GRIEVANCE POLICY AND APPEALS WHEREAS, it is desirable for the City of Eden Prairie to provide orderly procedures for the participation by Eden Prairie employees and their representatives in the formulation of personnel policies and plans to ensure the fair and considerate treatment of City employees , to eliminate employment inequities , and to provide effective means of resolving questions and controversies with respect to terms and con- ditions of employment , and WHEREAS , a grievance procedure should be established as a means of resolving disputes, and WHEREAS , the City of Eden Prairie recognizes the importance of settling disagreements and misunderstandings in an orderly, prompt, and fair manner, a manner that will maintain the self-respect of the employee , the rights of the City, and be consistent with sound manage- ment principles , and WHEREAS , to accomplish these purposes , every effort shall be made to settle employee grievances expeditiously at the lowest possible level of supervision . BE IT THEREFORE RESOLVED that the grievance policy and appeals pro- cedure be established as follows: Employees are expected to recognize the organizational structure in submitting their grievances to their immediate supervisor, division head , and department head , respectively. Whenever a grievance is directed to the attention of a super- visor, the supervisor shall promptly discuss all circum- stances with the employee and remove the cause of the grievance to the extent he deems justified . Should a department head be unable to settle a grievance to the satisfaction of the employee , the employee may request the department head , and the department head is obligated , to transmit the grievance to the City Manager. In review of the grievance , the City Manager may conduct any investigation which he deems necessary, including review of the records of the department. -2- Disposition of a grievance by the City Manager may be appealed to the City Council in writing not later than ,t five days after receipt of City Manager' s disposition . Disposition of a grievance by the City Council is subject to a judicial appeal as final. BE IT FURTHER RESOLVED the City Council encourages City employees to follow the aforementioned procedure in order to efficiently and expe- ditiously Process disagreements and that employees shall be unimpeded and free from restraint, interference , coercion, discrimination, or reprisal in seeking abjudication of their grievances and appeals . A grievance transmitted directly from an aggrieved employee to a member of the City Council. shall immediately be reduced to written form with copies made available to all Council Members and the City Manager and the appropriate department head .
