HomeMy WebLinkAboutResolution - 1167 - Authorizing Filing of Preliminary Application for 1977 LAWCON and Legislative Commission on Minnesota Resources Funds - 07/06/1976 +CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA 40 RESOLUTION NO. 1167 RESOLUTION AUTHORIZING THE FILING OF A PRELIMINARY APPLICATION FOR 1977 LAWCON AND LEGISLATIVE COMMISSION ON MINNESOTA RESOURCES FUNDS WHEREAS, The LAWCON (Land and Water Conservation) Fund and the Legislative Commission on Minnesota Resources provide for the making of 'grants to assist local public bodies in the acquisition and development of outdoor recreation projects; and WHEREAS, the City of Eden Prairie desires to acquire certain lands known as Mitchell Lake Park and Purgatory Creek Park, and develop certain park and recreation facilities at Round Lake Park which land is to be held and used permanently for park and open space; and WHEREAS, Title VI of the Civil Rights Act of 1964 P. L. 88-354-(1964) and of the regulations promulgated pursuant to such Act by the Secretary of The Interior and contained in 43 C. F. R. 17, effectuating that title, provides that no person shall be discriminated against because of race, color, or national origin in the use of the land acquired; and • NOW THEREFORE, BE IT RESOLVED by the Council of the City of Eden Prairie l. That an application be made to the Office of Local and Urban Affairs of the State Planning Agency for a grant from the Land and Water Conservation Fund as amended in 1965 and the Legislative Commission on Minnesota Resources Fund. 2. That the City Manager is hereby authorized and directed to execute and to file such application with the State of Minnesota Office of Local and Urban Affairs of the State Planning Agency, to provide additional information, and to furnish such documents as may be required by said Agency to execute such contracts as are required by said Agency and to act as the authorized correspondent of the Applicant. 3 . That the proposed acquisition and development is in accordance with plans for the allocation of land for open space uses, and that should said grant be made , the applicant will acquire, develop and retain said land for use designated in said application and approved by the Office of Local and Urban Affairs and the Bureau of Outdoor Recreation. 4. That the United States of America and the State of Minnesota be, and they hereby are, assured of full compliance by the Applicant with the regulations of the Department of Interior, effectuating Title VI of the Civil Rights Act of 1964.
