RESOLUTION NO. M
A RESOLUTION AUTHORIZING THE ACQUISITION OF LANDS EITHER
BY PURCHASE OR CONDEMNATION PROCEEDINGS UNDER THE RIGHT
OF EMINENT DOMAIN FOR THE PURPOSE OF CONSTRUCTING,
OPERATING , AND MAINTAINING UNDERGROUND UTILITIES.
WHEREAS , it has been necessary for the City of Eden Prairie, a municipal
corporation, locates?. in Hennepin County, Minnesota, to acquire from time to
time lands for the use of construction, operation, and maintenance of underground
utilities because of the rapid growth and development of the City; and
WHEREAS, the City of Eden Prairie has completed a comprehensive plan
for. the City, which plan designates certain areas as being logical and appropriate
areas to develop for underground utilities ; and
WHEREAS,, the installation of said underground utilities is necessary
for the development of sail' community and the health and welfare of the residents
therein; and
WHEREAS , subsequent thereto, the City has adopted the said comprehensive
plan which provides for the installation, operation, and maintenance of underground
utilities; and
WHEREAS , the following described tracts, pieces , and parcels of land
are necessary for the development and installation of said underground utilities,
to-wit :
Parcel. No. i Bounded by a line coimnencing at a point 335 feet Westerly of the
East line of the Northwest Quarter of Section 13, Township 116
North, Range 22 West in the Northerly right-of-way line of U.S.
Highway No. 494; thence Northerly and parallel to said East line
a distance of 70 feet ; thence Easterly to a point in the East line

of said Northwest Quarter 70 feet North of. said Highway right-of-
way Line; thence Southerly to said Highway right:-of-way line;
thence [•:esterly along said Highway right-of-way line to point of
beginning; except the Easterly 45 feet thereof. Another strip
of land 30 ieet in width centered on the following described
line : Conunencing at a point 60 feet West of said East line in.
the North line of the aforedescrihed easement; thence Northerly
and parallel to the East line of said Northwest Quarter, to a
point 404.86 feet South of the North Line of said Northwest
Quarter; thence Northerly to a point 21 . 76 feet West of the
East line of said Northwest Quarter in the North line of said
Northwest Quarter and there terminating.
Parcel. No. 7_ The South 105 feet of the East 41.0 feet and the East 110 feet
of a parcel- of land described as that part of the Northwest
Quarter of Section 13, lying North of U. S. lli gh4iay 494 and
except the aforedescrihed perpetual. easement .
Parcel No . 3 A strip of land 30 feet in width centered on a line, commencing
in the South line of the Southwest Quarter, Section i2, Township
116 North, Range 22 West, 21. 76 feet West of the East line of
said Southwest Quarter; thence Northerly to a point 74.7 feet
North of the South line and 15 feet [lest of said East line;
thence Northerly and parallel to said East line to the Creek,
and there terminating.
Parcel No. 4 The East 75 feet lying Scr_:tli of the Creek of said Southwest Quarter,
except the aforedescrihed perpetual easement; the 'Jest 75 feet
lying South of the Creek of the Southeast: Quarter of Section 12,
Township 116 North, Range 22 West, and the West 250 feet of the
South 300 feet of a parcel described as that part of Government
Lot 6, Section 13, Township 1.16 North, Range 22 West, lying North
of U.S. Highway No. 494.
Said Parcel No. 2 and No. 4 are only temporary construction easements and
r-hey sliall expire on July 1 , 1976.
8E IT RESOLVED, that the City Council of the City of Eden Prairie, a
municipal corporation, located in Hennepin County, Minnesota, has determined
that: it is necessary for reasons hereinbefore set forth that the City acquire
said easements for the installation of underground utilities.
BE IT FURTHER RESOLVED, that the City Attorneys , PERBIX, HARVEY, SIMONS
& THORTI:NNSON, P.A. , Hopkins, Minnesota, be, and they hereby are, empowered and

directed to proceed to acquire the same by purchase or condemnation under the
right of eminent domain according; to the laws of this State, and that such
proceedings be commenced, and that the Mayor and City Manager be, and they
hereby are, authorized and directed on behalf of the City to sign a petition
directed to the District Court of. Hennepin County, Minnesota, praying for
the acquisition of said lands and the appointment of r_onunissioners to appraise
the same.
ADOPTED by the City of Eden Prairie this 8th day of Aori 1 ,
1975.
