St. John's Wood Fourth Addition has been sub- mitted in the manner required for platting land under the Eden Prairie Ordinance Code and under Chapter 462 of the Minnesota Statutes and all proceedings have been duly had thereunder, and ` WHEREAS, said plat is in all -respects consistent with the City plan and the regulations and requirements of the laws of the State of Minnesota and ordin- ances of the City of Eden Prairie. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF TES CITY OF EDENi PRAIRIE: A. Plat Approval Request for St. John 's Wood Fourth Ad.d' t. is approved upon compliance with the recommendation of the City Engineer's Report on this plat dated B. variance is herein granted from City Ordinance No. 93, Sec.8, Subd. 1 waiving the six month maxixmym time elapse between the approval date of the preliminary plat and filing of the final plat as described in said Engineer's Report. C_ That the City Clerk is hereby directed to file a cert_i.fied copy of this Resolution in the office of the Register of Deed and/or Regis- trar of Titles for .their use as required by MSA 462.7358, Subd. 3. D. That the City Clerk is hereby directed to supply a certified copy of this Resolution to the owners and subdividers of the above named plat. E. That the Mayor and City Manager are hereby authorized to Execute the certificate of approval on behalf of the City Council upon com- pliance with' the foregoing provisions. JOHN'S WOOD FOURTH ADDN TO: Mayor Osterhol.t and Members of the City Council FROM: Carl Jullie, City Engineer THROUGH: Roger Ulstad, City Manager DATE: March 18, 1975 SUBJECT: St. John' s Wood Fourth Addition Y r PROPOSAL: D. 11. Gustafson and Associates, Inc . is requesting City Council approval of the Final Plat of St. John ' s Wood Fourth Addition. This is a multi-family residential plat located west . of: Baker Road and south of 62nd Street in Section HISTORY: Zoning to RM 2. 5 was finally read and approved on March 14, 1972, per City Ordinance No. 164. The Preliminary Plat was approved on September 25, 1973 , per �. Council Resolution No. 768. VARIANCES: A variance from City Ordinance No. 93, Sec. 8, Subd. 1, waiving the six month maximum time elapse between the ap- proval date of the Preliminary Plat and filing of the Final Plat is necessary. Approval of this variance is recommended because the developer has pr_nceeded with the project in a reasonable and efficient manner. UTILITIES AND STREETS: Municipal sanitary sewer, watermain and storm sewer will. be available to all areas of the Plat_ All streets will have concrete curb and gutter and full depth de- design bituminous surfacing. Outlot B shall be dedicated to the City to accommodate the future re-alignment of Baker Road as anticipated when the overall St. John' s Wood Development was approved by the City. Such dedication is consistent with what has been required from other major developers whose projects abut or encompass state and county highways and City parkways. This and future right-of-way dedication may greatly facili- tate early re-alignment of Baker Road by Hennepin County. Such dedication of Outlot B will also relieve the developer from taxation on this parcel. d Eng. Report St. John' s wood Fourth March 1B, 1975 Page 2 In a recent telephone conversation, ins. Spencer of the Hennepin County Staff indicated that the County, in their review of. the Plat, will strongly recommend dedi- cation of Outlot B. PARK DEDICATION: There will be no land dedication for public park or open space purposes within the Plat. A reasonable cash contribution in lieu of land, per City Ordinance No. 230, can be based on 15% of the assessor 's full and -true value of the land being subdivided, as previously required under Ordinance No. 93. Accordingly, this contribution would be $712. 50, based upon the land area of the Plat, excluding OUtlot B. BONDING: Sanitary sewer, watermain, storm sewer, concrete curb and gutter and paving have been completed by the developer. Therefore, no further banding will be required. RECOM-MENDAl"TON- Recommend approval of St. John' s Wood Fourth Addition, subject to the contents of this report and the following : 1. Approval by the Hennepin County Highway Dept. 2.
