RESOLUTION NO. 460
A RESOLUTION AUTHORIZING THE ACQUISITION OF
PARK LANDS EITHER BY PURCHASE OR CONDEMNATION
PROCEEDINGS LINDER THE RIGHT OF EMINENT DOMAIN
WHEREAS, it has been necessary for the Village of Eden Prairie, a
Municipal Corporation, Hennepin County, Minnesota, to acquire from time to
time lands for the use of park sites because of the rapid growth in the
population of the Village and the ever-increasing number of people therein,
and
WHEREAS, the Village has completed the comprehensive plan for the Village
which plan designates certain areas as being thelogical and appropriate areas
to develop as park lands, and
WHEREAS, the following described tracts, pieces and parcels of land are
necessary for the development of the park plan of the Village, to-wit:
That part of Government Lot 3, Section 22, Township 116, Range 22
i West of the 5th Principal Meridian, lying West of the North South
Center line of Section 22. Also an easement over that part of
Government Lot 4, Section 22, Township 116, Range 22, being a
strip of land 20 feet in width and being 10 feet on each side of
the following described center line: Beginning at a point in the
South line of said Government Lot 4, distant 154.9 feet west of a
point which is midway between two concrete posts in Purgatory Creek;
thence North 7 degrees, 5 minutes West a distance of 92 feet ; thence
North 2 degrees, 55 minutes west 407 feet, more or less, to the
center line of town road, formerly known as County Read No. 2, and
there terminating; for purposes of this description the South line
of said Government Lot 4 is assumed to be a due East and West line.
That part of Government Lot 1 and that portion of the Southwest
Quarter of the Southeast Quarter, Section 21, Township 116, Range 22,
lying south of St. Paul and Chaska road;
That part of Tracts A and B, Registered Land Survey No. 1085, Files
of the Registrar of Titles , Hennepin County, Minnesota, lying in
Section 221 Township 116, Range 22;
All that part of the following described property situated in
Government Lot 1, Section 13, Township 116, Range 22, and accretions
thereto, described as : Beginning at a point 1141.84 feet North of
the South line of said Government Lot 1 along a line drawn parallel
to and 640 feet West, measured at right angles, from the East line
of said Government Lot 1, which point is marked by a Judicial Land-
mark ; thence South along said parallel line 831.39 feet, which point
is marked by a Judicial Landmark; thence deflecting to the right 92
degrees, 05 minutes and 36 seconds a distance of 328.28 feet which
point is marked by a Judicial Landmark; thence deflecting to the right
88 degrees, 26 minutes and 29 seconds a distance of 317. 5 feet, which
point is marked by a Judicial Landmark; thence deflecting to the
left 90 degrees and 01 minute along a line to be hereafter known as
Line "A", a distance of 907.3 feet, which point is marked by a
Judicial Landmark; thence deflecting to the right 1 degree, 36 minutes
and 50 seconds a distance of 519.75 feet, which point is marked by
a Judicial Landmark; thence deflecting to the right 127 degrees, 07
minutes and 35 seconds a distance of 442.95 feet, which point is marked
by a Judicial Landmark; thence deflecting to the right 50 degrees,
44 minutes and 30 seconds a distance of 370.0 feet, which point is
marked by a Judicial Landmark; thence deflecting to the left 90 degrees
a distance of 129.95 feet to a point 1101.05 feet West of the point
of beginning on a line drawn West at right angles to the first described
parallel line from the point of beginning which point is marked by a
Judicial Landmark; thence East 1101.05 feet- to the point of beginning
according to the Government Survey thereof, except that part which
lies South of the Easterly extension of said Line "A" to the East
line of above described property.

BE IT RESOLVED, that the Village Council of the Village of Eden Prairie,
a Municipal Corporation, Hennepin County, Minnesota, has determined that it is
necessary for reasons hereinbefore set forth that the Village acquire said
property.
BE IT FURTHER RESOLVED, that the Village Attorneys, Perbix, Harvey &
Simons, Hopkins, Minnesota are hereby empowered and directed to proceed to
acquire the same by purchase or condemnation under the right of eminent domain
according to the laws of this state, and that such proceedings be commenced,
and that the Mayor and Village Manager be, and they hereby are, authorized
and directed on behalf of the Village to sign a petition directed to the
District Court of Hennepin County, Minnesota, praying for the acquisition of
said lands and the appointment of Commissioners to appraise the same.
ADOPTED by the Village of Eden Prairie this 26th day of October, 1971.
