in Richfield and from the Cities of Victoria and Coon Rapid3 stating no devaluation of property has been found for homes located near group hones. Sorensen then read the letter from the mayor of Victoria dated January 23, 1976. Mr. Leroy Wenzel , Preserve resident, said he is impressed with the thorough- ness of documentation and concern for human rights that the commission and city are exhibiting. Mr. Dave Anderson, Preserve resident , statea ,lost of The Preserve residents are not opposed to the Fraser project but are against the extent of the proposal. John Nelson, President of the Preserve HOA, suggested approval be given to one home and if it is determined that the project is successful the other 2 homes could be built. Judy Schuck, 7286 Topviek «_oad, stated she feels the proposal affects all of Eden Prairie and diversity of housing as outlined and adopted by the City in the Housing Task Force Report will make the City of Eden Prairie richer. Don Hess, The Preserve, stated The Preserve reviewed the proposal indepth and believe it will be a service to The Preserve and the City. He added that Fraser School graduates should have 41 priority in placement. Rosemary Dysinger, Human Rights Commission Chairwoman, felt many citizens within the City will work to make the program a success. Motion 3 Lynch moved, Bearman seconded, to recommend approval of the replat of Lot 8 Block 2 Westwinds to provide a . 8 acre triangle , a .43 acre outlot for pathway purposes, and a 2. 34 acre development parcel . The motion carried unanimously. Motion 4 Bearman moved, Sundstrom seconded, recommend approval of the MHR proposed by Fraser School and Robert Mason in concept because of the specialized, pro- gram . experience of the Fraser School and NHR program, and unique site ` features and location which allow clustering of 3 units on 1 site in The Preserve fused upon the following; 1. that the MHR concert request a variancc, of Subd. 5, item F of Ordinance 289 by allowing 3 structures within 500 feet of each other. 2. that no further group cr family care homes should be permitted in The Preserve Sector ( 11 untilone of the following would occur; is a. that the total housing units in The Preserve Sector reach 1 ,000 • b. that family or group care homes be developed in at least six other city sectors. c. and that in no case may the family care home ratio exceed that permitted in Ordinance 289 or State Regulations governing community based residential services for the retarded or handicapped whichever more restrictive. 3. that the MHR proposal be developed in detail by Fraser School staff and meet all requirements of Subd. 5 of Ordinance 289. The City staff shall prepare an evaluation of the MHR submission in co^formance with Ordinance 289. This report will be submitted to the City Council for its review and approval with a copy to the President of the Preserve HOA. 4. that the City Council direct the Human Rights Commissioin to study and recommend the structure and composition of the Corwanity Based Services Board as required by Ordinance 289 . S. that the MHR director of Residential Programs meet frequently with representatives of the Preserve HOA to discuss and explain the program development, discuss selection of house parents for the 3 homes and work- out questions as they may arise. b' and recommend to the C2.ty Council that the legality of *2 be investigated and, if neces;,ary,criteria be developed so as to protect the integrity o f she Preserve and Ordinance 289. Sorensen felt the Creek Study was a very complex document to adopt and suggested it be used as a guideline during a trial basis . motion Lynch moved, Fosnocht seconded, to recommend that the Purgatory reek Study be adopted in concept as a policy guide. The motion carried 4 :0:2 with Bearman and Sundzitrom abstaining. a The Commission then suggested the Council develop proirities and investigate avenues of implementing the creek study. C. VLJ p-V Service Commercial . The PUD is located north of I-494 in the Major Center Area and south of Smetana Lake and Nine Mile Creek. Pauly asked if there is any alternative to extensively grading the auto dealership sites. Brauer replied that the grading is dictated by the ramp and road plans . He added that if concept approval is granted they would be returning with more detailed plans. Sorensen expressed the following concerns; the treatment of the floodplain is unacceptable, the use of the undulated land as car dealerships requires too extensive of grading, car lots in the MCA can be located elsewhere than this site, the 2 acre sites on the eastern end of the pud are insensitive to the landforms, and based on the Guide Plan , staff report and Purgatory Creek Study the only action he would support would be concept approval of the Commercial Highway site. Lynch agreed with the concerns expressed by Sorensen. Pauly agreed with the proposed use at the western end of the site but not the auto dealership uses. Motion: Lynch moved, Pauly seconded for discussion purposes , to recommend to the City Council denial of the PUD and rezoning request for Regional Service Commer- ..cia.l by Condon/Naegele Realty because the treatment of the floodplain is unacceptable, the use of the undulated 'Land as car dealership sites requires too extensive of grading, car lots in the MCA can be located elsewhere than this site, and the eastern proposal of 2 acre lots is insensitive to the landforms. Discussion: Amendment : Sorensen moved, Pauly seconded, to amend the motion to approve in concept the Commercial Highway at the westerly end of the PUD as presented in the revised sur�ission dated December, 1975. The amendment carried 4 :2 with Lynch and Fosnocht voting nay. Vote On Motion: The notion carried 5 : 1 with Fosnocht voting nay. j$. 3 AM- approved Planning Commission Minutes -5- Jan. 26, 1976 D. He estimated the forum would last about 3-4 hours and involve approximately 60 people. E. Edenvale Ilth Addition,by Edenvale Incorporated. request for rezoning to R1-13. 5 with lots size variances & preliminary plat approval for approximately 22 lots on 6 acre. The site is located north of the intersection of Woodhi ll Trail and Edenvale Boulevard. The planner referred the Commission to the staff report by Chris EnPer. Pauly asked why the previously approved project was not pursvied. The planner responded that Suncrest Homes Incorporated left she project and now Edenvale Incorporated is interested in doing something with the land that is already graded. Sorensen stated he supports lower cost housing but has difficulty with the lot sizes and the house/garage, house/garage appearance. Don Peterson said he is willing to make some changes as suggested in the staff report. Lynch felt the garage sacrifice would be acceptable temporarily. Motion: Lynch moved, Fosnocht seconded, to continue the public hearing to the Feb. 9 th meeting. The motion carried unanimously. - - - Pauly excused herself - - PETITIONS AND RE UESTS. A. Area H of The "Preserve Commercial Plan, presentation by The Preserve of plans for their site in the southwest quadrant of U.S. 169 and Schooner Blvd. Mr. Don Hcss presented the proposal for 5 auto dealership sites and discussed the ideas of storage and building arrangement that the auto representatives halre such as; the necessity of freeway visibility and inioor shooping, and disagreement With the plaza coi&cept. Sorensen asked if market studies illustrate freeway exposure is necessary for impluse buying. Hess replied that constant exposure produces preconditioning which brings people back when they are reddy to buy. Discussion followed relative to meetings with auto representatives to discuss concerns and the plaza concept. Sorensen felt such a meeting should be a _ public one and that concepts, not the specific project, should be discussed. Lynch chaired the remainder of the meeting , Sorensen asked to be- excused because of a health problem. Lynch believed the plaza concept is the best wid should be pursued. Notion: Beaman moved, Sundstrou seconded, to continue the item to the Feb. 9th meeting. The notion carried unanimously. ,a approved Planning Coomission Minutes -6- Jan. 260 19?6 R. Homart Development Company, Twin City Federal and Suburban National Bank, program modification to allow limited exterior signs on Men Prairie Center. Not covered at the request of the proponents. z Y C. Gravel Miring Permit Request for Swendscen Property. M r. Sunde informed the Commission that the previous mining permit expired and Johnson Brothers desire to gain P. new permit. He then showed the Existing end proposed grading. He stated the watershed is reviewing the permit and that Mr. Swendseen plans to ultimately market the property as industrial . Bearman asked if the garbage has been cleaned off the property. Olson said yes. Beamman then inquired if the proposed land use plan conforms to the Co. Rd. 18/ 169 interchange shown in the Smetana Lake Plan_. The planner responded it does not conform to the Smetana Lake Plan and he would recommend approval of the permit but not the land uses proposed. Motion 1 Fosnocht moved, Sundstrom seconded, to recommend approval of the grading permit by Johnson Brothers Incorporated for tine Swendseen property based on the Gravel Mining Permit Report dated Deceuber, 1975. The motion carried unanimously. Motion 2: Fosnocht moved, Lynch seconded to refer the proposed land uses for the Swendseen property to the staff for a report for the Council and Planning Commission. The aotion carried 3: 1 with Dearman voting nay because of his objections to the Smetana Lake Plan. PLAWER'S REPORT A. The planner listed the following suggestions todate; bikeways, Edenvale playgrmmcl.. Round Lake Park road access to Bryant Lake Park, nelghborhood playgrounds, Prairie View School Park development and Redrock School park development. Lynch and Beaman felt the Co.
