RESOLUTION NO. 77-3
RESOLUTION AUTHORIZING THE FILING OF APPLICATION FOR GRANTS TO DEVELOP
RECREATIONAL LAND AND OPEN SPACE UNDER THE PROVISION OF THE FEDERAL LAND
AND WATER CONSERVATION FUND ACT AND THE STATE NATURAL RESOURCES FUND ACT
WHEREAS, The Land and Water Fund Act and the State Natural Resources
Fund Act provides for the making of grants to assist local public bodies
in the acquisition and development of outdoor recreation projects; and
WHEREAS, the City of Eden Prairie desires to develop certain parklands
known as Round Lake Park, which land is to be held and used for permanent
open space and recreation; and
WHEREAS, Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and
the regulations promulgated pursuant to such act by the Secretary of Interior
and contained in (43 C.F.R. 17) effectuating that title provides that no person
shall be discriminated against because of race, color or national origin in the
use of said land and facilities acquired and developed; now therefore,
BE IT RESOLVED, by the Council of the City of Eden Prairie:
1. That an application be made to the Office of Local and Urban
Affairs of the Minnesota State Planning Agency for a grant
from the Federal Land and Water Conservation Fund in the
estimated amount of $67,000 and a grant from the State of Minnesota
Natural Resources Fund in the estimated amount of $33,500.
2. That the City Manager is hereby authorized and directed to
execute and to file such application with the State of Minnesota
Office of Local and Urban Affairs of the State Planning Agency,
to provide additional information, and to furnish such documents
as may be required by said agency to execute such contracts
as are required by said agency and to act as the authorized
correspondent of the applicant.
3. That the proposed development is in accordance with plans for
the allocation of land for open space and recreational uses
and that should said grant be made the applicant will develop
and retain said land for use designated in said application and
approved by the Office of Local and Urban Affairs and the Bureau
of Outdoor Recreation.

4. That the United States of America and State of Minnesota be,
and they hereby are, assured of full compliance by the applicant
with the regulations of the Department of Interior effectuating
Title VI of the Civil Rights Act of 1964.

of January 1977.
