HomeMy WebLinkAboutResolution - 935 - Approving Final Plat - Hidden Ponds 2nd Addition - 01/14/1975 January 14, 1975 CITY OF EDEN PRAIRIE IIENNEPIN' COUNTY, MINNESOTA RESOLUTION NO. 935 A RESOLUTION APPROVING FINAL PLAT OF HIDDEN PONDS 2nd ADDITION WHERE,,AS, the plat of Hidden Ponds 2nd Addition has been sub- mitted in the manner required for platting land under the Eden Prairie Ordinance Code and under Chapter 462 of the Minnesota Statutes and all proceedings have been duly had thereunder, and WHEREAS, said plat is in all respects consistent with the City plan and the regulations and requirements of the laws of the State of Minnesota and ordinances of the City of Eden Prairie. N0W, THEREFORE, BE; IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE: A. Plat Approval. Request for Hidden Ponds 2nd Addition is approved upon compliance with the recommendation of the City Engineer' s Report on this plat dated 1/10/75. B. Variance is herein granted from City Ordinance No. 93 , Sec. 8 , Subd. 1 waiving the six month maximum time elapse between the approval date of the preliminary plat and filing of the final plat as described in said Engineer' s Report. C. That the City Clerk is hereby directed to file a certified ropy of this Resolution .in the office of the Register of Deed and/or Registrar of Titles for their use as required by MSA 462- 358, Subd 3. D. That the City Clerk is hereby directed to supply a certified copy of this Resolution to the owners and subdividers of the above named plat. E. That the Mayor and City Manager are hereby authorized to Execute the certificate of approval on behalf of the City Council upon compliance with the foregoing provisions. TION a Minnesota coroora t ion S E LU N T=V O , here i nzi fter called "Owners " , and the City of Eden Prairie, a municipal_ corporation, of the State of Minnesota , hereinafter called "City" WHERFAS, It is proposed to request the City to change zoning from P . U. D . "72--10 to RI 13 . 5 for the land to be platted as Hidden Ponds 2nd Additi;�n , more fully described in Exhibit "A" attached hereto and accompanying this Agreement , and being property no,.a vested of record in 0,4ners ; and WHEREAS , It is believed that a re•-zoning of said area to RI 13 . .5 viould be in the public ' s interest , welfare and convenience of the people of the City of P,den Prairie ; and WHELZEAS , Owners agree to develop aforementioned property as a single family area in consideration of the City ' s changing of the zoning ; and Owners further agree that as a part of said consideration to lay out , develop and maintain said project as hereinafter set forth. NOW, THEREFORE, THIS AGREEMENT WITNESSETH, That for and in consideration of the City passing an ordinance changing the zoning from P .U. D . 72--•10 to RI 13 . 5 , the Owners agree to develop said property in accordance �ti,ith the architectural and landscaping plans submitted to the Staff and the City Planning Commission, subject to the fol lov i.ng cond i.t ions 1 . A pedestrian system lighted underpass and/or overpass should be provided along the major community trail vhere it intv�rsects the North/South Parkway. 2 . The N/S-E/:AT pathvjays as suggested previously should be incorporated into the plan. 3 . The dedicat _i.on of all of the land suggested accomplishes the C i_ty ' s objective of: creating open space amenities within the development and should be accepted . 4 . A home owner ' s association should be created by the developer with a dues structure, comparable to the Sterling Field Association, and a maintenance agreement reached with this home owner ' s association for the pond/park areas . 5 . Blocks 1.3 and 1.4 should be platted as outlots on the final plat rather than into the 25 Lots as proposed , and tide road which crosses the major trailway to serve this <-tr. ea should be el.i_mi.nrited and cul-•de--sac ' s north of the trail. Blocks 13 and 14 would be retained as outlots for three years from the data of approval and if the City or School District fail to acquire the property, the preliminary plat would be effectuated . 6 . The City should procoed to acquire Blocks _l3 and 14 ,-jith the purchase price to be :somewhere in the $100 , 000 . 00 range provided the developer meets the assumptions stat.nd previously fo.�: paying all assessments and cons -ruction of all roads to service the area . 7. This $100 , 000 . 00 could be repaid by assessing subsequent land developments in the area at the rate of approximately $200 . 00 per unit for cash in lieu of park land dedication. This would include areas such as the one between the entire Hidden Ponds proposal_ It is anticipated that approximately 500 additional units will be constructed in this area and will receive service benefits from the provision of this neighborhood park and/or school . 3 . If and when the Eden Prairie School District ,%7jshes to "buv into this site" , they should reimburse the City at an amount equal to one-half_ of the actual acquisition cost of this parcel or $50 , 000. 00 approximately. If this occurs the money collected in excess of the City ' s $50, 000 . 00 share will be used for additional acquisition or site development in the service area. 3 9. Approval of Block 10 as submitted . -- 2 assigns , of the property herein described . 3 _ That an executed copy of this Agreement shall be recorde6 with the Reg:ist.rar. of Deeds for the County of Hennepin, State of Minnesota . 4 . That il_ Owner fails to proceed in accordance with this Agreement within eighteen ( 18) months from the date hereof, Owner will not oppose the re-zoning of said property to a District P.U.D . rural zoning .
