City Council - 09/22/1970 - Village Meeting MINUTES EDEN PRAIRIE VILLAGE COUNCIL Tuesday, September 22, 1970 7:30 P.ii. , Village Ball Members present were flayor Osterholt, Councilmen Haugen, Nesbitt, Lidb and Redpath. Also present was Village Clerk, Edna Holmgren and Village Attorney Perbix. Village Manager, George bite was absent. I . MINUTES OF JULY 29 August 25 SEPTEMB ER 3 and 14 1970. A motion was made y tir. Haugen, seconded y Mr. Redpath to approve the minutes of July 29, 1970 , as published. All voted aye. Motion carried. A motion was made by Mr. Redpath and seconded by Mr. Nesbitt to approve -the minutes of August 25, 1970 with the following addition: Item IV (A) Duck Lake Trail Subtrunk Sanitarx Sewer. Mr. Haugen , indicated that he was convince tha—E—t-Were was need and that in his opinion the Village had no choice but to proceed with the improvement. He also stated that he was concerned about pollution in Duck Lake. With this addition to his statement, all voted aye. Motion carried. A motion was made by Mr. Nesbitt and seconded by Mr. Haugen to approve the minutes of September 8, 1970 as published. All voted aye. Motion carried. A motion was made by Mr. Haugen and seconded by Mr. Nesbitt to approve the minutes of September 14, 1970 as published. All voted aye. Motion carried . II . 1971 BUDGET Mayor 0s erhotl asked for questions from the audience, none were forthcoming. A motion was made jby Mr. Lieb and seconded by Mr. Redpath to set a special meeting of the Council on September 29th at 7 P.M. in the Village Hall for reviewal and final action on the 1971 Budget. All voted aye. Motion carried. III. RECOtMMENDATIONS AND REPORTS A. Order to Remove Hazar ous Buildin . County Road 4 and Scenic Heights Road A motion was made by Mr. Redpath and seconded. by Mr. Fiaugen to adopt elf Hfution No. 364, an order for Mr. A.W. Miller to remove a hazardous building at the corner of County Road 4 and Scenic Heights Road. Village Attorney Harlan Perbix was asked by the Council to contact Mr. Miller and advise him of this order. All voted aye. Motion carried. B. Kings Forest Park-School Site Development and Maintenance A reement. 17 A motion was made by Mr. Redpath and seconded y Mr. Nesbitt to ask the Mayor and Manager to execute the Warrenty the Warranty Deed for the Kings Forest School property of 3 acres. On roll call , Mr. Lieb, Mr. Nesbitt, Mayor Osterholt, Mr. Haugen and Mr. Redpath all voted aye. There were no nays. Motion carried. The Council instructed the Village Manager and Village Attorney to study the Site Development and Maintenance Agreement before signing. Council Minutes September 22, 1970 Page 2 t C. Eden Prairie J.C. 's Round Lake Snowmobile Race. A motion was made by Mr. Haugen and seconded y N edpath to accept the recommendation by the Park & Recreation Commissionto approve the Snowmobile R&ce at Round Lake on February 13, and 14, 1971 . Village Attorney, Perbix stated that the lake could be used for this purpose. Fie advised that the Village should have a copy of the insurance coverage sometime before the event takes place. After this discussion,all voted aye. Motion carried. D. 1971 LAWCON Ao lication for Park Acquisition Funds. A motion was made by Mr. Re path a econded by Mr. Lieb to adopt Reso ut on No. 363, 365, and 366 authorizing the Village Manager to sign "Assurance of Compliance", Power and Utility Construction and 1971 LAWCON application for Park Acquisition Funds. All voted aye. Motion carried. E. Homeward Hills Additicn Preliminary Plat. A motion was made by Mr. Redpath and seconded y Mr. NesSitt to e ay action on approval of the Preliminary Plat for three weeks to October 13, 1970 Council meeting for study. All voted aye. Motion carried. F. Eden Prairie Industrial Park. Division of Lot 3 Block 1 . A motion was made by Mr. Nesbitt and sec on e y r. Lieb to accept the property division of Lot 3,, Block 1 at the south end of Fuller Road, Eden Prairie Industrial Park. On roll call , Mr. Lieb, Mr. Nesbitt and Mr. Haugen voted aye, Mr. Redpath and Mayor Osterhol t voted no. Motion carried. G. Mike Gorra Request for Buildins Permit. Village Attorney, Mr. Perbix stated that i s opinion, a building permit for this home on 23 acres of land in the proposed Hennepin County Park Preserve could not be withheld. The matter was referred back to Village Manager, Mr. Hite. H. Edenvale Industrial Park. Request for Public Hearin . Mr. Don Peterson ! appeared requesting a referral to the Planning Comission. A motion was made by Vir. Nesbitt and seconded by Mr. Haugen to refer this matter to the Planning Commission and the Industrial Commission and to set a tentative date of October 27, 1970 for the hearing, with Manager's approval and to set an alternate date no later than November 10, 1970. All voted aye. Motion carried. i I . Planned Stud Districts. Village Attorney Perbix suggested to the Council that t ey must move along with, the rezoning in the Planned Study Districts as the time is running out. The Council decided that this should be discussed , at the September 29th meeting. The subject will be considered by the Planning & Zoning Commission at its meeting on October 6, 1970.
