MOTION• Bye moved, seconded by Bauer to continue this item to the August 27, 1990, Planning Commission meeting as requested by the proponent in order to allow more time for redesign of the plans. Request for Comprehensive Guide Plan Change from Low Density Residential to Church on 3.5 acres, Zoning District Change from Rural to Public on 3.5 acres, with a variance to be reviewed by the Board of Appeals, Site Plan Review on 3.5 acres, Preliminary Plat of 12.4 acres into 2 lots, one outlot and road right-of-way for construction of additional parking spaces. Location:Northwest comer of Baker Road and St.Andrews Drive. A public hearing. Fred Hosington, representing the proponent, stated that the Church had submitted in writing what it believed to be compelling reasons for the City to approve a Comprehensive Guide Plan Change. Hosington noted that the other major concern of Staff and the Planning Commission had been the screening of the parking area from the single-family residential area to the north. Hosington stated that Phase I would be screened by the existing vegetation with the addition of a berm and Bluehill Spruce. He added that additional vegetation would be planted for Phase H if this portion of the plan would ever proceed. Uram stated that the first consideration by the Commissioners should be if the rationale for the Comprehensive Guide Plan Change had been substantiated. Bauer stated that he appreciated the outline presented by the proponent regarding the rationale for the Comprehensive Guide Plan Change and would be supportive of the change; however he was concerned about what time limit would be allowed for the temporary gravel surface to remain before a permanent surface would be installed. Ruebling questioned how a time limit would be established and enforced. Uram replied that the Planning Commission could recommend a time limit; however, enforcement was difficult. Uram added that he believed that it was important to have a time limit established for the record and also to emphasize to the Church that this was only a temporary situation. Ruebling asked if the Church would be able to make the decision to relocate or stay at the present location within one year. Pastor Rod Anderson replied that the Church would appreciate at least a two year period • to make these major decisions. MOTION 1 Bauer moved, seconded by Bye to close the public hearing. Motion carried 4-M. MOTION 2: Bauer moved, seconded by Bye to recommend to the City Council approval of the request of St. Andrew's Church for Comprehensive Guide Plan Amendment from Low Density Residential to Church on 3.5 acres for expansion of the parking lot, based on plans dated July 17, 1990, subject to the recommendations of the Staff Report dated July 20, 1990. Motion carried 4-M. MOTION 3 Bauer moved, seconded by Bye to recommend to the City Council approval of the request of St. Andrew's Church for Zoning District Change from Rural to Public on 3.5 acres for expansion of the parking lot, with variance to be reviewed by the Board of Appeals,based on plans dated July 17, 1990, subject to the recommendations of the Staff Report dated July 20, 1990. Motion carried 4-0-0. MOTION 4: Bauer moved, seconded by Bye to recommend to the City Council approval of the request of St.Andrew's Church for Site Plan Review on 3.5 acres within the Public Zoning District for expansion of the parking lot,based on plans dated July 17, 1990, subject to the recommendations of the Staff Report dated July 20, 1990. Motion carried 4-0-0. . MOTION 5• Bauer moved, seconded by Bye to recommend to the City Council approval of the request of St.Andrew's Church for Preliminary Plat of 12.4 acres into two lots, one outlot, and road right-of-way for expansion of the parking lot,based on plans dated July 17, 1990,subject to the recommendations of the Staff Report dated July 20, 1990. Motion carried 4-0-0. MOTION 6: Bauer moved, seconded by Bye to recommend to the City Council and the Board of Appeals and Adjustments that the gravel surface for the parking lot be limited to 18 months; to begin from the date construction is started. Motion carried 4-0-0. E. CEDAR RIDGE 2ND ADDITION, Westar Properties, Inc. Request for Zoning District Change from Rural to R1-13.5 on 23.37 acres with variances to be reviewed by Board of Appeals, and Preliminary Plat of 23.37 acres into 54 single family lots and road right-of-way. Location: North of County Road 1,west of Cedar Ridge Estates at Rogers Road. A public hearing. Bob Smith, representing the proponent, stated that the proposed project would be in compliance with the Southwest Area Phasing Study. A variance for front yard setback was requested due to the location of the existing home and two additional variances would be necessary for street frontage on Lots 5 and 10. Smith noted that the lot lines could be adjusted to eliminate the variances for street frontage. The proponent would dedicated approximately 4.96 acres for public right-of-way. The density proposed for the project was approximately 2.31 units per acre. is for School District had pointed out to the proponent a concern regarding the potential for noise problems for the homes located adjacent to the ballfields and playground. The sanitary sewer and water line would be extended from Rogers and Kenning Road. Negotiations were . being made with the owners of the Lassen property to provide storm water run-off to drain into a pond located on the Lassen property. The road would require a petition from both the proponent and the School District. Smith stated that grading would be limited to Phase I and would be minimal. Heavy rows of pines would be used to screen the project from County Road 1 and 1 to 2 additional trees would be planted on each lot. Uram reported that Staff recommended that if the storm water connection to the adjacent Lassen property could not be negotiated that the project not be allowed to proceed. Uram noted that an actual transition plan had not been submitted by the proponent at this time. Ruebling asked if the homes would be required by City Code to line up with other homes. Uram replied that the City Code required that if a new home were constructed within an existing neighborhood the home would have to line up with existing homes. Ruebling believed that the provision of a buffer between the school's ballfield and playground and the residential homes was critical. Smith replied that the elevation of the homes would be approximately 15 feet lower than the ballfields. He added that statistics showed that only approximately 1 out of 20 residents who had purchased homes in similar situations complained about the noise. Lee Johnson, the proponent, stated that to provide a different site plan would require the road to be moved into a valley area,which would require additional grading. Johnson did not believe that this would be an acceptable alternative to the City. Johnson believed that the lots adjacent to the school would be the most desirable lots. He added that the lots adjacent to County Road 1 would have a more negative aspect,while the lots adjacent to the school would be a positive aspect. Johnson noted that the school had stated that the ballfields would be used only by children up to the 3rd grade. Johnson added that 8 lots had already been sold in the Cedar Ridge 1st Addition and had been some of the first lots sold. He stated that the • landscaping would blend in with that of the school. Johnson did not believed that a berm on both the school property and this project would be advisable. Johnson recommended that a Staff Recommendation be added to the report requiring the addition of over-story trees and pines. Johnson believed that the road as originally planned would not be efficient. Bauer asked if sidewalks would be located on both sides of the street. Smith replied that an 8-foot bituminous trail would constructed along County Road##1 and sidewalks would only be on one side of the street. Bye was concerned about allowing another development located adjacent to ballfields when the City had heard complaints from residents located next to ballfields in other locations within the City. Bye asked where the natural drainage was located on this parcel. Smith replied that the water naturally Rowed in the location where the proposed pipe would be installed. Bye then asked if the DNR had approved the proposed plan. Smith replied that the DNR had not responded at this time; however, the DNR did want the water to be brought into the pond. Johnson stated that the planned use of the ballfields could always change and believed that if that did happen that the neighbors would be within their rights to voice their opinions. Ruebling believed that the lower elevation of the ballfields only enhanced the problem of having residents located adjacent to the ballfields. Ruebling also noted that Staff had requested that a specific buffer and transition plan be submitted. Uram reported that it could be possible that this was an improved plan over the original; however, Staff was recommending that this item be continued to allow time for the proponent to provide a specific transition plan. • Ruebling recommended the consideration of deeper lots adjacent to the ballfields. Uram noted that this plan had 5 more lots that the original plan. Johnson stated that the lots were already 150 feet deep adjacent to the school property. He added that he was not interested in making these lots any deeper. Ruebling replied that he believed that deeper lots would give the proponent the opportunity to provide a better transition. Smith stated that to take lots from the middle of the project would result in the loss of 10 lots. Smith added that the ballfields were designed specifically for elementary children. Ruebling asked how the sidewalks would be planned for School Road. Uram replied that the sidewalks for School Road would be part of a petition process. Uram believed that several alternatives were open to the proponent to provide an adequate transition and a good site plan. Smith requested that due to a critical construction schedule the Planning Commission approve the plan as submitted with direction for the proponent to work with Staff to develop a specific transition plan. Uram noted that before the project could continue permits were necessary from the DNR and the Lassen property owners. Smith replied that written agreements would be provided prior to review by the City Council. Bye stated that she was not comfortable passing this along to the City Council with the number of questions left unanswered by the proponent. Bye added that she preferred to have the road as originally proposed and was also concerned about the screening provided along County Road#1. Ruebling believed that transitions to both the school and County Road #1 were important and a specific plan needed to be provided for the Planning Commission to review prior to passing this along to the City Council. Uram asked how Ruebling would like to see the transition. Ruebling believed that the depth of the lots should be increased even though the lots were in compliance with City Code. Johnson replied that the depth of the lots in Cedar Ridge 1st Addition were only 130 to 137 feet. Johnson further believed that . the depth of the lots was more critical along County Road#1 than adjacent to the school. Johnson stated that the lot lines could be massaged 5 to 10 feet. Bauer stated that he preferred the road layout as proposed on the plan tonight. Bauer noted that the noise factor along County Road#1 was a given and would be obvious to potential buyers; however, the school issue is different in that the noise potential is not as obvious. Bauer believed that these fields would be used for more than just elementary ballplayers and that transition needed to be addressed now. MOTION 1: Ruebling moved, seconded by Bye to continue the public hearing to the August 13, 1990, Planning Commission meeting in order to allow proponent time to revise the plans to provide screening for the single family homes adjacent to County Road#1 and adjacent to the playground and ballfield area for a greater transition to the single family area. Uram recommended that if the only concerns were for drainage and transition that this item be published for City Council review on August 21, 1990. Motion carried 4-M. V. OLD BUSINESS VII.
