HomeMy WebLinkAboutResolution - 529 - Acquisition of Property for Public Park Purposes by Purchase or Condemnation - 06/13/1972 VILLAGE OF EDEN f PAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 52.9 A RESOLUTION AUTHORIZING THE ACQUISITION OF PARK LANDS EITHER BY PURCHASE OR CONDEMNATION PROCEEDINGS UNDER THE RIGHT OF EMINENT DOMAIN WHEREAS, it has been necessary for the Village of Eden Prairie, a Municipal Corporation, Hennepin County, Minnesota, to acquire from time to tirr.e lands for the use of park sites because of the rapid growth in the population of the Village and the eves'-increasing number of people therein, and WHEREAS, the Village has completed the comprehensive plan for the Village which plan designates certain areas as being the logical and appropriate areas to develop as park lands , and WHEREAS, the following described tracts , pieces and parcels of land are necessary for the development of the park plan of the Village, to-wit : Parcel I. Commencing 9 chains West of Northeast corner of Lot 2 ; thence East 6 and 3/100 chains; thence Southeast to a point 2 and 52/100 chains South of Northeast corner of Lot 2; thence South to Southeast corner of Lot 2 ; thence West 9 chains; thence North to beginning, except road, in Section 2, Township 116, Range 22. That part of Government Lot 3 lying Southwesterly of Center line of Rowland Roac.1 and lying South of a line bearing South 88 degrees 46 minutes West from a point in East line of Northwest Quarter distant 2022 and 87/100 feet South of Northeast corner of Northwest Quarter, except road, and except the North 400 feet of the West 870 feet in Section 2, Township 116, Range 22. Commencing 9 chains West of Northeast currier of Lot 2 ; thence South to North shore of Bryant Lake; thence Northwesterly along lake shore to North line of Lot 2; thence Fast to beginning, in Section 2, Township 116, Range 22. Commencing 9 chains West of ,Southeast corner of Lot 2; thence East 9 chains; thence South to Bryant Lake; thence Westerly along lake to point due South. of beginning, thence North to beginning, in Section 2,Township 116, Range 22. BE IT RESOLVED, that the Village Council of .the Village of Eden Prairie, a Municipal Corporation, Hennepin County, Minnesota, has determined that it is necessary for reasons hereinbefore set forth that the Village acquire said property. BE IT FURTHER RESOLVED, that the Village Attorneys , Perbix, Harvey & Simons, P.A. , Hopkins, Minnesota, are hereby empowered and directed to proceed to acquire the same by purchase or condemnation under the right of eminent domain according to the laws of this state, and that such proceedings be commenced, and that the Mayor and Village Manager be, and they hereby are, authorized and directed on behalf of the Village to sign a petition directed to the ,District Court of Hennepin County, Minnesota, praying for the acquisition of said lands and the appointment of Commissioners to appraise the same.
