Plan (PUD) - 04/01/1975 CITY OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. c'54 _ A RESOLUTION APPROVING THE PLANNED UNIT DEVELOPMENT PLAN FOR AREA F OF THE PRESERVE COMMERCIAL PLAN LD-74-PUD-12F BE IT RESOLVED, by the Council of the City of Eden Prairie, Hennepin County, Minnesota as follows : THAT,LD-74-PUD-12.F, 34 acre site is legally described as The north half of the southeast quarter of Section 24 ,-l'ownship 116, Range 22, Henn•epin County , Minnesota; Xx:cept that part platted as Franlo Road, according tb the recorded plat thereof, Hennepin County, Minnesota: Also Except that part lying 40.00 feet southeasterly and 40.00 feet northeasterly of the following described line: Beginning at a point on the north boundary of the southeast quarter of said Section 19 , distant 1.17,5 feet easterly from the northwest corner thereof thence run In a soutl'nvest2rly direction: at an a,:71e of 45050' with said north boundary fo:r a distance of 12.5 feet: thence deflect to the left on a 1° 30' curve, delta angle 70 34, for a dlsta'nce of 504 .4 feet; thence on tangent to said curve for a distance of 995. 8 feet; thence deflect to the right on a 3° 00' curve with.a radius of 1146. 28 feet for a distance of 125 feet , more or less, to the soul h boundary of the notheast quarter of south-hest quarter of said Section and there terminating; 'Together with that part of Registered Land Survey No. 166 according to the recorded plat theemf liennepin 'County, T.Ilnresota , lying westerly of the west limof Registered Land Survey No.913 according to the recorded plat thereof, Hennepin County. Hennepin County, Minnesota. excepting that portion lying northerly of tho proposed Fling Route and T.H. 169/212 THAT,the revised concept plan for Area F ( exhibit A ) , for 34 acres , located in the southwest quadrant of the T. H. 169 and City Ring Route intersection,for Regional Service , Office , Medical. Clinic , and apartment use is in conformance with the MCA PUD Plan, . LID-73-Z-P-08 . i Resolution No . 954 page 2 THAT, the owners agree to develop the aforementioned property consistent with the following requirements established by the City Council of the City of Eden Prairie : 1 , That the changes suggested in a staff report for the Area F plan are hereby incorporated as a part of the revised plan (as per Exhibit B ) . 2 . That the revised plan for Area F is an amendment to The Preserve' s LD-70-PUD-04 . 3 . That the path, walkway, plaza system shall be continuous and open to public use, through easement. Easement configuration and restrictions , if any, ^,hall be determined and given at the time of final zoning of each individual. site. (See Exhibit "C" as illustration of type and location.) 4 . That , consistent with our "Construction Agreement for the Installation of the Neill I:ake Storm Sewer", easements to t;ie City for the stov-m sewer pond and Upper Eden Lake shall be granted at the time of final plat. However. , upon final rezoning of each parcel the easement configuration may change consistent with the approved grading and site plan. 5 , That all sanitary sewer water main and sLorm sewer facilities ; curb and gutter and surfacing, whether to be public or private, shall be designed to City standards by a Registered Professional Civil Engineer rind submitted to the City Engineer for approval. The clev:_Ioper through his engineer shall provide for competent daily inspection of all street and utility construction both public and private. As-built drawings with service and valve ties on reproducible mylar and certificates of completion and compliance with specifications shall also be delivered to the City Engineer. The developer also agrees to pay all fees for City Engineering and Administrative services consistent with current City requirements. THAT, the property owners shall comply with all applicable rules, regulations , ordinances and laws of the City of Eden Prairie . THAT , if building construction on anyone parcel is not begun in accordance with the revised concept plan ( exhibit A ) within eighteen ( 18 ) months from the date hereof, the owners will not oppose city action voiding Resolution 954. Resolution No . 954 page3 f THEREFORE BE IT RESOLVED, by the City Council of the City of Eden Prairie , Hennepin County, Minnesota , that the revised concept plan for LD-74-PIJD 12F attached and labeled exhibit A and the site development requirements specified in the December 1 , 1974 , Planning Staff Report , portions hereto attached and labeled exhibit B ( and all terms and conditions of this resolution ) , are the basis upon which LD-74-PUD- 12F is granted PUD concept approval .
