City Center Prairie Rooms A& B 8080 Mitchell Road, Eden Prairie COMMISSION MEMBERS: Kent Barker, Tom Heffelfinger, Rob Kilpatrick, Carlo Amato VISITOR: Joy Manthey Fick, Elliot Aviation STAFF: Scott A. Kipp, Planner CALL TO ORDER Acting Chairman Heffelfinger called the meeting to order at 7:20 p.m. Commissioners Marge Bundgaard, Gary Schmidt and Allen Nitchman were absent. I. APPROVAL OF AGENDA MOTION: Amato moved, Barker Seconded, to approve the agenda as submitted. Motion carried unanimously. II. OATH OF OFFICE FOR NEW COMMISSION MEMBER Amato read and signed the Oath of Office. It was witnessed by Heffelfinger and Barker. III. ELECTION OF OFFICERS This item was unanimously approved to be deferred until the next meeting. IV. APPROVAL OF APRIL 3, 1996 MINUTES The minutes were unanimously approved as submitted. V. DISCUSSION ITEMS A. Update on Long-Term Comprehensive Plan at Met Council Kipp updated the Commission on the recent approval of the LTCP at the Met Council, indicating that MAC's next step is the Environmental Impact Statement. Kipp added that as part of the Met Council approval, they wanted the City and MAC to meet to discuss the outstanding issues; specifically Ordinance 51. Kipp Minutes FCAAC June 5, 1996 said that this meeting was held with the Met Council staff present. The outcome of the meeting was a tentative agreement to not change Ordinance 51 unless mutually agreed by MAC and the City. Barker said the City shouldn't be negotiating with MAC when they have ignored past agreements. Adding it is invalid to be negotiating with an agency that unilaterally threw out the last agreements, including MAC's "guarantee". Heffelfinger said he fears the loss of control in the decision making process. He believes the nature of the aircraft mix will change adding to the conflict. Heffelfinger said to hold off litigation is to hold off negotiating Ordinance 51, adding that any change to the ordinance will change the airport. Heffelfinger said involving any agency in a tentative agreement would essentially eliminate the agreement because of challenges to it. He said the City has already compromised by not objecting to the hangars and runway. Barker agreed. Kilpatrick arrived at approximately 7:40 p.m. Heffelfinger said the message to the City Council should be that we have compromised with removing runway length opposition and hangar opposition, but that Ordinance 51 is not to be compromised. Heffelfinger said an Advisory Commission representative should be part of any MAC and City meetings. In addition, the Advisory Commission needs to be involved daily in the environmental process. B. Design Framework Manual for Flying Cloud Airport Kipp explained the Design Framework Manual and that discussion was continued to this meeting before the manual is to be finalized. The commissioners said a lot of work went into the document, and that it would be a good product for any upgrading of the hangar facilities. Adding that the manual will help establish some consistency with the existing facilities as they improve. MOTION: Heffelfinger moved, seconded by Amato to adopt the Design Framework Manual and to forward it to the MAC and City Council for endorsement. Motion carried unanimously. C. Development Proposal - Riley Creek Ridge Minutes FCAAC June 5, 1996 Kipp updated the Commission on the Riley Creek Ridge development saying that it was scheduled to be reviewed at the Planning Commission in late June. The project involves development of 130 single family homes west of Eden Prairie Road. Approximately one third of the development is located under what is known as Safety Zone B, which MAC has agreed to purchase. The developer has decided to pursue development since MAC has made no effort to acquire property. VI. NOISE ABATEMENT PLAN/AIRCRAFT INCIDENTS A. Noise Complaints for March and April, 1996 No MAC representative was present to report on noise complaints. B. Noise Abatement Signage Implementation Schedule No MAC representative was present to update the Commission. Kipp explained that the sign package for noise abatement was to be implemented in the spring. He said he has only observed the perimeter signs regarding noise abatement, but no air side signs reminding pilots to request noise abatement runway. Some general discussion to place regarding the need for MAC to act on this implementation schedule. MOTION: Heffelfinger moved, seconded by Barker that staff send a letter on behalf of the Commission advising MAC of the need for written confirmation of the implementation of the noise abatement signs to take place no later than July 8, 1996, and to explain in writing, any added delay no later than July 5, 1996. Motion carried unanimously. VII. OTHER BUSINESS Kilpatrick was concerned about the use of runway 27R/9L during active use of the ball fields along Pioneer Trail. He said many planes, especially one of the Warbirds, actively bank their planes over the fields, sometimes during a steep climb. This could be very hazardous if a plane stalls or engine failure occurs. Kipp said a letter could be sent to the control tower, Planes of Fame Museum and MAC, advising them of the concern. VIII. ADJOURNMENT Minutes FCAAC June 5, 1996 There being no further business of the Commission, the meeting was unanimously adjourned at 9:00 p.m.
