SUBJECT: Maple Leaf Acres - Request for Rezoning
and Preliminary Plat Approval
The Council may wish to consider the following four alternates with respect
to your review of the Maple Leaf Acres residential development, as proposed
by Mr. Loren Irvine.
Alternate A
Approve the first reading of an ordinance rezoning from Rural to RM 6.5 for
Lots 1 through 9, Block. 1 and from Rural to RI-13.5 for the remaining lots
in Block 1 and all of the lots in Blocks 2 and 3 of the Preliminary Plat of
Maple Leaf Acres, dated February 3, 1976 (received) . Such approval to be
subject to the following:
• 1. Submit preliminary grading plans for Engineering Department review.
2. Conformance with all requirements of the Parks and Recreation Com-
mission, as outlined in their approval action of January 19, 1976,
which include the following:
a. shifting the southerly line of Lots 21 and 22 and
Outlot A of Block 1 northerly approximately 55 feet;
b. combine said Outlot A with Lot 22;
c. delete Lot 11, Block 3;
d. $300 per lot park dedication;
e. public dedication of the drainage easement adjoining
Lots 1, 2, 3 and 4 of Block 2,
3. Satisfactory evidence that the distance for any driveways along
T.H. 101 is adequate.
4. Provide a 44' wide street and utility right-of-way for future
access to the Scroggins-Dorf properties west of Block 3 and
dedicate the south 20' of Lot 10 for future extension of Lotus
• View Drive.

5. No building permits for Lots 16, 17 and 18 until a temporary
cul-de-sac is provided at.the end of Tartan Curve, or until
such time that Tartan Curve is connected to some other street
44 and.thus eliminating the dead-end. f

6. No variances for lot sizes or setbacks to be requested

Alternate B
Approve first reading of rezoning as under alternate A, but refer the Pre-
liminary Plat back to the Planning and Zoning Commission for their review
and recommendation regarding the changes proposed since their previous re-
view, together with the recommendations forthcoming from the Minnesota
Highway Department and also that the applicant and Planning Commission
address the possibilities of no platting of lot lines withintany of the flood
plain limits.in. order to` comply, as much as i"s reasonable possi-
ble at this time, with the intent and spirit of the Purgatory Creek-Corridor
Study. The concept of "scenic easements" might be applicable in this respect.
Alternate C.
Refer the entire matter back to the Planning & Zoning Commission and direct
the applicant to follow the City's Planned Unit Development procedures.

Deny the rezoning and platting request as submitted.
