HomeMy WebLinkAboutResolution - 372 - Resolution Confirming and Adopting south Washington Improvement - 10/01/1970 EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF EDEN PRAIRIE, MINNESOTA Pursuant to due call and notice thereof, a regular-special meeting of the Village Council of the Village of Eden Prairie was held on the 8 day of September ,19 70 , commencing at 7 :30 o'clock, P.M. , at the Village Hall , 8950 County Road #4, Eden Prairie, Minnesota. The following members were present: Mayor Osterholt, Councilmen Leib, Nesbitt, Redpa th and Haugen. The following members were absent : Nonc ,`1r. Redpath introduced the following resolution and moved its adoption. P RESOLUTION NO. 372 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR SOUTH WASHINGTON AVE. IMPROVEMENT WHEREAS, Pursuant to due and proper notice according to law an assessment hearing was held on the 8th day of September, 1970 relating to South Washington Ave. Improvements and, WHERAS, All persons present desiring to be heard were heard and their objections, if any, were noted t r NOW, THEREFORE , BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF EDEN PRAIRIE, MINNESOTA, AS FOLLOWS: 1 . The Village Clerk has calculated the proper amounts to be specially assessed for South Washington Ave. Improvements against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filled in this office tabulat6d -statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same. 2. Notice has boon duly published as required by law that this Council would merit in regular session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons inter- ested, and an opportunity has been given to all intended persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed. 4. This Council finds that each of the lots,pieces or parcels of land enumerated in saki proposed assessment was and is specially benefited by the south Washington Ave. Improvements. in the amount in said proposed assessment set opposit4 the description of each such lot, piece. or parcel of land ' and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for: 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the samiie have been paid at the rate of b per cent per annum. -2- 8. Such �assussments shall bt payable in 8 equal amount instal 1 m,2nts payable on the 1 ST day of January in eaach year, beginning, i n the year 1971 , and Continuing until all of said installments shall have buen paid, each installment to bE collected with taxes collectable during said year by the County ;auditor. Th-� Village: Clerk is hc-ruhy di rccted to make up and file in the office of th(;: County ,-,�aditors of Hennepin County a curtificd statement of the: amount of all of such unpaid assessments and the: amount which i!ill Lo due thereon on the 1st day of January in teach year.
