RESOLUTION NO. 2012-132
NOTICE OF VACATION OF A PART OF THE DRAINAGE AND UTILITY
EASEMENTS LYING OVER, UNDER AND ACROSS LOT 2, BLOCK 1, EDEN BLUFF
HIGHLANDS 4TH ADDITION AND OUTLOT A,EDEN BLUFF HIGHLANDS 2ND
ADDITION
VACATION 12-06
WHEREAS, the City of Eden Prairie has (a) certain Drainage and Utility Easement described as
follows:
That part of a 20 foot wide Drainage and Utility Easement as dedicated within Lot 2,
Block 1, EDEN BLUFF HIGHLANDS 4TH ADDITION, according to the recorded plat
thereof, Hennepin County, Minnesota, the centerline of which is described as follows:
Commencing at the most northerly corner of said Lot 2; thence South 71 degrees
54 minutes 07 seconds East, assumed bearing along the northerly line of said Lot
2, a distance of 225.49 feet to the intersection with the centerline of a Drainage
and Utility Easement as dedicated on said plat; thence South 18 degrees 05
minutes 39 seconds West, along said centerline, a distance of 27.37 feet, herein
after referred to as Line A, to the actual point of beginning of the centerline to be
described; thence North 82 degrees 50 minutes 10 seconds West, a distance of
261.58 feet to the west line of said Lot 2 and said centerline there terminating.
Excepting therefrom, that part lying easterly of a line lying 10 feet westerly of and
parallel to the above described Line A and the southerly extension thereof.
Also excepting therefrom the West 10 feet of said Lot 2.
Together with:
That part of a 20 foot wide Drainage and Utility Easement as dedicated within Outlot A,
EDEN BLUFF HIGHLANDS 2ND ADDITION and re-dedicated within Lot 2, Block 1,
EDEN BLUFF HIGHLANDS 4TH ADDITION, according to the recorded plats thereof,
Hennepin County, Minnesota, the centerline of which is described as follows:
Commencing at the most northerly corner of said Lot 2; thence South 71 degrees
54 minutes 07 seconds East, assumed bearing along the northerly line of said Lot
2, a distance of 225.49 feet to the intersection with the centerline of a Drainage
and Utility Easement as dedicated on said plat and the actual point of beginning of
the centerline to be described; thence South 18 degrees 05 minutes 39 seconds
West, along said centerline, a distance of 407.07 feet to the south line of said Lot
2 and said centerline there terminating.
Excepting therefrom, the northerly 40 feet of said Outlot A and Lot 2.
Also excepting therefrom, the southerly 10 feet of said Outlot A and Lot 2.
WHEREAS, a Public Hearing was held on September 18, 2012 after due notice was given to
affected property owners and published in accordance with M.S.A. 412.851; and
WHERAS, the Council has been advised by City Staff that the proposed vacation of the above
described Drainage and Utility Easement has no relationship to the comprehensive municipal
plan; and
WHEREAS, it has been determined that the said Drainage and Utility Easement is not necessary
and has no interest to the public, therefore, should be vacated; and
NOW,THEREFORE,BE IT RESOLVED by the Eden Prairie City Council as follows:
1. Said Drainage and Utility Easement as described above is hereby vacated.
2. The City Clerk shall prepare a Notice of Completion of Proceedings in accordance with
M.S.A. 412.851.
3. This Resolution is contingent upon and shall not be effective until new dedicated
easement has been recorded with the County Recorder/Registrar of Titles as applicable.
The City Clerk shall not present the Notice of Completion of Proceedings to the County
Auditor or file it with the County Recorder/Registrar of Titles until new dedicated
easement has been recorded.
ADOPTED by the Eden Prairie City Council on September18, 2012.
