HomeMy WebLinkAboutResolution - 464 - Southside Plumbing - Denying Rezoning Request - 12/14/1971 VILLAGE OF EDEN PRAIRIE HENNEPIN COUNTY, MINNESOTA RESOLUTION NO. 464 A RESOLUTION DENYING THE APPLICATION OF SOUTHSIDE PLUMBING & HEATING CO. FOR RE- ZONING OF LOT 2, BLOCK 1 , M&K ADDITION WHEREAS, Southside Plumbing & Heating Co. did on September 7, 1971 apply for a rezoning from Rural (RU) to Industrial (I-2-PrRK) of that part of Lot 2, Block 1 , M & K Addition, and WHEREAS, the Zoning & Planning Commission of the Village of Eden Prairie by action dated October 5, 1�71 did recommend the denial of said rezoning of that part of Lot 2, Block 1 , M & K Addition lying East of the West 210 ' thereof, and 4,IHEREAS, the Council of the Village of Eden Prairie did on November 23, 1971 consider said application and hear the argument of applicant, and WHEREAS, the Village on October 14, 1969 did enact Ordinance No. 135 which ordinance establishes a comprehensive zoning plan for the Village and which ordinance is in full force and effect; and WHEREAS, the land involved in said application is zoned Rural (RU),and WHEREAS, the said Ordinance No. 135 was adopted to protect the public health, safety and general welfare of the inhabitants of said Village, and WHEREAS, no utilities exist for immediate connections, further development of industrial uses should not be permitted without utility service, and d1HEREAS, the Village Council after discussing the recommendation of the Village Planning Commission and the reasons for their denial , namely, (1 ) that development of a portion of the property would not seriously interfere with the Village' s planning efforts in the airport area; (2) that the proposed Resolution No. 464 Page Two use of the part to be rezoned would represent a nominal on-site utility use that should be able to operate effectively for the two or three years until public utilities are available; (3) that rezoning of the East 1 /2 of the site should await the Flying Cloud Master Plan study recently announced by the Metropolitan Airports Commission; and WHEREAS, the proposed development of the entire tract is inconsistent with the objectives of the comprehensive guide plan in that it tends to expand an area of industrial uses further into what has been designated for residential use, and WHEREAS, the adjacent properties are presently zoned and occupied as residential properties, NOW,THEREFORE, BE IT RESOLVED by the Village Council of the Village of Eden Prairie that based on the foregoing the application for rezoning of Lot 2, Block 1 , from Rural to Industrial be denied insofar as the request applies to that part of Lot 2, Block 1 , M & K Addition, lying East of the West 210 feet thereof.
