The Planner stated that the developer proposes an alteration of the site plan that was appr"ed in 1973 . He introduced Mr . Larry Laukka who would press-.it the project. . Larry Laukka , Laukka 6 Associates , reviewed the oriolaal proposal nf 143 units , went over the alteration , stated that the surrfluncing home- owners will be able to use the recreational facilities , reviewed the - landscaping plan , and grading and utilities plan . The Planner reviewed the staff repoirt of December 4 , 19209- covered parking and roads , and also revfewed. the screenirvg of the site . Tarjesen questioned whether one of the buildings met the 35 ' frontyard setback . The Planner replied that it was very close and could easily be mad-i f i ed to comply. - Planning Camission Minutes -2- Atcoo sroU. I Bentley asked if this development would adversely affect the golf course and stated that he was concerned with the crossing of pedestrians to get to the golf course. Laukka replied that they would carefully plan the road crossing area within the deveiopowt to assure a safe crossing. Bentley stated that he was also concerned with the Riley-Purgatory Creek Watershed letter dated December 3 , 1980 . Laukka stated that they plan to go to the Watershed for approval . Sutliff asked if the sidewalk along the public road will be concrete . The Planner replied yes . Bentley asked why the cull -de-sacs were not recommended to be public . The Planner replied that - they are not up to public standards and the Homeowners Association would be responsible for maintenance of thee. Torjesen asked the price range of the units . Laukka replied between $55 ,000 and $75 ,000. 6arnter asked if that price includes appliances . Laukka replied yes . Conrad Sorvick , 14322 Fairway Drive , felt that the proponent has been very cooperative with the homeowners and stated that they approve of the project. �. Olen Neinkc , 14336 Fairway Drive , stated that he wanted to know how close the buildings are to the proposed street . Laukke rep; ;ed approximately 35 ' to 40 ' from the corner of the building and also stated that they will bee-m to protect the end of the existino buildi3g . Lawrence Felsenberg , 14321 Fait-way Drive , was concerned with the use of concrete as opposed to blacktop for the sidewalk . The Planner replied that blacktop has long-term maintenance problems if used for a public walk . . Torjesen asked if gravel could be used for the sidewalk . The Planner replied it cannot be used in a right-of-way, because of maintenance p,^oblea+s. � L -Mtvkka stated that they will respond with a sidewalk v13" before going to the City Council and Parks , Recreation , and Natural RexRWrces Commission . William Rumpel , 14338 Fairway Drive , stated that he was opposed to a sidewalk . The planner replied tsit the sidewalk is a convenience to the walking person , and arl so sta cad that- the Parks , Recreation and Natural Resources Commission will have this item on their agenda . - Torjesen asked if a lot of traffic -is anticipat4d on the reed. DISCUSSION Went ey asked that the motion include requiring the proponent, prepare a trail system to present to the Parks , Recreation , and Natural Resources Commission prior to City Council consideration and include the Department of Transportation letter dated October 20 , 1960 and the Riley- Purgatory Creek Watershed letter dated December 3 , 1980 . Amended motion carried 5-0 . B . BENTEC OFFICE , by John A . Benedict . Request to rezone 2 acres from Rur31 to Office , combine the 2 existing lots , and use the existing structure , ., ..-FF; ..e a nr s-1 b1. i c hearing The Planner reviewed the previous zoning changes and stated that Mr . John Benedict and Tim Pierce of Tim Pierce & Associates were present . Pierce introduced Mr. Benedict , gave a brief slide presentation , and explikined the surrounding land uses . The Planner reviewed the staff report dated December 4 , 1980 and stated that if the existing building would be used more than 5 years , the City ' s Building Inspector would require substantial structural improvements . Retterath asked what type of business this would be . Benedict replied he owns a business called Bentec Sales and stated that this is a manufactur Retterath asked about storage . Benedict replied that he would comply with all codes and further stated that smoke detectors would be installed . Sutliff asked if this use could revert back to rural if this use was not updated in 5 years . The Planner replied that there will be a clause in the Developer ' s Agreement stating this . Sutliff asked if screening will be required for the parking lot . The Planner replied yes . Retterath asked if any residents were present . None were in attendance . MOTION 1 Bentley moved to close the public hearing . Sutliff seconded , motion carried 5-0 . MOTION 2 Bentley moved to recommend approval of the rezoning from aural to Office based upon the November 11 , 1980 and November 18 , 1980 material and the December 4 , 1980 staff report excluding the land- scaping date of May 1 . Gartner seconded , motiors carried 5-0 . approved Planning Commission Minutes -4- December 8 , 1980 MOTION 3 Bentley moved to recommend to the City Council approval of the prelim- inary plat dated November 11 , 198C as per the report dated December 49, 1980 with the exclusion of the landscape date -if May 1 . Torjesen seconded , motion carried 5- 0 . C . MTS/MCC INDUSTRIa_ CAMPUS , by MTS Systems Corpor- ation and Magnetic Controls Company . Request for PUD Concept approval of industrial and commercial uses upon 150 acres . Located off or the Southeast corner of Mitchell Road and T . H . 5 . A public hearing . The Planner suggested that the commission hear a presentation from John Wdrra-ll representing both MTS and MCC , frcm Brauer and Associates , and refer the item to staff for a report . Worrall - reviewed the proposal , stated that the proponent wants to develop the property as an industHal campus . Sutliff asked if the proposed street would be a service road . The Planner replied yes and stated that it would be parallel to T . H . 5 and run from Mitchell Road east to West 78th Street . Turiesen was concerned that West 78th Street runs into floodplain area . The Planner stated that he felt that it is critical that the site have access to west 78th Street , and that the staff report and the Purgatory Creek Study for this area would dea ': with this question . Sutliff asked hone much fill is planned in the conservancy zone . The Planner stated that a study will be done to determine that . Bentley asked if the commission should wait to give recommendations until the study is completed . The Planner stated yes , that the proponent could came back at the first meeting in January . Worrall further stated that the proponent wanted tn meet before the ccmmis - sion to present the project at this time more as an informational item . MOTION Bentley moved to continue the public hearing to January 12 , 1981 for a staff report . Torjesen seconded , motion carried 5-0 . D. EDENVALE APARTMENTS , by Edenvale Apartments , A artnership . Request for PUD Development Plan approval , platting of 2 lots , and rezoning from Rut-al to PM 2 . 5 for 17 of the 23 acre site . Lo - cated in the east quadrant of Mitchell Road and Valley View Road extended . A public hearing . The Planner stated that Mr . James Cooperman of Bar- Ett Construction Company and Sid and Scott Bader of Z b S Management Company were present . approved Planning Commission Minutes -5- December R , 1980 s Cooperman reviewed the site the parking area stated there will be a totlot and swimming pool . He also stated that each unit will have a balconv . The Planner went over the staff report dated December 5 , 1980 . Bentley asked if all units are to be rental . Cooperman replied yes . Bentley stated that he was concerned with the size of the building . The Planner stated teat very little grading occurs , the building is place' in good position on the site , and also that the plateau and slope areas are preserved . Retterath asked the degree of the angle of the joq in tine building. The Planner replied it is 25 ' . Cooperman stated that each jog is a fire wall . Pichard Johnson , 7271 Prairie View Drive , stated that he was concerned with Valley View Road . Phyllis Kielblock , 7262 Mitchell Road , was concerned with the traffic . The Planner stated that there will be approximately 1300 trips per E day . Phyllis Kielblock stated that she was also concerned with the time it will take an emergency vehicle to get to the Golf Vista area if it _ occurs in the future at the end of a cul -de- sac . MOTION 1 Bentley moved to close the public hearing . Sutliff seconded , motion carried 5-0 . MOTION 2 ' 6entley moved to recommend to the City Council approval of the revised PUD Plan and rezoning to RM 2 . 5 as per the plan dated November 14 , 1980 and the December 5 , 1980 staff report with the following additions : 1 . That constroiction be contingent Upon access tj hardsurfaced Valley View Road . 2 . That fire access and safety plans be emphasized . Sutliff seconded , motion carried 5-0 . MOTION 3 len ey moved to recommend to the City Council approval of the preliminary plat dated October 27 , 1980 as per the December 5 , 1980 staff report with the same additions as in motion #2 .
