HomeMy WebLinkAboutResolution - 2017-72 - Conveyance of Property to Harders - 07/11/2017 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2017-72 RESOLUTION AUTHORIZING CONVEYANCE OF PROPERTY TO CULLEN AND STACY HARDER WHEREAS, the City is the fee owner of that part of Lot 10, Block 1, Riverview Bluffs embraced within Outlot D, Bluffs West Second Addition(the "Property"); and WHEREAS, the Property was originally intended to provide the City with access to a stormwater pond also located on Outlot D, Bluffs West Second Addition; and WHEREAS, in 1998, a portion of Bluffs West Second Addition was replatted into Riverview Bluffs and Outlot D, Bluffs West Second Addition became Outlot A, Riverview Bluffs; and WHEREAS, in the plat of Riverview Bluffs, the access strip to the stormwater pond on Outlot A, Riverview Bluffs, was moved a short distance to the west; and WHEREAS, at the time of platting of Riverview Bluffs, the City did not receive title to the new access strip portion of Outlot A, Riverview Bluffs; and WHEREAS, Cullen and Stacy Harder are the fee owners of the remainder of Lot 10, Block 1, Riverview Bluffs and have requested that the City convey the Property to them to facilitate their sale of Lot 10, Block 1, Riverview Bluffs;and WHEREAS, the City is now the fee owner of all of Outlot A, Riverview Bluffs, including the new access strip; and WHEREAS, it is now appropriate to convey the Property to the Harders. NOW, THEREFORE, BE IT RESOLVED by the Eden Prairie City Council that conveyance of the Property to the Harders is approved and the Mayor and City Manager are authorized to execute all documents necessary to effectuate the conveyance.
