HomeMy WebLinkAboutResolution - 87-235 - Vacation of Drainage, Utility and Conservation Easement on Lot 10, Block 1, Bluestem Hills 1st Addition - VAC 87-07 i CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 87-235 VACATION OF DRAINAGE, UTILITY AND CONSERVATION EASEMENT ON LOT 10, BLOCK 1 BLUESTEM HILLS 1ST ADDITION WHEREAS , the City of Eden Prairie has certain drainage , utility and conservation easements described as follows : A drainage and utility easement over and across Lot 10, Block 1 , BLUESTEM HILLS 1ST ADDITION, according to the recorded plat thereof. Said easement lies southerly of a line described as follows : Beginning at a point on the westerly line of said Lot 10, Block 1 distant 116.00 feet southerly from the Northwest corner• thereof; thence in an easterly direction to a point on the easterly line of said Lot 10, Block 1 distant 132 .68 feet southerly from the North- east corner thereof and said line terminating . And northerly of a line as described as follows : k Beginning at a point on the westerly line of said Lot 10, Block 1 distant 116. 00 feet southeasterly direction from the Northwest corner thereof; thence in a southerly direction , deflecting to the left 83 degrees 07 minutes 05 seconds for a distance of 79.00 feet ; thence northeasterly, deflecting to the left , 49 degrees 12 minutes 18 seconds for a distance of 101 .00 feet to a point on the easterly line of said Lot 10, Block 1 distant 132 .68 feet southerly from the Northeast corner thereof and said line there terminating . A permanent easement for conservation purposes over and across Lot 10, Block 1 , BLUESTEM HILLS 1ST ADDITION , according to the recorded plat thereof, said easement lies southerly of the line as described and recorded as Document No . 5217015 and northerly of the following described line: Commencing at the most southerly corner of Lot 9, Block 1 ; thence on an assumed bearing of North 47 degrees 05 minutes 30 seconds East , along the southeasterly line thereof, a distance of 60.00 feet ; thence North 82 degrees 02 minutes 00 seconds West a distance of 66.38 feet to the point of beginning of the line to be described ; thence South 76 degrees 29 minutes 47 seconds West a distance of 101 . 00 feet ; thence North 54 degrees 07 minutes 55 seconds West a distance of 79.00 feet to the westerly line of said Lot 10, Block 1 and said line there terminating. 1 r VAC 87-07 �x WHEREAS, a public hearing was held on August 18, 1987 after due notice was published and posted as required by law; WHEREAS, it has been determined that the said easements are not necessary and have no interest to the public , therefore, should be vacated . The existing 5 . 0 foot side line drainage and utility easement adjacent to the westerly and easterly lot lines of said Lot 10, Block 1 are to be prolonged southerly to intersect with the line of the drainage and utility easement being retained . NOW, THEREFORE, 8E IT RESOLVED by the Eder. Prairie City Council as follows : 1 . Said drainage , utility and conservation easements as above described are hereby vacated. 2 . The City Clerk shall prepare a notice of completion of the proceedings in accordance with M.S.A. 412 .851 . ADOPTED by the Eden Prairie City Council on August 18, 1987 .
