HomeMy WebLinkAboutOrdinance - 15-2013 - Amending City Code Chapter 6.21 Relating to Snow and Ice Removal - 09/12/2013 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA ORDINANCE NO. 15-2013 AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINNESOTA AMENDING CITY CODE CHAPTER 6 BY AMENDING SECTION 6.21 RELATING TO SNOW AND ICE REMOVAL AND ADOPTING BY REFERENCE CITY CODE CHAPTER 1 AND SECTION 6.99 WHICH AMONG OTHER THINGS CONTAIN PENALTY PROVISIONS. THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, MINNESOTA, ORDAINS: Section 1. City Code Section 6.21, Subdivision 3 is amended by deleting subsection (A) in its entirety. Section 2. City Code Section 6.21, Subdivision 3 is amended by renumbering the remaining subsections. Subsection B shall be renamed subsection A, Subsection C shall be renamed subsection B, Subsection D shall be renamed subsection C, and Subsection E shall be renamed subsection D, Subsection F shall be renamed subsection E. Section 3. City Code Section 6.21, Subdivision 3 former subsection B renumbered as subsection A is amended by deleting the phrase "except from Trails or Sidewalks with the street rights of way listed in"A" above" and replacing it with the following: "unless the City assumes responsibility for causing snow and/or ice to be removed from a particular Trail or Sidewalk. The City shall identify any such Trails or Sidewalks on a map entitled "Sidewalk and Trail Plowing Designation" kept on file and open for public inspection in the office of the City Engineer. Said map may be revised by the City at any time and the City need not provide notification of revisions. It shall be the responsibility of each Owner or Occupant to determine if the City has assumed responsibility for particular Trails or Sidewalks" Section 4. City Code Section 6.21, Subdivision 3 former subsection C renumbered as subsection B is amended by deleting the phrase "except from Trails or Sidewalks with the street rights of way listed in "A" above" and replacing it with the following: "unless the City assumes responsibility for causing snow and/or ice to be removed from a particular Trail or Sidewalk. City Code Chapter 1 entitled "General Provisions and Definitions Applicable to the Entire City Code including Penalty for Violation" and Section 6.99 entitled "Violation a Misdemeanor" are hereby adopted in their entirety by reference as though repeated verbatim herein. Section 7. This ordinance shall become effective from and after its passage and publication. This Ordinance incorporates, by reference, City Code Chapter 1 and City Code Section 6.99,which contain provisions relating to penalties. EFFECTIVE DATE.
