HomeMy WebLinkAboutResolution - 2006-60 - Vacation 05-03 of Easement for Part of West 62nd Street - 05/02/2006 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 2006-60 VACATION OF AN EASEMENT FOR PART OF WEST 62ND STREET LOCATED IN THE NORTH%2 OF SECTION 5 VACATION 05-03 WHEREAS, the City of Eden Prairie has a certain permanent easement for street purposes described as follows: A permanent easement for street purposes over all that part of the following described tract: East 110 feet of the west 281 feet of the north 300 feet of the Northeast Quarter of the Northwest Quarter(NE %4,NW %a) of Section 5, Township 116,range 22, which lies northwesterly and northerly of the following described line: Commencing at the northwest corner of the Northeast Quarter of the Northwest Quarter of Section 5, Township 116, Range 22; thence run easterly along the north line thereof on an assumed bearing of North 87 degrees 17 minutes 15 seconds East for a distance of 191.73 feet to the actual point of beginning of the line being described; thence South 9 degrees 29 minutes 25 seconds East for 33.21 feet; thence deflect left along a tangential curve having a radius of 52.00 feet for 118.48 feet more or less to the east line of said tract and said line there terminating. WHEREAS, a Public Hearing was held on May 2, 2006, after due notice was given to affected property owners and published in accordance with M.S.A. 412.851; and WHERAS, the Council has been advised by City Staff that the proposed vacation of the above described permanent easement for street purposes has no relationship to the comprehensive municipal plan; and WHEREAS, it has been determined that the said permanent easement for street purposes is not necessary and has no interest to the public, therefore, should be vacated. NOW, THEREFORE, BE IT RESOLVED by the Eden Prairie City Council as follows: 1. Said permanent easement for street purposes described as Commencing at the northwest corner of the Northeast Quarter of the Northwest Quarter of Section 5, Township 116, Range 22; thence run easterly along the north line thereof on an assumed bearing of North 87 degrees 17 minutes 15 seconds East for a distance of 191.73 feet to the actual point of beginning of the line being described; thence South 9 degrees 29 minutes 25 seconds East for 33.21 feet; thence deflect left along a tangential curve having a radius of 52.00 feet for 118.48 feet more or less to the east line of said tract and said line there terminating is hereby vacated. 2. The City Clerk shall prepare a Notice of Completion of Proceedings in accordance with M.S.A. 412.851. 3. This Resolution shall not be effective until the plat of Prairie Estates has been filed with the Hennepin County Recorder/Registrar of Titles office. The City Clerk is directed to withhold filing this Resolution with the Hennepin County Recorder/Registrar of Titles office until the City Clerk has received evidence of the filing of said plat.
