HomeMy WebLinkAboutResolution - 373 - Resolution Establishing a Lateral Utility Extension Policy - 10/13/1970 VILLAGE OF EDEN PRAIRIE HENNEP IN COUNTY, MINNESOTA RESOLUTION NO. 373 A RESOLUTION ESTABLISHING A LATERAL UTILITY EXTENSION POLICY BE IT RESOLVED, by the Village Council of the Village of Eden Prairie, Minnesota as follows: 1 . Public health conditions shall be the number one consideration in determining the need for public utilities in existing neighborhood sub- divisions and those presently being developed. 2. A second consideration for extending public utilities shall be the threat or alleviation of pollution to our lakes and waterways. 3. A third consideration is neighborhood need. If 20%to 30% of the homes are experiencing difficulty with their septic systems or wells, this would be considered ample evidence that attention to this situation is required and possible Village action needed. 4. Individual or relatively isolated problems with drain fields and wells should not be cause to initiate a neighborhood project. In those instances where less than, 20%-30% of existing septic systems or wells are operating with difficulty the Village will attempt to determine Whether or not individual prop- erty owners can provide corrective measures sufficient to protect public health. If such measures are possible the owners shall be required to individually remedy their situation. If such measures do not seem to be possible the Council will review the situation and determine what, if any, Village action is needed. 5. It shall be the objective of the Council to implement sewer and water at the lowest possible cost and develop the financial information needed to document tnat the solutions provi ded soul d be most practical and economical ; consi stant with the proper safeguard of public health and natural resources. 6. It shall be part of this policy to require and provide the extension of utilities in newly developing areas, newly developing commercial areas and newly developing industrial areas where the cost is to be assessed against the benefited property.
