I. GREEN MID-MARKET NEIGHBORHOOD
Community Development Director Janet Jeremiah presented an update on the Green Mid-
market Neighborhood project. Three proposals (Scenic Prairie, Eden Gardens, and
Gladstone) were presented at the June 18 Council Workshop, and the City Council directed
staff to gather feedback from the public on the senior housing component of the Gladstone
proposal. Jeremiah said a total of 44 comments were received via the front counter, e-mail,
phone and City Connect. Sixteen comments were negative toward the senior housing
component, and three were positive. Twenty-nine comments were received via City Connect
—five in support of senior housing and 24 opposing it. Reasons for opposition to the senior
component include the concerns about density, increased traffic and noise.
Scenic Prairie Proposal
Jeremiah said the three development teams have refined their proposals based on City
Council feedback from the June workshop. The Scenic Prairie team has submitted two
financial options, one with 34 units priced from $240,000 to $360,000 and a $1.7 million
subsidy and $10,000 earnest money. Their second option, which does not include a subsidy,
includes 25 single-family units in the $300,000 to $360,000 price range and 12 units in the
$500,000s. Jeremiah noted that this team does not yet have an architectibuilder on board.
Eden Gardens Proposal
Jeremiah said the Eden Gardens team has addressed concerns that their home designs seemed
"cookie cutter." Their lot layouts inxlusw some variation and the buildings will not all look
the same. She said their"green" numbers have gone up, and the design includes some
mother-in-law apartments, garages in the back, rain gardens, bioswales, and more green
construction techniques. The Eden Gardens team has submitted three financial options.
Option 1 (36 units from$240,000 to $350,000) calls for a 429 assessment, $200,000 earnest
money, and reduced permitting and park dedication fees. Option 2 (36 units from$240,000
to $350,000) includes upfront land purchase for$850,000 and land write down/reduced fees.
Option 3 (12 units greater than $360,000 and 24 units from $240,000 to $360,000) includes
$1,044,000 cash land purchase, $150,000 earnest money and no subsidy. They have added

Whitten Associates (architects) and Builder's Association of Twin Cities (green path
building certification) to their team.
Gladstone
The Gladstone team is proposing 20 single family units in the $350,000+range. The senior
housing component has been redesigned as two separate buildings with a total of 70-80 units
(half of them would be affordable). Jeremiah said the Gladstone team has indicated they
would consider doing all single family, and would be willing to revise their plans to include
attached garages. Jeremiah noted that their green score is the lowest of the three proposals.
Both of their financial options are contingent on receiving an LCDA grant for the green
elements, which could be problematic given their proposed timelines.
Discussion
Mayor Tyra-Lukens said she is a bit concerned since the Gladstone team is very experienced,
and they apparently feel an LCDA grant is necessary to incorporate green features. Jeremiah
said the other proposers appear to have dug deeper into design details and they believe they
can include green features. Nelson noted that the Gladstone proposal does not include
anything in the mid-market range and does not include many green features. She said she
does not see many benefits to this proposal.
Council Member Aho said green components may not be achievable due to the associated
costs,but he does not feel the City should have to provide a subsidy to achieve that. Mayor
Tyra-Lukens said the City is looking for three elements —affordability, no subsidy, and green
component—but it seems all three may not be achievable. She said she would be willing to
consider sacrificing some of the mid-market component in order to get the green element.
She said the proposal with two-thirds market rate looks good compared to the other two.
Council Member Case suggested letting the property float out on the market. He said he
does like the green aspect of the project. There is a case for governments piloting
innovations, but he noted that there is not much other land in Eden Prairie for similar
projects. He said they may have to look at adjusting park fees in order to get all of the
elements they are looking for. Nelson said she would like a commitment to keeping at least
two-thirds of the project at mid-market. She said the second proposal seems most viable.
Aho said he is not convinced this development can work. He said until it is actually designed,
there is no way to know actual costs. He said prices may have to be increased or some features
may have to be sacrificed. Mayor Tyra-Lukens said she prefers setting the bar high to try to
get this kind of development,rather than starting out with low expectations. Case said he
favors letting the property go back on the market or simply doing as much green as possible
and letting go of the other criteria. Butcher Wickstrom said she believes doing a model project
of this type is worthwhile even if there are not many other developable properties in Eden
Prairie at the moment. City Manager Rick Getschow said a final decision does not have to be
made at this meeting. Jeremiah said she is hearing that Council does not favor subsidies for the
project and the Eden Gardens proposal is the preferred proposal.

II. OPEN PODIUM
A. Tessie Bradbury—Doi Park
Bradbury recounted an incident that recently occurred at the Staring Lake Dog Park.
She said her Yorkie was attacked by a pit bull at the entrance of the dog park. Her
dog subsequently died of its injuries. She said she has previously visited dog parks
in Minneapolis that have separate areas for small dogs. She is requesting that the
City create a similar area at Staring Lake Dog Park. She said she has spoken with
Rick Getschow and Jay Lotthammer, and feels staff has been responsive to her
request. Lotthammer said when the dog park was created, the task force that
oversaw the work did not feel the area was big enough to accommodate a separate
small dog area; however, staff has reassessed this decision and feels it would be
possible to accomplish without impeding use of the park by larger dogs.
Lotthammer said staff could provide labor and use fencing no longer in needed at
ball fields, so there would be very little cost involved.
B. James O'Toole—Weed Control
O'Toole said he is here tonight representing his Olympic Hills neighborhood. He
said the City owns an adjoining outlot where cockleburs are growing out of
control. He has asked staff to address the issue in past years, and he has
volunteered to rid the site of weeds himself. He said the site has been ignored so
far this year and the plants will be going to seed soon. He is asking that the City
be a good neighbor and take measures to eradicate the weeds. Lotthammer said
the lot is on the list of properties park maintenance staff will be spraying in
coming weeks. Lotthammer and O'Toole agreed to continue the conversation
after the meeting to come to a mutual agreement on how the matter should be
handled.

Please note that Ordinance 432-93 refers to the Developer's Agreement dated August 17, 1993,
between the City of Eden Prairie and Eden Trace Corporation. The City has approved the
development including the building, parking and the zoning for this property, based on plans as
referred to in these agreements.
The Eden Prairie Comprehensive Guide Plan Map dated March 1, 2013 indicates the property
identified above as Industrial.
Parking for this site is based on the site plan approved by the City Council.
Purposes, permitted uses and required conditions are reviewed in Section 11.30 enclosed.
A Variance has been granted via Board of Adjustment and Appeals. Final Order #93-31 is
enclosed.
As of this writing there are no applications filed for the subject property for zoning changes,
subdivision, variances, site plan approval or building permits.
Certificate of Occupancy information may be obtained from the Building Department at (952)

AN ORDINANCE OF THE CITY OF EDEN PRAIRIE, MINN MOTA, AN[ENDING THE ZONING
WITHIN A PARTICULAR ZONING DISTRICT, AND ADOPTING BY REFERENCE CITY CODE

THE CITY COUNCIL OF THE CITY OF EDEN PRAIRIE, NW4NESOTA, ORDAINS:
SECTION 1. That the land which is the subject of this Ordinance (hereinafter, the "land") is legally
described in Exhibit A attached hereto and made a part hereof.
SECTION 2. That action was duly initiated proposing that the zoning of the land be amended within
the I-2 Park Zoning District.
SECTION 3. That the proposal is hereby adopted and the zoning of the land shall be, and hereby is
amended within the I-2 Park Zoning District, and the legal description of land in such District referred to in
City Code Section 11.03, Subdivision 1, Subparagraph B, shall be, and is amended accordingly.
SECTION 4. City Code Chapter 1, entitled"General Provisions and Definitions Applicable to the Entire
City Code Including Penalty for Violation" and Section 11.99, "Violation a Misdemeanor" are hereby adopted
in their entirety, by reference, as though repeated verbatim herein.
SECTION 5. The land shall be subject to the terms and conditions of that certain Developer's

SECTION 11.30. I-INDUSTRIAL DISTRICTS.
Subd.1. Purposes.The purposes of the I-Industrial District are to:(1)Reserve appropriately located area for industrial
and related activities;(2)Protect areas appropriate for industrial use from intrusion by inharmonious uses;(3)Protect
residential and commercial properties and protect nuisance-free,non-hazardous,industrial uses from noise,odor,insect
nuisance,dust,dirt,smoke,vibration,heat and cold,glare,truck and rail traffic,and other objectionable influences,and
from fire, explosion, noxious fumes, radiation, and other hazards incidental to certain industrial uses; (4) Provide
opportunities for certain types of industrial plants to concentrate in mutually beneficial relationship to each other;(5)
Provide adequate space to meet the needs of modern industrial development including off-street parking and truck
loading areas and landscaping;(6)Provide sufficient open space around industrial structures to protect them from the
hazards of fire and minimize the impact of industrial plants on nearby uses;(7)Minimize traffic congestion and avoid the
over-loading of utilities by preventing the construction of buildings of excessive size in relation to the amount of land
around them;and,(8)Permit and reserve areas for employment activity and service to the public which do not materially
