RESOLUTION NO. 1035
A RESOLUTION AMI.NDING THE 1968 COMPREHENSIVE
GliIDE PLAN FOR THE MODERN TIRE SECTOR
WHEREAS, over the past five years, the City of Eden Prairie has experienced
unprecedented planning for accelerated urban growth with respect to population,
employment, retail trade and natural resource development. Transportation, utility, and
educational systems as well. as City emergency, governmental and recreational services
are being up-graded to meet the growing needs. The City of Eden Prairie, faced with
the provision of services and facilities at a pace which must keep abreast of the
projected population increases, must devise a plan and strategy for community service
implementation that will complement private development to insure orderly community
growth.
WHEREAS, in 1968, the Village of Eden Prairie adopted a Comprehensive Guide
Plan to provide a dynamic framework to cope with the physical , social and fiscal
problems of a developing community. following adoption of the Guide Plan a revised
zoning ordinance, planned unit development procedures, and subdivision regulations
were approved to aid in providing specific guidance for land use change. The Com-
pletion of the comprehensive sewer water_ and storm water drainange plans have been
:adopted by the City and have been partially implemented. Joint School District and
City planning and acquisition for school/park sites allows maximum flexibility at
minimum public expense.
WHEREAS, The City has amended the 1968 Comprehensive Guide Plan by studying in
detail sectors of the City and after technical study, recommendations and public
hearings resolutions were adopted modifying the 1968 Comprehensive Guide Plan. The
Comprehensive Guide Plan is used as a "constant" which sector plans or specific re-
zoning request can be compared against.
t-JHEREAS, The City has studied the so called Modern Tire Sector with assistance
from technical experts in engineering, hydrology, traffic analysis, soil conservation,
finance, law and planning providing documentation for the recommendations contained in
the report of Brauer & Associates, Inc. and planning Staff Reports. The City Planning
and Zoning Commission has held public hearings prior to making its recommendation to
the City Council .
t%TPEREAS, the City Council has reviewed all technical data, citizen/landowner
recommendations , City advisory commission minutes and recommendations and testimony
at the September 23, 1975 Public Hearing.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of. Eden Prairie
as provided by State Law M. S.A. 462 empowering local. government to establish ordinances
and policies regulating land use to protect the public health, safety, and general
welfare as follows:
1 . That the Mini Sector Studyof the Modern Tire Area, Eden Prairie,
Minnesota, prepared by Brauer & Associates, Inc. dated August 4, 1975 and amended
August 26, 1975 is hereby adopted as the Modern Tire Area Sector Study.
2. Retain the Garden King home site and adjacent lots as residential
property not commercial.
3. Enforce the requirements of Ordinance 135 pertaining to nonconforming uses
and clearly identify the fruit market as such a use .
4. At such time as sewer and water are provided to Sunnybrook area, platting
and zoning of the Garden King home site and adjacent 1oLs should be considered to an
appropriate single family detached residential district ,
5. Close Sunnybrook Road when alternate access is available.
6. Give furr_her study to the impact of cul-de-sacing Creek Knoll Road.
7. That the east/west collector road is necessary to allow orderly and
compatible future development of the total area.
S. That the east/west collector should connect with State Highway #169 and
consideration be given to spacing from other streets, property served by the street
location, and connection with a major intersection.
9. That the parcels identified in the Brauer Report as Energy Systems , Modern
Tire, Clean Sweep and Simchuck properties should be non-residential as described in
said study. The collector road designed in allignment should be planned with this
in mind.
1.0. That the timing of the east/west collector street should not be in advance
of the need created by either the residential development east or the industrial
development of the parcels mentioned in no. 9 above as defined on page 3 of the
September 12 , 1975 staff report.
ADOPTED by the City Council of the City of Eder. Prairie on this 7 day of
October 1975.
