HENNEPIN COUNTY , MINNESOTA
RESOLUTION NO. 936
BE IT RESOLVED, that pursuant to statutory authority, the City
Engineer for and on behalf of the City of Eden Prairie is hereby
authorized to request and obtain from the Minnesota Department of
Highways , needed engineering and technical services during the year
of 1975, for which payment will be made by the City upon receipt of
verified claims from the Commissioner of Highways.
ADOPTED this 14th day of January, 1975.

THIS AGREEMENT, made and entered into by and between the State
of Minnesota acting through its Commissioner of Highways, hereinafter
referred to as the "State`, and the County or City of Eden Prairie. M-n.
hereinafter referred to as the "User" , WITNESSETH:
WHEREAS, the User, as evidenced by Resolution, a copy of which is
attached hereto and made a part hereof as Exhibit A, does hereby request
the State tc furnish from time to time as needed and specifically requested,
technical and engineering assistance pursuant to M.S . 161 .39; and
WHEREAS , The State is authorized to provide technical and engineering
assistance to other road authorities by M.S . 161 .39, and is willing to do so;

t4OW, THEREFORE, it is mutually agreed by the parties hereto that:
1 . Tt e State shall , upon w r i tte n request by the User, provide
technical and engineering assistance and such other services as authorized
by M.S . 161 .39.
2. The State shall keep a record of its costs and expenses,
Including overhead costs, in providing assistance and services to the User
pursuant to Paragraph I above, and shall prepare an itemized statement
thereof showing the amount due hereunder and submit the same to the User
on a (monthly) (annual) basis.
3. The User agrees to pay to the Trunk Highway Fund of the
State of Minnesota all monies due hereunder and as shown by the invoices
or statements submitted to the User, within 30 days after such submission .

presents to be executed by their respective officers.
